Brothers and nominal sisters in anonymity,

We gather here to today, in the presence of Big Changes, to mourn the loss of our renowned leader, the prophet and Great Teacher Onizuka, Anthony Ciolli. May the Washington Post have mercy on his soul. He is not retired, of course, but he has resigned as our Chief Educational Director. Although I do not have the faintest notion what the significance of that particular position was, I suppose it to be quite important. At the very least, we know it to be a very tragic day when Mr. Ciolli voluntarily resigns such a choice gold star on his resume. Yet, whether resigned or retired or resurrected on the third day, I do not think I speak presumptuously when I say that within the coal-blackened heart of each true xoxoer, there beats an everlasting song of gratitude and devotion to the Great Teacher.

Or not.

We have lost a leader. But more importantly, we have lost our way. The events of late point to an unprecedented identity crisis the like of which xoxo has never faced. The outcome of this struggle will prove determinative, not only for the future of each board member, but for the hope and future of the human species. We are the greatest, the most ambitious, and the most prestigious social experiment in freedom that has ever been undertaken in the history of the world. If we fail, then we not only fail ourselves, but we fail each generation that has worked to grant us the inalienable right to say what we choose, and each generation that will receive from us not the torch of liberty, their birthright, but the ashes of despair and silence.

The relentless attacks by Reputation Defender, compounded by the unfathomable stupidity and cruelty of a certain undesirable element recently introduced to the board, have no doubt strained us all. That the temple of Yale, which yearly on the USNWR vigil feast we have ever paid homage--yes, even Yale has turned its back upon us, because of the actions of a single lonelyvirgin. We must rest in the knowledge that there will be fire and brimstone poured upon that evildoer, hopefully by a magical invisible being in the sky. Yet even that wretch is not the concern here. We are fighting instead for the soul of AutoAdmit. It is on this theme that I wish to address our Wednesday sermon.

Over the years, of course, this board has faced attacks from without and scandals from within. We have been a persecuted and peculiar people, from the first Exodus, when we escaped the moderation of the Princeton Review, to the Leiternacht and the Night of a Thousand Cunts. Yet whenever the wolf has set himself upon the flock, sometimes by skillfully impersonating a lamb, we have proven more clever than sheep. We have not only survived--we have endured. Yea, though we walked through the valley of the shadow of grateful shiteaters, we feared no evil. We have enjoyed great fortune in this regard, not simply because of idle probabilities, but because throughout we have held fast to certain immutable ideals

We, the community of this most prestigious discussion board, believe above all that the freedom of speech necessarily holds social value as a step towards truth, however slight a step that may be. We believe that it is only in the clash of well-formulated ideas and in the minefield of tubgirl links that the constant human hunger for a true epistemology can be satisfied. And while we believe that individuals must always be responsible for their conduct, we believe strongly that there must always be a public space for people to speak without fear of censure or reprimand, a place where people are judged not by the color of their speech, but the content of their resumes.

At times like these, we must necessarily ask ourselves if there is any value in defending the vile filth that regularly pollutes this message board? Is the sexual humiliation of Holocaust victims a topic for civilized discussion? Does it really matter whether WhitePride is allowed to wear his hood on this board? Might it not have been better if we never read saltybabe's worthless thoughts? Who the fuck really wants to say hi to pensive all the time? Would any weep if Pauliewalnuts were raped by a dozen AIDS-infected leprechauns and left to dry out in the lukewarm glow of Rowan's platitudes? Is there any value to free speech? Is there any value to the First Amendment? Does free speech really matter?

Should we defend AutoAdmit?

Yes. It must be defended not merely because this sermon is posted here. It must be defended because it is the truth of humanity in the mass. If xoxo seems a corrupt wasteland of indecency and garbage, it is only because that is human nature, unfeettered by social restraints. If we shudder when we see the depravities perpetrated here, it is only because we shudder at the dark mirror of our own soul. We are like yourselves, gentle reader, only truer. We have not altered not jot or tittle of our humanity, except that we could told the truth. It conclusively demonstrates an awful truth that every priest who has ever taken a confession--for that is what we are, penitent confessors all--has known: that beneath every cherubic smile lies the sensuous, demon-frenzied heart of a naughty boy. We show people as they truly are, in all their irredeemable ugliness, in all the hues and shades of pettiness, conceit, dishonesty, malice, spite, cowardice, cruelty, greed, inanity, lust, envy, and violence.

Yet if it had been otherwise, we might have had so much the more to answer for. Whatever benefit gained Xoxo might have been like the, as we read in the Book of Kaavya, "four major department stores and 170 specialty shops" selling their homogenized products, enforcing a common standard of mediocrity, stifling dissent at the moment it was ever phrased in uncomfortable or even unusual terms. Could such an environment have given us an xoxo dungeonmasTTTer? Would a legendary schtick like Call Me Ishmael have ever stood a chance against the philistine censor, always straining for topicality while swallowing whole caravans of relevance? Might we have not naively assumed, as do the poor deluded saps in the other religions, that we will get in everywhere we apply? And if we have lost some measure of innocence, have we not gained great multitudes of wisdom? Think now and then, when you are tempted to regret this board, that you might have been like Melissa Lafsky, the high priestess of the false idol Opinionista, who trollopped through her years expecting that law would be some cauldron of half-decency, only to be tragically and amusingly mistaken.

And if there is to be any further greatness in the human spirit, it will only come when it has met trial against the worst adversity, like gold refined in the crucible. We are that crucible. Only in the white-hot heat of our relentless flaming will be forged the perfect instruments of prestige.

It thus that we stand today in defense of humanity--not the perfect or idealized humanity, constrained to the lies we are forced to say every day, whilst our secret thoughts resound a furious dissenting refrain--but the authentic human, flawed and yet triumphant, repugnant and yet strangely beautiful. And so it is that we dedicate ourselves to a dream.

We have a dream that one day all of our children, T14s and TTTs, CGWBT and WGWAG, URM and KKK, will join together hand in hand and sing in the words of the old Nigger spiritual, "True at last! True at last! Thank USNWR Almighty, we are true at last!"

This is not yet the end. It is not even the beginning of the end. But it is, perhaps, the end of the beginning.

Upon this battle depends the survival of Cohen's civilization. Upon it depends our own shitty life, and the long continuity of our pretensions and our schticks. The whole fury and might of the enemy must very soon be turned on us. Fertik knows that he will have to break us on this Board or lose the war. If we can stand up to him, all the Internet may be free and the life of the world may move forward into broad, sunlit uplands. But if we fail, then the whole world, including the United States, including all that we have known and cared for, will sink into the abyss of a new Dark Age made more sinister, and perhaps more protracted, by the lights of perverted cease and desist orders. Let us therefore brace ourselves to our duties, and so bear ourselves that if this discussion board and its common filth last for a thousand years, cool guys with cool haircuts will still say, "This was their finest hour!"

When reviewing recent events at this board, it is apparent that we have done everything that could be done to avert the storm which is now coming on. We have petitioned; we have remonstrated; we have supplicated; we have prostrated ourselves before the throne, and have implored its interposition to arrest the tyrannical hands of the forces of censorship and legal blackmail.

Interwoven as is the love of liberty with every ligament of your hearts, no recommendation of mine is necessary to fortify or confirm the attachment.

The unity of government which constitutes you one people is also now dear to you. It is justly so, for it is a main pillar in the edifice of your real independence, the support of your tranquility at home, your peace abroad; of your safety; of your prosperity; of that very liberty which you so highly prize. But as it is easy to foresee that, from different causes and from different quarters, much pains will be taken, many artifices employed to weaken in your minds the conviction of this truth; as this is the point in your political fortress against which the batteries of internal and external enemies will be most constantly and actively (though often covertly and insidiously) directed, it is of infinite moment that you should properly estimate the immense value of your national union to your collective and individual happiness; that you should cherish a cordial, habitual, and immovable attachment to it; accustoming yourselves to think and speak of it as of the palladium of your political safety and prosperity; watching for its preservation with jealous anxiety; discountenancing whatever may suggest even a suspicion that it can in any event be abandoned; and indignantly frowning upon the first dawning of every attempt to alienate any portion of our country from the rest, or to enfeeble the sacred ties which now link together the various parts.

