You claim that your main reason for going to law school is that you enjoy studying the law. Let's assume that you're telling the truth and aren't simply rationalizing your failure.
Have you considered that the cost of law school is wildly disproportionate to any enjoyment you might derive from it? If you just want to study the law, here's what you do: 1) Buy some casebooks and a subscription to Lexis. 2) Pay some law students to let you attend their study group sessions. This is a much cheaper solution if, as you claim, you don't care about the JD. |

My friend got screwed out of her house by her son and daughter-in-law. She told me after she had already done it, but even if she had told me before, there was nothing I could do. Had I advised her on what to ask her lawyer to include in the agreement, I would have been practicing law without a license. I had to stand by and watch an elderly woman lose the home she had paid into for years.
I dont need to work but having the JD means I could help in situations like that. |

Then the son got married. He told her that his wife became co-owner of the house upon marriage. They told her if she signed over her portion of the house to them, it would mean tax benefits for them.
In NY that would not be the case because property acquired before marriage remains personal, according to Matrimonial law teacher. but this took place in Jersey.
Ok, she tells me AFTER it's a done deal and the paperwork is signed. The attorney did a straightforward life estate agreement where she signed over her share and was given the right to remain in the house for life.
I'm not saying that the attorney committed malpractice. He did a straightforward life estate. However, isn't a lawyers job to look out and protect to the best possible extent his client's interest.
At the time the agreement was signed, the son had a solid job and no one ever imagined things would change?
When she told me what she did, the first questions out of my mouth were
1. Now what provision did the lawyer make in case, heaven forbid, your son dies and the daughter in law remarries and wants to sell the house.
2. What happens if for some reason, your son decides to move and sell the house? Did your lawyer write up the agreement in such a way that you would share in the proceeds of the sale to compensate for the years you paid the mortage and taxes in the house. (He didn't and she wasn't)
The son lost his job, had to move down south. The life estate clause created a problem and made it difficult to sell the house. It was a mess that could have been avoided with a little more foresight on the the lawyers part.
The house was finally sold, my friend in an assisted living in facility down south after being mistreated by her daughter in law. She did not receive one cent of compensation from the sale of the house.
Is there a legal claim against the attorney probably not, but I knew enough to ask about those circumstances arising. I know one thing, had I been my friends lawyer, I would have have advocated more aggressively for her to be protected from the circumstances that did arise, just as I had predicted.
So if my concerns were useless, then I guess, I dont belong in law at all. How presumptious of me for thinking I should care about my clienta as much as possible and not just do the minimum to be competent

If she has a life estate the son can't force a sale. He has only a future interest that he may protect from certain actions by the life tenant. They would not be able to sell w/o the life tenant's consent. To hold otherwise would make a life estate worthless, which is why courts don't do so.

I wasn't interested in going there. Just as I was not interested in going to Harvard. "Best" is a subjective, not objective description.
I dont do well on LSAT's. I do well on exams. How do I know because I've practiced them.? Some I get on line and compare my answers to the models. I've asked some of the lawyers in the family to share some of there old exams with me. I do them and give them back to be graded.

He's 96, still works as a lawyer, and has worked for the same NYC litigation firm for the past 70 years or so.
So no, I dont object to taking pointers in litigation from him.

Where do you get off judging what the enjoyment that I derive from a particular activity is "wildly disproportionate" to the cost. That's a personal judgement that no one else can make for me.
I dont care about the JD, but I cant practice law without it. True, I dont have to work, but I've had to stand by and see so many people get screwed because they couldn't afford competent legal help. I knew what they needed to do and could have helped many of them, but I didnt have that piece of paper and practicing law without a license is a big no-no.
Who are you or anybody else to tell me just to buy a few casebooks and subscribe to lexis and be satisfied with that.
And what "failure" are you referring to? My failure at getting in to a particular school. Using that yardstick, then 99 percent of law school applicants since very few get accepted everywhere they apply to. |

I dont have to work now. It's the payoff for having struggled for so many years. But I could choose to work on a few cases here or there as needed. I could do legal work for people at reduced rates, so that those who might not be able to have legal assistance would have to somewhere to turn. Oh wait, my choosing to spend my money to subsidize legal access for people will most surely annoy and offend the exalted ones on this board. |
