The result is correct--the use of employment testing should be encouraged despite the disparate impact.

(I was not excited about Obama, however--I'm a big fan of Dean, and I was in favor of Edwards in the primary)

I'm not convinced a long multiple choice test is the best way to select firefighters for leader positions, but of course it's blatantly unfair to go back and just scrap the results because they turn out to not be PC.

Did you read about all the stuff they did to make the test fair? There is no way to "fix" the test except to dumb it down.

I didn't read it, but why have a multiple choice test at all? Can't the managers observe performance, interview the guys, and figure out who should be promoted like in most other workplaces

I'm not sure how I feel about this. I do like that this sort of testing is somewhat objective and insures that the fire fighters know the regulations when promoted. On the other hand, what you said is also true. It could work like any other job.! The thing I am not ok with is moving away from testing just to promote more blacks.

part of the point is to have an objective component rather than making it wholly subjective, contingent upon favoritism, etc. you just have a threshold test of objectivity, then you can promote within that based on performance.

Yeah, I agree with this. Although I suspect that while a multiple choice test isn't ideal, it could be helpful if used in combination with some other factors. Ideally you'd want someone who both knew their stuff, had a history of good performance and who was respected by the people they'd be supervising.

none of course. I would suck as a firefighter, and even more as a leader of firefighters, but I'm sure I could ace that multiple choice test with a couple of days of study.

Why does everyone presume that multiple choice tests are a poor way to weed out firefighters for leadership positions? Those in such positions need to be able to make command decisions based on complicated matters such as structural dynamics and combustion principles. Those are the most important qualities--knowing how to fight a fire that's engulfing a building when lives are at stake. The "soft" leadership factors are probably less important than the things one needs to study for hours on end to comprehend and apply in real life situations.

I'm not an expert, but I'm puzzled by the presumption that multiple choice tests are suboptimal for such positions. Is it because everyone envisions firefighters as dudes with hoses who occasionally help cats out of trees?

Do you understand, though, the difference between practical firefighting skills, which every firefighter develops, and leadership skills, which includes telling the firefighters what to do, where to go, what side of the building to enter, etc, based on their understanding of where the building will crumble? That's very difficult to test in any other way than on a written/multiple choice test.

I don't see this as a major concern. All the people taking the test are already firefighters able to perform their duties. It's impossible for someone to come in and take the test without being able to work as a fire fighter.

In fact, we need more employment testing. If it weeds out the dumb blacks, that's ok--instead, we'll have more efficient hiring and promotion decisions. See http://www.centerforcollegeaffordability.org/uploads/Griggs_vs_Duke_Power.pdf

LOL at Ginsburg declaring the test "flawed." I recall when I was a young teenager. Having read the Bell Curve, and being a naive believer in the beauty of racial equality, I was surprised to find convincing evidence that whites are smarter than blacks. I read some "rebuttals" to the Bell Curve. Uniformly, they declared the Bell Curve tests "flawed," but I found the reasoning unsound. Every test that shows whites are much smarter than blacks on average is flawed, according to these so-called scientists, regardless of whether the tests control for nutrition, socioeconomic factors, schooling, what have you. the tests are flawed because they reach the racist result. and we must ignore the fact that blacks all over the globe are unsuccessful, and they've always been unsuccessful, because history too yields a racist result.