For this you have every inducement of sympathy and interest. Citizens, by birth or choice, of a common country, that country has a right to concentrate your affections. The name of American, which belongs to you in your national capacity, must always exalt the just pride of patriotism more than any appellation derived from local discriminations. With slight shades of difference, you have the same religion, manners, habits, and political principles. You have in a common cause fought and triumphed together; the independence and liberty you possess are the work of joint counsels, and joint efforts of common dangers, sufferings, and successes.

But these considerations, however powerfully they address themselves to your sensibility, are greatly outweighed by those which apply more immediately to your interest. Here every portion of our country finds the most commanding motives for carefully guarding and preserving the union of the whole.

The North, in an unrestrained intercourse with the South, protected by the equal laws of a common government, finds in the productions of the latter great additional resources of maritime and commercial enterprise and precious materials of manufacturing industry. The South, in the same intercourse, benefiting by the agency of the North, sees its agriculture grow and its commerce expand. Turning partly into its own channels the seamen of the North, it finds its particular navigation invigorated; and, while it contributes, in different ways, to nourish and increase the general mass of the national navigation, it looks forward to the protection of a maritime strength, to which itself is unequally adapted. The East, in a like intercourse with the West, already finds, and in the progressive improvement of interior communications by land and water, will more and more find a valuable vent for the commodities which it brings from abroad, or manufactures at home. The West derives from the East supplies requisite to its growth and comfort, and, what is perhaps of still greater consequence, it must of necessity owe the secure enjoyment of indispensable outlets for its own productions to the weight, influence, and the future maritime strength of the Atlantic side of the Union, directed by an indissoluble community of interest as one nation. Any other tenure by which the West can hold this essential advantage, whether derived from its own separate strength, or from an apostate and unnatural connection with any foreign power, must be intrinsically precarious.

While, then, every part of our country thus feels an immediate and particular interest in union, all the parts combined cannot fail to find in the united mass of means and efforts greater strength, greater resource, proportionably greater security from external danger, a less frequent interruption of their peace by foreign nations; and, what is of inestimable value, they must derive from union an exemption from those broils and wars between themselves, which so frequently afflict neighboring countries not tied together by the same governments, which their own rival ships alone would be sufficient to produce, but which opposite foreign alliances, attachments, and intrigues would stimulate and embitter. Hence, likewise, they will avoid the necessity of those overgrown military establishments which, under any form of government, are inauspicious to liberty, and which are to be regarded as particularly hostile to republican liberty. In this sense it is that your union ought to be considered as a main prop of your liberty, and that the love of the one ought to endear to you the preservation of the other.

These considerations speak a persuasive language to every reflecting and virtuous mind, and exhibit the continuance of the Union as a primary object of patriotic desire. Is there a doubt whether a common government can embrace so large a sphere? Let experience solve it. To listen to mere speculation in such a case were criminal. We are authorized to hope that a proper organization of the whole with the auxiliary agency of governments for the respective subdivisions, will afford a happy issue to the experiment. It is well worth a fair and full experiment. With such powerful and obvious motives to union, affecting all parts of our country, while experience shall not have demonstrated its impracticability, there will always be reason to distrust the patriotism of those who in any quarter may endeavor to weaken its bands.

In contemplating the causes which may disturb our Union, it occurs as matter of serious concern that any ground should have been furnished for characterizing parties by geographical discriminations, Northern and Southern, Atlantic and Western; whence designing men may endeavor to excite a belief that there is a real difference of local interests and views. One of the expedients of party to acquire influence within particular districts is to misrepresent the opinions and aims of other districts. You cannot shield yourselves too much against the jealousies and heartburnings which spring from these misrepresentations; they tend to render alien to each other those who ought to be bound together by fraternal affection. The inhabitants of our Western country have lately had a useful lesson on this head; they have seen, in the negotiation by the Executive, and in the unanimous ratification by the Senate, of the treaty with Spain, and in the universal satisfaction at that event, throughout the United States, a decisive proof how unfounded were the suspicions propagated among them of a policy in the General Government and in the Atlantic States unfriendly to their interests in regard to the Mississippi; they have been witnesses to the formation of two treaties, that with Great Britain, and that with Spain, which secure to them everything they could desire, in respect to our foreign relations, towards confirming their prosperity. Will it not be their wisdom to rely for the preservation of these advantages on the Union by which they were procured ? Will they not henceforth be deaf to those advisers, if such there are, who would sever them from their brethren and connect them with aliens?

To the efficacy and permanency of your Union, a government for the whole is indispensable. No alliance, however strict, between the parts can be an adequate substitute; they must inevitably experience the infractions and interruptions which all alliances in all times have experienced. Sensible of this momentous truth, you have improved upon your first essay, by the adoption of a constitution of government better calculated than your former for an intimate union, and for the efficacious management of your common concerns. This government, the offspring of our own choice, uninfluenced and unawed, adopted upon full investigation and mature deliberation, completely free in its principles, in the distribution of its powers, uniting security with energy, and containing within itself a provision for its own amendment, has a just claim to your confidence and your support. Respect for its authority, compliance with its laws, acquiescence in its measures, are duties enjoined by the fundamental maxims of true liberty. The basis of our political systems is the right of the people to make and to alter their constitutions of government. But the Constitution which at any time exists, till changed by an explicit and authentic act of the whole people, is sacredly obligatory upon all. The very idea of the power and the right of the people to establish government presupposes the duty of every individual to obey the established government.

All obstructions to the execution of the laws, all combinations and associations, under whatever plausible character, with the real design to direct, control, counteract, or awe the regular deliberation and action of the constituted authorities, are destructive of this fundamental principle, and of fatal tendency. They serve to organize faction, to give it an artificial and extraordinary force; to put, in the place of the delegated will of the nation the will of a party, often a small but artful and enterprising minority of the community; and, according to the alternate triumphs of different parties, to make the public administration the mirror of the ill-concerted and incongruous projects of faction, rather than the organ of consistent and wholesome plans digested by common counsels and modified by mutual interests.

However combinations or associations of the above description may now and then answer popular ends, they are likely, in the course of time and things, to become potent engines, by which cunning, ambitious, and unprincipled men will be enabled to subvert the power of the people and to usurp for themselves the reins of government, destroying afterwards the very engines which have lifted them to unjust dominion.

Towards the preservation of your government, and the permanency of your present happy state, it is requisite, not only that you steadily discountenance irregular oppositions to its acknowledged authority, but also that you resist with care the spirit of innovation upon its principles, however specious the pretexts. One method of assault may be to effect, in the forms of the Constitution, alterations which will impair the energy of the system, and thus to undermine what cannot be directly overthrown. In all the changes to which you may be invited, remember that time and habit are at least as necessary to fix the true character of governments as of other human institutions; that experience is the surest standard by which to test the real tendency of the existing constitution of a country; that facility in changes, upon the credit of mere hypothesis and opinion, exposes to perpetual change, from the endless variety of hypothesis and opinion; and remember, especially, that for the efficient management of your common interests, in a country so extensive as ours, a government of as much vigor as is consistent with the perfect security of liberty is indispensable. Liberty itself will find in such a government, with powers properly distributed and adjusted, its surest guardian. It is, indeed, little else than a name, where the government is too feeble to withstand the enterprises of faction, to confine each member of the society within the limits prescribed by the laws, and to maintain all in the secure and tranquil enjoyment of the rights of person and property.

I have already intimated to you the danger of parties in the State, with particular reference to the founding of them on geographical discriminations. Let me now take a more comprehensive view, and warn you in the most solemn manner against the baneful effects of the spirit of party generally.

This spirit, unfortunately, is inseparable from our nature, having its root in the strongest passions of the human mind. It exists under different shapes in all governments, more or less stifled, controlled, or repressed; but, in those of the popular form, it is seen in its greatest rankness, and is truly their worst enemy.

