This seems like a a sweet gig, whilst patent examiner seems like SPS. Describe your average day and how much $ do you make?

Average day I telecommute from a desk in my living room.

Review approximately 15 applications a day.

Between 60 and 90.

Pop quiz: someone applies for AUTOADMIT in Class 9, intent to use. They are allowed. They submit a statement of use and specimen. Specimen shows AUTOADMIT NETWORK.

Do you accept it?

Oh hai!

No. Unless network is clearly generic based on applicant's particular identification of goods/ services.

Although I would say that autoadmit is likely IC 38.

Thx.

It could be.

But based on this scenario if it (NETWORK) is, as a matter of fact, distinguishable, it's not part of the mark on the spec.

That's what I'm thinking. Like, it's the equivalent of "the most prestigious admissions board in the world" Just something that sometimes also accompanies the mark, but is not part of it.

brother, how can I avoid getting merelydescriptivePWN3d on a pretty fucking descriptive TM app, that was registered for about 7 years but then the owner accidentally let it lapse? If I do a 2(f) claim to the office action, with an affidavit showing like 10 years of continuous use, will I likely get the registration?

Isn't there some sort of presumption after 5 years of use. You probably won't even need to send in the evidence.

Caveat: this is a bit outside my area of expertise

yes there is. that's what a "2(f)" claim is for. this particular app has been chapping my ass for months, about to do a 2(f) claim for it. Its descriptive as fuck, but was registered for 7 years, and been used in commerce for over 10 years. Also, the client will go ballistic if we mess this one up.

Eh, file the application, and if they require documentation/evidence to support secondary meaning then gather up all you've got and see if the client is willing to pay for some sort of survey or something.

Is it your firm that let it lapse in the first place? If so, that sucks for you.