The alternate domination of one faction over another, sharpened by the spirit of revenge, natural to party dissension, which in different ages and countries has perpetrated the most horrid enormities, is itself a frightful despotism. But this leads at length to a more formal and permanent despotism. The disorders and miseries which result gradually incline the minds of men to seek security and repose in the absolute power of an individual; and sooner or later the chief of some prevailing faction, more able or more fortunate than his competitors, turns this disposition to the purposes of his own elevation, on the ruins of public liberty.

Without looking forward to an extremity of this kind (which nevertheless ought not to be entirely out of sight), the common and continual mischiefs of the spirit of party are sufficient to make it the interest and duty of a wise people to discourage and restrain it.

It serves always to distract the public councils and enfeeble the public administration. It agitates the community with ill-founded jealousies and false alarms, kindles the animosity of one part against another, foments occasionally riot and insurrection. It opens the door to foreign influence and corruption, which finds a facilitated access to the government itself through the channels of party passions. Thus the policy and the will of one country are subjected to the policy and will of another.

There is an opinion that parties in free countries are useful checks upon the administration of the government and serve to keep alive the spirit of liberty. This within certain limits is probably true; and in governments of a monarchical cast, patriotism may look with indulgence, if not with favor, upon the spirit of party. But in those of the popular character, in governments purely elective, it is a spirit not to be encouraged. From their natural tendency, it is certain there will always be enough of that spirit for every salutary purpose. And there being constant danger of excess, the effort ought to be by force of public opinion, to mitigate and assuage it. A fire not to be quenched, it demands a uniform vigilance to prevent its bursting into a flame, lest, instead of warming, it should consume.

It is important, likewise, that the habits of thinking in a free country should inspire caution in those entrusted with its administration, to confine themselves within their respective constitutional spheres, avoiding in the exercise of the powers of one department to encroach upon another. The spirit of encroachment tends to consolidate the powers of all the departments in one, and thus to create, whatever the form of government, a real despotism. A just estimate of that love of power, and proneness to abuse it, which predominates in the human heart, is sufficient to satisfy us of the truth of this position. The necessity of reciprocal checks in the exercise of political power, by dividing and distributing it into different depositaries, and constituting each the guardian of the public weal against invasions by the others, has been evinced by experiments ancient and modern; some of them in our country and under our own eyes. To preserve them must be as necessary as to institute them. If, in the opinion of the people, the distribution or modification of the constitutional powers be in any particular wrong, let it be corrected by an amendment in the way which the Constitution designates. But let there be no change by usurpation; for though this, in one instance, may be the instrument of good, it is the customary weapon by which free governments are destroyed. The precedent must always greatly overbalance in permanent evil any partial or transient benefit, which the use can at any time yield.

Of all the dispositions and habits which lead to political prosperity, religion and morality are indispensable supports. In vain would that man claim the tribute of patriotism, who should labor to subvert these great pillars of human happiness, these firmest props of the duties of men and citizens. The mere politician, equally with the pious man, ought to respect and to cherish them. A volume could not trace all their connections with private and public felicity. Let it simply be asked: Where is the security for property, for reputation, for life, if the sense of religious obligation desert the oaths which are the instruments of investigation in courts of justice ? And let us with caution indulge the supposition that morality can be maintained without religion. Whatever may be conceded to the influence of refined education on minds of peculiar structure, reason and experience both forbid us to expect that national morality can prevail in exclusion of religious principle.

It is substantially true that virtue or morality is a necessary spring of popular government. The rule, indeed, extends with more or less force to every species of free government. Who that is a sincere friend to it can look with indifference upon attempts to shake the foundation of the fabric?

Promote then, as an object of primary importance, institutions for the general diffusion of knowledge. In proportion as the structure of a government gives force to public opinion, it is essential that public opinion should be enlightened.

As a very important source of strength and security, cherish public credit. One method of preserving it is to use it as sparingly as possible, avoiding occasions of expense by cultivating peace, but remembering also that timely disbursements to prepare for danger frequently prevent much greater disbursements to repel it, avoiding likewise the accumulation of debt, not only by shunning occasions of expense, but by vigorous exertion in time of peace to discharge the debts which unavoidable wars may have occasioned, not ungenerously throwing upon posterity the burden which we ourselves ought to bear. The execution of these maxims belongs to your representatives, but it is necessary that public opinion should co-operate. To facilitate to them the performance of their duty, it is essential that you should practically bear in mind that towards the payment of debts there must be revenue; that to have revenue there must be taxes; that no taxes can be devised which are not more or less inconvenient and unpleasant; that the intrinsic embarrassment, inseparable from the selection of the proper objects (which is always a choice of difficulties), ought to be a decisive motive for a candid construction of the conduct of the government in making it, and for a spirit of acquiescence in the measures for obtaining revenue, which the public exigencies may at any time dictate.

Observe good faith and justice towards all nations; cultivate peace and harmony with all. Religion and morality enjoin this conduct; and can it be, that good policy does not equally enjoin it 7 It will be worthy of a free, enlightened, and at no distant period, a great nation, to give to mankind the magnanimous and too novel example of a people always guided by an exalted justice and benevolence. Who can doubt that, in the course of time and things, the fruits of such a plan would richly repay any temporary advantages which might be lost by a steady adherence to it ? Can it be that Providence has not connected the permanent felicity of a nation with its virtue ? The experiment, at least, is recommended by every sentiment which ennobles human nature. Alas! is it rendered impossible by its vices?

In the execution of such a plan, nothing is more essential than that permanent, inveterate antipathies against particular nations, and passionate attachments for others, should be excluded; and that, in place of them, just and amicable feelings towards all should be cultivated. The nation which indulges towards another a habitual hatred or a habitual fondness is in some degree a slave. It is a slave to its animosity or to its affection, either of which is sufficient to lead it astray from its duty and its interest. Antipathy in one nation against another disposes each more readily to offer insult and injury, to lay hold of slight causes of umbrage, and to be haughty and intractable, when accidental or trifling occasions of dispute occur. Hence, frequent collisions, obstinate, envenomed, and bloody contests. The nation, prompted by ill-will and resentment, sometimes impels to war the government, contrary to the best calculations of policy. The government sometimes participates in the national propensity, and adopts through passion what reason would reject; at other times it makes the animosity of the nation subservient to projects of hostility instigated by pride, ambition, and other sinister and pernicious motives. The peace often, sometimes perhaps the liberty, of nations, has been the victim.

So likewise, a passionate attachment of one nation for another produces a variety of evils. Sympathy for the favorite nation, facilitating the illusion of an imaginary common interest in cases where no real common interest exists, and infusing into one the enmities of the other, betrays the former into a participation in the quarrels and wars of the latter without adequate inducement or justification. It leads also to concessions to the favorite nation of privileges denied to others which is apt doubly to injure the nation making the concessions; by unnecessarily parting with what ought to have been retained, and by exciting jealousy, ill-will, and a disposition to retaliate, in the parties from whom equal privileges are withheld. And it gives to ambitious, corrupted, or deluded citizens (who devote themselves to the favorite nation), facility to betray or sacrifice the interests of their own country, without odium, sometimes even with popularity; gilding, with the appearances of a virtuous sense of obligation, a commendable deference for public opinion, or a laudable zeal for public good, the base or foolish compliances of ambition, corruption, or infatuation.

As avenues to foreign influence in innumerable ways, such attachments are particularly alarming to the truly enlightened and independent patriot. How many opportunities do they afford to tamper with domestic factions, to practice the arts of seduction, to mislead public opinion, to influence or awe the public councils 7 Such an attachment of a small or weak towards a great and powerful nation dooms the former to be the satellite of the latter.

Against the insidious wiles of foreign influence (I conjure you to believe me, fellow-citizens) the jealousy of a free people ought to be constantly awake, since history and experience prove that foreign influence is one of the most baneful foes of republican government. But that jealousy to be useful must be impartial; else it becomes the instrument of the very influence to be avoided, instead of a defense against it. Excessive partiality for one foreign nation and excessive dislike of another cause those whom they actuate to see danger only on one side, and serve to veil and even second the arts of influence on the other. Real patriots who may resist the intrigues of the favorite are liable to become suspected and odious, while its tools and dupes usurp the applause and confidence of the people, to surrender their interests.

The great rule of conduct for us in regard to foreign nations is in extending our commercial relations, to have with them as little political connection as possible. So far as we have already formed engagements, let them be fulfilled with perfect good faith. Here let us stop. Europe has a set of primary interests which to us have none; or a very remote relation. Hence she must be engaged in frequent controversies, the causes of which are essentially foreign to our concerns. Hence, therefore, it must be unwise in us to implicate ourselves by artificial ties in the ordinary vicissitudes of her politics, or the ordinary combinations and collisions of her friendships or enmities.

Our detached and distant situation invites and enables us to pursue a different course. If we remain one people under an efficient government. the period is not far off when we may defy material injury from external annoyance; when we may take such an attitude as will cause the neutrality we may at any time resolve upon to be scrupulously respected; when belligerent nations, under the impossibility of making acquisitions upon us, will not lightly hazard the giving us provocation; when we may choose peace or war, as our interest, guided by justice, shall counsel.

Why forego the advantages of so peculiar a situation? Why quit our own to stand upon foreign ground? Why, by interweaving our destiny with that of any part of Europe, entangle our peace and prosperity in the toils of European ambition, rivalship, interest, humor or caprice?

It is our true policy to steer clear of permanent alliances with any portion of the foreign world; so far, I mean, as we are now at liberty to do it; for let me not be understood as capable of patronizing infidelity to existing engagements. I hold the maxim no less applicable to public than to private affairs, that honesty is always the best policy. I repeat it, therefore, let those engagements be observed in their genuine sense. But, in my opinion, it is unnecessary and would be unwise to extend them.

Taking care always to keep ourselves by suitable establishments on a respectable defensive posture, we may safely trust to temporary alliances for extraordinary emergencies.

Harmony, liberal intercourse with all nations, are recommended by policy, humanity, and interest. But even our commercial policy should hold an equal and impartial hand; neither seeking nor granting exclusive favors or preferences; consulting the natural course of things; diffusing and diversifying by gentle means the streams of commerce, but forcing nothing; establishing (with powers so disposed, in order to give trade a stable course, to define the rights of our merchants, and to enable the government to support them) conventional rules of intercourse, the best that present circumstances and mutual opinion will permit, but temporary, and liable to be from time to time abandoned or varied, as experience and circumstances shall dictate; constantly keeping in view that it is folly in one nation to look for disinterested favors from another; that it must pay with a portion of its independence for whatever it may accept under that character; that, by such acceptance, it may place itself in the condition of having given equivalents for nominal favors, and yet of being reproached with ingratitude for not giving more. There can be no greater error than to expect or calculate upon real favors from nation to nation. It is an illusion, which experience must cure, which a just pride ought to discard.

In offering to you, my countrymen, these counsels of an old and affectionate friend, I dare not hope they will make the strong and lasting impression I could wish; that they will control the usual current of the passions, or prevent our nation from running the course which has hitherto marked the destiny of nations. But, if I may even flatter myself that they may be productive of some partial benefit, some occasional good; that they may now and then recur to moderate the fury of party spirit, to warn against the mischiefs of foreign intrigue, to guard against the impostures of pretended patriotism; this hope will be a full recompense for the solicitude for your welfare, by which they have been dictated.

How far in the discharge of my official duties I have been guided by the principles which have been delineated, the public records and other evidences of my conduct must witness to you and to the world. To myself, the assurance of my own conscience is, that I have at least believed myself to be guided by them.

In relation to the still subsisting war in Europe, my proclamation of the twenty-second of April, I793, is the index of my plan. Sanctioned by your approving voice, and by that of your representatives in both houses of Congress, the spirit of that measure has continually governed me, uninfluenced by any attempts to deter or divert me from it.

After deliberate examination, with the aid of the best lights I could obtain, I was well satisfied that our country, under all the circumstances of the case, had a right to take, and was bound in duty and interest to take, a neutral position. Having taken it, I determined, as far as should depend upon me, to maintain it, with moderation, perseverance, and firmness.

The considerations which respect the right to hold this con duct, it is not necessary on this occasion to detail. I will only observe that, according to my understanding of the matter, that right, so far from being denied by any of the belligerent powers, has been virtually admitted by all.

The duty of holding a neutral conduct may be inferred, without anything more, from the obligation which justice and humanity impose on every nation, in cases in which it is free to act, to maintain inviolate the relations of peace and amity towards other nations.

The inducements of interest for observing that conduct will best be referred to your own reflections and experience. With me a predominant motive has been to endeavor to gain time to our country to settle and mature its yet recent institutions, and to progress without interruption to that degree of strength and consistency which is necessary to give it, humanly speaking, the command of its own fortunes.

Though, in reviewing the incidents of my administration, I am unconscious of intentional error, I am nevertheless too sensible of my defects not to think it probable that I may have committed many errors. Whatever they may be, I fervently beseech the Almighty to avert or mitigate the evils to which they may tend. I shall also carry with me the hope that my country will never cease to view them with indulgence; and that, after forty five years of my life dedicated to its service with an upright zeal, the faults of incompetent abilities will be consigned to oblivion, as myself must soon be to the mansions of rest.

Relying on its kindness in this as in other things, and actuated by that fervent love towards it, which is so natural to a man who views in it the native soil of himself and his progenitors for several generations, I anticipate with pleasing expectation that retreat in which I promise myself to realize, without alloy, the sweet enjoyment of partaking, in the midst of my fellow-citizens, the benign influence of good laws under a free government, the ever-favorite object of my heart, and the happy reward, as I trust, of our mutual cares, labors, and dangers.

Our petitions have been slighted; our remonstrances have produced additional violence and insult; our supplications have been disregarded; and we have been spurned, with contempt, from the foot of the throne. In vain, after these things, may we indulge the fond hope of peace and reconciliation. There is no longer any room for hope.

If we wish to be free -- if we mean to preserve inviolate those inestimable privileges for which we have been so long contending -- if we mean not basely to abandon the noble struggle in which we have been so long engaged, and which we have pledged ourselves never to abandon until the glorious object of our contest shall be obtained, we must fight! I repeat it, sir, we must fight! An appeal to arms and to the God of Hosts is all that is left us!

We need to stop destroying imperfect people at the altar of an unobtainable morality.

We need to start living up to the standards which the public, in its infinite wisdom, understands that imperfect people must strive towards, but too often fall short.

We are now rapidly descending into a politics where life imitates farce. Fratricide dominates our public debate and America is held hostage to tactics of smear and fear.

Let all of us here today say no to resignation, no to impeachment, no to hatred, no to intolerance of each other, and no to vicious self-righteousness.

We need to start healing. We need to start binding up our wounds. We need to end this downward spiral which will culminate in the death of representative democracy.

I believe this healing can start today by changing the course we've begun.

This is exactly why we need this today to be bipartisan. This is why we ask the opportunity to vote on a bipartisan censure resolution, to begin the process of healing our nation and healing our people.

We are on the brink of the abyss. The only way we stop this insanity is through the force of our own will.

The only way we stop this spiral is for all of us to finally say -- enough.

Let us step back from the abyss and let's begin a new politics of respect and fairness and decency which raises what has come before.

They tell us, sir, that we are weak -- unable to cope with so formidable an adversary. But when shall we be stronger? Will it be the next week, or the next year? Will it be when we are totally disarmed, and when a British guard shall be stationed in every house? Shall we gather strength by irresolution and inaction? Shall we acquire the means of effectual resistance, by lying supinely on our backs, and hugging the delusive phantom of hope, until our enemies shall have bound us hand and foot?

Thus much, gentlemen, I have thought it incumbent on me to observe to you, to show upon what principles I opposed the irregular and hasty meeting which was proposed to have been held on Tuesday last - and not because I wanted a disposition to give you every opportunity consistent with your own honor, and the dignity of the army, to make known your grievances. If my conduct heretofore has not evinced to you that I have been a faithful friend to the army, my declaration of it at this time would be equally unavailing and improper. But as I was among the first who embarked in the cause of our common country. As I have never left your side one moment, but when called from you on public duty. As I have been the constant companion and witness of your distresses, and not among the last to feel and acknowledge your merits. As I have ever considered my own military reputation as inseparably connected with that of the army. As my heart has ever expanded with joy, when I have heard its praises, and my indignation has arisen, when the mouth of detraction has been opened against it, it can scarcely be supposed, at this late stage of the war, that I am indifferent to its interests.

But how are they to be promoted? The way is plain, says the anonymous addresser. If war continues, remove into the unsettled country, there establish yourselves, and leave an ungrateful country to defend itself. But who are they to defend? Our wives, our children, our farms, and other property which we leave behind us. Or, in this state of hostile separation, are we to take the two first (the latter cannot be removed) to perish in a wilderness, with hunger, cold, and nakedness? If peace takes place, never sheathe your swords, says he, until you have obtained full and ample justice; this dreadful alternative, of either deserting our country in the extremest hour of her distress or turning our arms against it (which is the apparent object, unless Congress can be compelled into instant compliance), has something so shocking in it that humanity revolts at the idea. My God! What can this writer have in view, by recommending such measures? Can he be a friend to the army? Can he be a friend to this country? Rather, is he not an insidious foe? Some emissary, perhaps, from New York, plotting the ruin of both, by sowing the seeds of discord and separation between the civil and military powers of the continent? And what a compliment does he pay to our understandings when he recommends measures in either alternative, impracticable in their nature?

I cannot, in justice to my own belief, and what I have great reason to conceive is the intention of Congress, conclude this address, without giving it as my decided opinion, that that honorable body entertain exalted sentiments of the services of the army; and, from a full conviction of its merits and sufferings, will do it complete justice. That their endeavors to discover and establish funds for this purpose have been unwearied, and will not cease till they have succeeded, I have not a doubt. But, like all other large bodies, where there is a variety of different interests to reconcile, their deliberations are slow. Why, then, should we distrust them? And, in consequence of that distrust, adopt measures which may cast a shade over that glory which has been so justly acquired; and tarnish the reputation of an army which is celebrated through all Europe, for its fortitude and patriotism? And for what is this done? To bring the object we seek nearer? No! most certainly, in my opinion, it will cast it at a greater distance.

For myself (and I take no merit in giving the assurance, being induced to it from principles of gratitude, veracity, and justice), a grateful sense of the confidence you have ever placed in me, a recollection of the cheerful assistance and prompt obedience I have experienced from you, under every vicissitude of fortune, and the sincere affection I feel for an army I have so long had the honor to command will oblige me to declare, in this public and solemn manner, that, in the attainment of complete justice for all your toils and dangers, and in the gratification of every wish, so far as may be done consistently with the great duty I owe my country and those powers we are bound to respect, you may freely command my services to the utmost of my abilities.

While I give you these assurances, and pledge myself in the most unequivocal manner to exert whatever ability I am possessed of in your favor, let me entreat you, gentlemen, on your part, not to take any measures which, viewed in the calm light of reason, will lessen the dignity and sully the glory you have hitherto maintained; let me request you to rely on the plighted faith of your country, and place a full confidence in the purity of the intentions of Congress; that, previous to your dissolution as an army, they will cause all your accounts to be fairly liquidated, as directed in their resolutions, which were published to you two days ago, and that they will adopt the most effectual measures in their power to render ample justice to you, for your faithful and meritorious services. And let me conjure you, in the name of our common country, as you value your own sacred honor, as you respect the rights of humanity, and as you regard the military and national character of America, to express your utmost horror and detestation of the man who wishes, under any specious pretenses, to overturn the liberties of our country, and who wickedly attempts to open the floodgates of civil discord and deluge our rising empire in blood.

By thus determining and thus acting, you will pursue the plain and direct road to the attainment of your wishes. You will defeat the insidious designs of our enemies, who are compelled to resort from open force to secret artifice. You will give one more distinguished proof of unexampled patriotism and patient virtue, rising superior to the pressure of the most complicated sufferings. And you will, by the dignity of your conduct, afford occasion for posterity to say, when speaking of the glorious example you have exhibited to mankind, "Had this day been wanting, the world had never seen the last stage of perfection to which human nature is capable of attaining."

Sir, we are not weak, if we make a proper use of the means which the God of nature hath placed in our power. Three millions of people, armed in the holy cause of liberty, and in such a country as that which we possess, are invincible by any force which our enemy can send against us. Besides, sir, we shall not fight our battles alone. There is a just God who presides over the destinies of nations, and who will raise up friends to fight our battles for us.

The battle, sir, is not to the strong alone; it is to the vigilant, the active, the brave. Besides, sir, we have no election. If we were base enough to desire it, it is now too late to retire from the contest. There is no retreat but in submission and slavery! Our chains are forged! Their clanking may be heard on the plains of Boston! The war is inevitable -- and let it come! I repeat it, sir, let it come!

I ask that we stop refighting the battles and the recriminations of the past. I ask that we look now at what is right with America, at our possibilities and our potentialities for change and growth and achievement and sharing. I ask that we accept the responsibilities of leadership as a good neighbor to all peoples and the enemy of none. I ask that we strive to become, in the finest American tradition, something more tomorrow than we are today.

Instead of my addressing the image of America, I prefer to consider the reality of America. It is true that we have launched our Bicentennial celebration without having achieved human perfection, but we have attained a very remarkable self-governed society that possesses the flexibility and the dynamism to grow and undertake an entirely new agenda, an agenda for America's third century.

So, I ask you to join me in helping to write that agenda. I am as determined as a President can be to seek national rediscovery of the belief in ourselves that characterized the most creative periods in our Nation's history. The greatest challenge of creativity, as I see it, lies ahead.

We, of course, are saddened indeed by the events in Indochina. But these events, tragic as they are, portend neither the end of the world nor of America's leadership in the world.

Let me put it this way, if I might. Some tend to feel that if we do not succeed in everything everywhere, then we have succeeded in nothing anywhere. I reject categorically such polarized thinking. We can and we should help others to help themselves. But the fate of responsible men and women everywhere, in the final decision, rests in their own hands, not in ours.

America's future depends upon Americans -- especially your generation, which is now equipping itself to assume the challenges of the future, to help write the agenda for America.

Earlier today, in this great community, I spoke about the need to maintain our defenses. Tonight, I would like to talk about another kind of strength, the true source of American power that transcends all of the deterrent powers for peace of our Armed Forces. I am speaking here of our belief in ourselves and our belief in our Nation.

Abraham Lincoln asked, in his own words, and I quote, "What constitutes the bulwark of our own liberty and independence?" And he answered, "It is not our frowning battlements or bristling seacoasts, our Army or our Navy. Our defense is in the spirit which prized liberty as the heritage of all men, in all lands everywhere."

It is in this spirit that we must now move beyond the discords of the past decade. It is in this spirit that I ask you to join me in writing an agenda for the future.

I welcome your invitation particularly tonight, because I know it is at Tulane and other centers of thought throughout our great country that much consideration is being given to the kind of future Americans want and, just as importantly, will work for. Each of you are preparing yourselves for the future, and I am deeply interested in your preparations and your opinions and your goals. However, tonight, with your indulgence, let me share with you my own views.

I envision a creative program that goes as far as our courage and our capacities can take us, both at home and abroad. My goal is for a cooperative world at peace, using its resources to build, not to destroy.

As President, I am determined to offer leadership to overcome our current economic problems. My goal is for jobs for all who want to work and economic opportunity for all who want to achieve.

I am determined to seek self-sufficiency in energy as an urgent national priority. My goal is to make America independent of foreign energy sources by 1985.

Of course, I will pursue interdependence with other nations and a reformed international economic system. My goal is for a world in which consuming and producing nations achieve a working balance.

I will address the humanitarian issues of hunger and famine, of health and of healing. My goal is to achieve -- or to assure basic needs and an effective system to achieve this result.

I recognize the need for technology that enriches life while preserving our natural environment. My goal is to stimulate productivity, but use technology to redeem, not to destroy our environment.

I will strive for new cooperation rather than conflict in the peaceful exploration of our oceans and our space. My goal is to use resources for peaceful progress rather than war and destruction.

Let America symbolize humanity's struggle to conquer nature and master technology. The time has now come for our Government to facilitate the individual's control over his or her future -- and of the future of America.

But the future requires more than Americans congratulating themselves on how much we know and how many products that we can produce. It requires new knowledge to meet new problems. We must not only be motivated to build a better America, we must know how to do it.

If we really want a humane America that will, for instance, contribute to the alleviation of the world's hunger, we must realize that good intentions do not feed people. Some problems, as anyone who served in the Congress knows, are complex. There arc no easy answers. Willpower alone does not grow food.

We thought, in a well-intentioned past, that we could export our technology lock, stock, and barrel to developing nations. We did it with the best of intentions. But we are now learning that a strain of rice that grows in one place will not grow in another; that factories that produce at 100 percent in one nation produce less than half as much in a society where temperaments and work habits are somewhat different.

Yet, the world economy has become interdependent. Not only food technology but money management, natural resources and energy, research and development -- all kinds of this group require an organized world society that makes the maximum effective use of the world's resources.

I want to tell the world: Let's grow food together, but let's also learn more about nutrition, about weather forecasting, about irrigation, about the many other specialties involved in helping people to help themselves.

We must learn more about people, about the development of communities, architecture, engineering, education, motivation, productivity, public health and medicine, arts and sciences, political, legal, and social organization. All of these specialities and many, many more are required if young people like you are to help this Nation develop an agenda for our future -- your future, our country's future.

I challenge, for example, the medical students in this audience to put on their agenda the achievement of a cure for cancer. I challenge the engineers in this audience to devise new techniques for developing cheap, clean, and plentiful energy, and as a byproduct, to control floods. I challenge the law students in this audience to find ways to speed the administration of equal justice and make good citizens out of convicted criminals. I challenge education, those of you as education majors, to do real teaching for real life. I challenge the arts majors in this audience to compose the great American symphony, to write the great American novel, and to enrich and inspire our daily lives.

America's leadership is essential. America's resources are vast. America's opportunities are unprecedented.

As we strive together to prefect a new agenda, I put high on the list of important points the maintenance of alliances and partnerships with other people and other nations. These do provide a basis of shared values, even as we stand up with determination for what we believe. This, of course, requires a continuing commitment to peace and a determination to use our good offices wherever possible to promote better relations between nations of this world.

The new agenda, that which is developed by you and by us, must place a high priority on the need to stop the spread of nuclear weapons and to work for the mutual reduction in strategic arms and control of other weapons. And I must say, parenthetically, the successful negotiations at Vladivostok, in my opinion, are just a beginning.

Your generation of Americans is uniquely endowed by history to give new meaning to the pride and spirit of America. The magnetism of an American society, confident of its own strength, will attract the good will and the esteem of all people wherever they might be in this globe in which we live. It will enhance our own perception of ourselves and our pride in being an American. We can, we -- and I say it with emphasis -- write a new agenda for our future.

It is in vain, sir, to extenuate the matter. Gentlemen may cry, "Peace! Peace!" -- but there is no peace. The war is actually begun! The next gale that sweeps from the north will bring to our ears the clash of resounding arms! Our brethren are already in the field! Why stand we here idle? What is it that gentlemen wish? What would they have? Is life so dear, or peace so sweet, as to be purchased at the price of chains and slavery?

I am but a vessel. Your wisdom is an inspiration, and I've structured some thoughts which should ensure a lasting peace and prosperous, free future for this great board. It will be our wish and purpose that the processes of peace, when they are begun, shall be absolutely open and that they shall involve and permit henceforth no secret understandings of any kind. The day of conquest and aggrandizement is gone by; so is also the day of secret covenants entered into in the interest of particular governments and likely at some unlooked-for moment to upset the peace of the world. It is this happy fact, now clear to the view of every public man whose thoughts do not still linger in an age that is dead and gone, which makes it possible for every nation whose purposes are consistent with justice and the peace of the world to avow now or at any other time the objects it has in view.

We entered this war because violations of right had occurred which touched us to the quick and made the life of our own people impossible unless they were corrected and the world secured once for all against their recurrence.

What we demand in this war, therefore, is nothing peculiar to ourselves. It is that the world be made fit and safe to live in; and particularly that it be made safe for every peace-loving nation which, like our own, wishes to live its own life, determine its own institutions, be assured of justice and fair dealing by the other peoples of the world, as against force and selfish aggression.

All the peoples of the world are in effect partners in this interest, and for our own part we see very clearly that unless justice be done to others it will not be done to us.

The program of the world's peace, therefore, is our program; and that program, the only possible program, all we see it, is this:

1. Open covenants of peace must be arrived at, after which there will surely be no private international action or rulings of any kind, but diplomacy shall proceed always frankly and in the public view.

2. Absolute freedom of navigation upon the seas, outside territorial waters, alike in peace and in war, except as the seas may be closed in whole or in part by international action for the enforcement of international covenants.

3. The removal, so far as possible, of all economic barriers and the establishment of an equality of trade conditions among all the nations consenting to the peace and associating themselves for its maintenance.

4. Adequate guarantees given and taken that national armaments will be reduced to the lowest points consistent with domestic safety.

5. A free, open-minded, and absolutely impartial adjustment of all colonial claims, based upon a strict observance of the principle that in determining all such questions of sovereignty the interests of the population concerned must have equal weight with the equitable claims of the government whose title is to be determined.

6. The evacuation of all Russian territory and such a settlement of all questions affecting Russia as will secure the best and freest cooperation of the other nations of the world in obtaining for her an unhampered and unembarrassed opportunity for the independent determination of her own political development and national policy, and assure her of a sincere welcome into the society of free nations under institutions of her own choosing; and, more than a welcome, assistance also of every kind that she may need and may herself desire. The treatment accorded Russia by her sister nations in the months to come will be the acid test of their good will, of their comprehension of her needs as distinguished from their own interests, and of their intelligent and unselfish sympathy.

7. Belgium, the whole world will agree, must be evacuated and restored, without any attempt to limit the sovereignty which she enjoys in common with all other free nations. No other single act will serve as this will serve to restore confidence among the nations in the laws which they have themselves set and determined for the government of their relations with one another. Without this healing act the whole structure and validity of international law is forever impaired.

8. All French territory should be freed and the invaded portions restored, and the wrong done to France by Prussia in 1871 in the matter of Alsace-Lorraine, which has unsettled the peace of the world for nearly fifty years, should be righted, in order that peace may once more be made secure in the interest of all.

9. A re-adjustment of the frontiers of Italy should be effected along clearly recognizable lines of nationality.

10. The peoples of Austria-Hungary, whose place among the nations we wish to see safeguarded and assured, should be accorded the freest opportunity of autonomous development.

11. Romania, Serbia, and Montenegro should be evacuated; occupied territories restored; Serbia accorded free and secure access to the sea; and the relations of the several Balkan states to one another determined by friendly counsel along historically established lines of allegiance and nationality; and international guarantees of the political and economic independence and territorial integrity of the several Balkan states should be entered into.

12. The Turkish portions of the present Ottoman Empire should be assured a secure sovereignty, but the other nationalities which are now under Turkish rule should be assured an undoubted security of life and an absolutely unmolested opportunity of autonomous development, and the Dardanelles should be permanently opened as a free passage to the ships and commerce of all nations under international guarantees.

13. An independent Polish state should be erected which should include the territories inhabited by indisputably Polish populations, which should be assured a free and secure access to the sea, and whose political and economic independence and territorial integrity should be guaranteed by international covenant.

14. A general association of nations must be formed under specific covenants for the purpose of affording mutual guarantees of political independence and territorial integrity to great and small states alike.

In regard to these essential rectifications of wrong and assertions of right, we feel ourselves to be intimate partners of all the governments and peoples associated together against the imperialists. We cannot be separated in interest or divided in purpose. We stand together until the end.

For such arrangements and covenants we are willing to fight and to continue to fight until they are achieved; but only because we wish the right to prevail and desire a just and stable peace such as can be secured only by removing the chief provocations to war, which this program does remove.

We have no jealousy of German greatness, and there is nothing in this program that impairs it. We grudge her no achievement or distinction of learning or of pacific enterprise such as have made her record very bright and very enviable. We do not wish to injure her or to block in any way her legitimate influence or power. We do not wish to fight her either with arms or with hostile arrangements of trade, if she is willing to associate herself with us and the other peace-loving nations of the world in covenants of justice and law and fair dealing.

We wish her only to accept a place of equality among the peoples of the world--the new world in which we now live--instead of a place of mastery.

Neither do we presume to suggest to her any alteration or modification of her institutions. But it is necessary, we must frankly say, and necessary as a preliminary to any intelligent dealings with her on our part, that we should know whom her spokesmen speak for when they speak to us, whether for the Reichstag majority or for the military party and the men whose creed is imperial domination.

We have spoken now, surely, in terms too concrete to admit of any further doubt or question. An evident principle runs through the whole program I have outlined. It is the principle of justice to all peoples and nationalities, and their right to live on equal terms of liberty and safety with one another, whether they be strong or weak.

Unless this principle be made its foundation, no part of the structure of international justice can stand. The people of the United States could act upon no other principle, and to the vindication of this principle they are ready to devote their lives, their honor, and everything that they possess. The moral climax of this, the culminating and final war for human liberty has come, and they are ready to put their own strength, their own highest purpose, their own integrity and devotion to the test.

The first part, I think, no godly man will deny. And if any would, I ask, "What made the selfsame sacrifice, instituted and ordained to be used by God's express commandment, odious and abominable in his sight?" As it is written, "Bring unto me no more your vain sacrifices; your burnt offering is abomination; your new moons, sabbaths, and conventions I may not abide; your solemn feasts, I hate them from the heart" (Isa. 1:13-14). And also, "Who slayeth an ox in sacrifice, killeth a man:" that is, doth me no less dishonour than if he killed a man. "Who slayeth a sheep," says he, "choketh a dog: who brought meat offerings unto me, doth offer swine's blood" (Isa. 66:3). These two beasts, the dog and the swine, were abominable to be offered in sacrifice, the one for the cruelty, the other for filthiness. But, O priests! your sacrifices are mixed with the blood of dogs and swine; while that, on the one part, most cruelly you do persecute the professors of Christ's word; upon the other part, yourselves live most filthily.

The prophet proceeds, "Who maketh a memorial of incense, praiseth a thing that is vain." Amos says, "I hate and detest your solemn feasts. I will not accept your incense; your burnt offerings and meat offerings are not thankful before me" (Amos 5:21-23). And why all this? Because, says the prophet Isaiah, "They have chosen these in their own ways, and their own hearts have delighted in their abominations" (Isa. 66:3). And it is plain, that the aforesaid sacrifices were commanded to be done by God, and were not invented no, not one jot thereof by man's wisdom. Read the books of Moses (Exodus and Leviticus), and you shall perceive them to be very commandments of God. And yet says the prophet, "They have chosen them in their own ways." Whereby the prophet meant and understood, that they had added unto them an opinion which made them to be abominable before God.

This opinion was, as in the same prophet and diverse others may be espied, that by working of the external work, they might purchase the favour of God, and make satisfaction for their sins by the same sacrifices. And that I collect of Jeremiah saying, "Ye believe false words which shall not profit you. For when you have stolen, murdered, committed adultery, and perjury, etc., then ye come and stand before me in this house, which hath my name given unto it; and ye say, 'We are delivered or absolved, albeit we have done all these abominations' " (Jer. 7:8-10). They thought and verily believed their sins to have been remitted by virtue of their sacrifice offered. But Isaiah asks of them, "Why spend ye silver for that which is not sure, and consume labour for that which does not satiate?" (Isa. 55:2). "Ye do hide yourselves with lies and ye make a band or covenant with death; but it shall not stand, for when destruction cometh it shall overwhelm you" (Isa. 28:15, 18). Their false prophets had taught them to cry, "Peace, peace," when yet there was no peace in their consciences (Jer. 6:14; 8:11). For they which did eat the sin of the people, as our priests have long done, for the more wicked men were, the more desire they had of the Mass, thinking by virtue thereof all was purged. The pestilent priests of Moses' law, as witness the prophets, caused the people to believe that by oblation of the sacrifice, they were just and innocent; and did desire, for such offerings, plague and the wrath of God to be removed (Hos. 7; Jer. 2). But it is answered unto them by the prophet Micah, "Shall I come in his presence with burnt offerings, and yearling lambs? Or doth a thousand rams please him, or ten thousand boats of oil? Shall I give my first-born son for expiation of mine iniquity; or the fruit of my womb a sin offering for my soul?" (Micah 6:6-7). Here the prophet plainly witnesses that no external work, how excellent ever it be, does purge or make satisfaction for sin. And so of the precedents, it is plain that a wicked opinion added to the very work, sacrifice, or ceremony commanded to be done and used by God, makes it abomination and idolatry. For idolatry is not only to worship that thing which is not God, but also to trust or lean unto that thing which is not God, and has not in itself all sufficiency. And therefore Paul calls covetous men idolaters (Col. 3:5), because their confidence and trust are in their riches; much more would he call him an idolater whose heart believed remission of sins [comes] by a vain work, done by himself or by any other in his name.

[Part Two: Unto the Mass is Joined a Wicked Opinion]

But now let us hear if unto the Mass be joined a wicked opinion. It has been held in common opinion; it plainly has been taught; by law it is decreed; and in the words of the Mass it is expressed, that the Mass is a sacrifice and oblation for the sins of the quick and the dead: so that remission of sins undoubtedly was believed by that same action and work presently done by the priest. Sufficient it were for me, by the plain words of the aforesaid prophets, therefore to conclude it [an] abomination; seeing they (the prophets) plainly show that remission of sins comes only of the mere mercy of God, without all deserving of us, or of our work proceeding of ourselves. As Isaiah writes, saying, "I am he which removeth thine iniquity, and that for my own sake."

But if I shall prove this aforesaid opinion which has been held of the Mass to be false, deceitful, and vain and that it is no sacrifice for sin (Isa. 43:25) shall either consuetude, long process of time, or multitude of papistical patrons, defend that it is not abomination and idolatry?

And first I ask, "Who offers this sacrifice, and what is offered?"

"The priest," say the Papists, "offers Jesus Christ unto the Father."

Then I demand, if a man can offer unto God a more precious thing than himself? And it appears not, for Paul commands that "we offer unto God a holy, lively, and reasonable sacrifice," which he calls our own bodies (Rom. 12:1). And Jesus Christ, having nothing more precious than himself, did offer up himself. If Paul had known any other sacrifice, after the death of Jesus Christ, more acceptable unto God than the mortification of our own bodies, would he not have advertised us thereof? If there was any other sacrifice, and he did not know thereof, then the Spirit led him not into all verity: which to say is blasphemy. If he knew it, and yet did not advertise us thereof, then did he not the duty and office of a true preacher; and to affirm that is like impiety. If any man might have offered Jesus Christ but himself only, in vain had it been to him to have suffered so cruel torment in his own person by oblation of himself. And so to affirm that mortal man may offer him who is immortal God, in my opinion is malapert proudness.

But let us hear more. Paul says, "By one oblation hath he made perfect forever them which are sanctified" (Heb. 10:14). And also, "Remission of sins once gotten, there resteth no more sacrifice" (Heb. 10:18). They will not avoid Paul's words, although they say Paul speaks of the Levitical sacrifice. No, Papists! he excludes all manner of sacrifice, saying, Nulla amplius restat Oblatio, "No more sacrifice resteth." And thereto testifies Jesus Christ himself upon the cross, saying, Consummatum est (It is finished) (John 19:30): that is, whatever is required for pacifying my Father's wrath justly moved against sin; whatever is necessary for reconciliation of mankind to the favour of my eternal Father; and whatever the purgation of the sins of the whole world required, is now completed and ended, so that no further sacrifice rests for sin.

Hear, you Papists! Two witnesses speak against you. How can you deny the opinion of your Mass to be false and vain? You say that it is a sacrifice for sin, but Jesus Christ and Paul say only the death of Christ was sufficient for sin, and after it rests none other sacrifice. Speak! or else you are likely to be condemned.

I know you will say, it is no other sacrifice, but the selfsame, save that it is iterated and renewed. But the words of Paul bind you more straightly than that so you may escape. For in his whole disputation, he contends not only that there is no other sacrifice for sin, but also that the selfsame sacrifice, once offered, is sufficient, and never may be offered again. For otherwise of no greater price, value, nor extenuation, should the death of Christ be, than the death of those beasts which were offered under the law which are proved to be of none effect, nor strength, because it behooved them often times to be iterated.

The apostle, by comparing Jesus Christ to the Levitical priests, and his sacrifice unto theirs, makes the matter plain that Christ might be offered but once. First, the Levitical priests were mortal, and therefore it behooved them to have successors; but Christ is an eternal priest, and therefore is alone, and needs no successor. The Levitical priests offered the blood of beasts; but Jesus Christ offered his own body and blood. The Levitical priests, for impotence of their sacrifice, did iterate the same; but the sacrifice of Jesus Christ, having in itself all perfection, needs not to be iterated. Yea, to affirm that it ought, or may be, iterated, is extreme blasphemy; for that were to impute imperfection thereupon, contrary to the whole religion, and the plain words of Paul, saying, "Such is our High Priest, holy, just, unpolluted, separate from sinners, and higher than the heavens; to whom it is not necessary every day to offer, as did those priests first offer for their own sins, and then for the sins of the people: for that he hath done once, when he offered himself" (Heb. 7:26-27). What words can be more plain? Here Paul shows all causes, wherefore it needs not Christ to be offered again; and would conclude, that he may not be offered again.

Yet, they say, it repugns nothing that we offer Christ, so that he offer not himself. The text says plainly, as before is shown, that Christ only might offer himself which sacrifice is sufficient, and never may be offered again. "For if it had behooved him to have been oftener offered than once, he should have suffered often times from the beginning of the world. But once hath he appeared for the away taking of sin, offering himself" (Heb. 9:26): that is, of his own body, once slain, now living, and may suffer death no more. "For by his only one sacrifice hath he made us perfect, and sanctifieth forever."

Here is answered to that objection, that some object: "Men every day sin; therefore it is necessary that every day be sacrifice made for sin." Paul says, "By one sacrifice hath he consummated us forever" (Heb. 10:14). For otherwise, his death is not the only and sufficient sacrifice for our sins: which to affirm is blasphemy. And so there rests of our whole redemption nothing but his second coming, which shall be to judgment: where we, depending upon him, shall receive glory and honour; but his enemies shall be made a footstool to his feet. Not that I mean that his death ought not to be preached, and the remembrance thereof extolled and praised in the right administration of his Supper; but none of this to be sacrifice for sin. What will you answer to this, which Paul produces against your Mass? He plainly says there is no sacrifice for sin, but Christ's death only, etc.; and that neither may you offer him, nor yet may he offer himself any more.

You will say, "It is a memorial sacrifice, under which Jesus Christ is offered unto the presence of God the Father by the kirk, under the appearance of bread and wine, for remission of sins. I answer with Paul, Apparet nunc in conspectu Dei pro nobis, "He appeareth now in the presence of God for us" (Heb. 9:24). So that it is not requisite that any man offer or represent him to the Father; for that he does himself, making continual intercession for us.

But let us consider this doctrine more deeply. The kirk, say they, offered Jesus Christ unto God the Father for a memorial sacrifice, or in a memorial sacrifice. Is there any oblivion or forgetfulness fallen upon God the Father? Has he forgotten the death and passion of Jesus Christ, so that he needs to be brought in memory thereof by any mortal man? Behold, brethren, how that impiety discloses and declares itself! Can there be any greater blasphemy than to say, God the Father has forgotten the benefits which he gave to mankind in his only Son Jesus! And whoever will say that they offer any memorial sacrifice or remembrance thereof unto God, does plainly say that God has forgotten them. For otherwise, what needs a representation or remembrance?

Advert, Papists, and consider how Satan has blinded you; you do manifestly lie, and do not espy the same. You do blaspheme God at every word, and can you not repent?

They say it is Sacrificium speaking here; for a memorial sacrifice it cannot be. They say it is a Sacrificium applicatorium (an applicatory sacrifice), a sacrifice whereby they do and may apply the merits of Christ's passion unto sinners. They will be layers-to of plasters! But I fear the wound be not well ripened, and therefore that the plasters are unprofitable.

You say you may apply the merits of Christ's passion to whom you list. This is proudly spoken. Then may you make peace with God at your pleasure. But the contrary he speaks in these words, "Who may make" (Isa. 27:5). Here God says, that as none may move his wrath against his chosen, and hereof ought you to rejoice, brethren: the pope, nor his priests, nor bishops whomsoever may not cause God to be angry against you, albeit they curse you with cross, bell, and candle, so no man may compel him to love or receive in favour but whom it pleases his infinite goodness. Moses, I confess, prayed for the people when God was displeased with them (Ex. 32:11-14; 32:32). But he speaks not proudly as you do, but either desired God to remit the offence of the people, or else destroy him altogether with them. I fear that your love be not so fervent. He obtained his petition of God.

But will you say, "So it was determined before in the counsel of God?" Advise you well. The nature of God is to be free, and thrall unto nothing. For although he is bound and obliged to fulfill all that his word promises to faithful believers, yet is that neither subjection nor thralldom; for freely he made his promises, and freely he does fulfill the same. I desire to be certified where God made his promises unto you Papist priests, that you should have power to apply the merits of Christ's passion to all and sundry who told or numbered money to you for that purpose? Takes God any part of the profit you receive? Alas, I have compassion upon your vanity, but more upon the simple people that have been deceived by you and your false doctrine.

Are you better heard with God than Samuel was? He prayed for King Saul, and that most fervently, and yet obtained not his petition, nor might not apply any merits or holiness unto him. And it is said to Jeremiah, "Pray thou not for this people, for my heart is not towards it; no, though Moses and Samuel should pray for them, yet would I not hear them, for they love to go wrong, and do not abstain from iniquity. Albeit they fast and cry, yet will I not hear them; and although they offer burnt sacrifice, I take no pleasure in it. And therefore pray not for this people, nor yet make any intercession for them, for I will not hear thee" (Jer. 14:11-12; cf. Jer. 15:1, Ezek. 14:14, 20).

What say you to these words, Papists? The prophet is forbidden to pray, for God says he neither will hear him nor yet the people. He will accept none of their sacrifices; and that because the people manifestly rebelled against God, rejoiced in iniquity, committed idolatry and abomination. And he manifestly shows that nothing may appease him but true repentance and conversion again unto God. O priests! has there not as great iniquity abounded in your days as ever did from the beginning? Have you not been enticers and leaders of the people to all idolatry? Yea, has not the mischievous example of your abominable lives provoked thousands unto iniquity? And yet do you say, that you may apply the merits of Christ's passion to whom you list! Hear you not that God never will accept prayers nor sacrifice whiles true repentance were found? Of that you were dumb, and always kept silence. Your clamour and crying was, "Come, come to the Mass; buy with money, substance, and possessions, remission of your sins. We have the merits of Christ's passion. We may offer Jesus Christ unto the Father, whom he must needs receive for an acceptable sacrifice and satisfaction of all your sins." Think not, brethren that I allege anything upon them which they themselves do not speak, as their own law and Mass shall testify.

In the beginning of the canon, the proud priest, lifting up his eyes, as that he had God even always bound to his commandment, says, "We beseech thee, most merciful Father, by Jesus Christ our Lord, that you receive and bless this untasted sacrifice which we offer to thee for thine universal church."

O proud and perverse prelates and priests! who gave you that authority? Is it not expressly forbidden by the apostle Paul that any man should usurp the honour to make sacrifice, except he be called by God, as was Aaron? Have you the same commandment which was given to Aaron (Heb. 5:4)? His sacrifices are abrogated by Christ. Let us hear where you are commanded to make sacrifices. Search the scriptures, but search them with judgment. It will not be, Hoc facite (Do this), for that is spoken of eating, drinking, and thanksgiving, and not of sacrifice making. Nor yet will the order of Melchizedek, nor the text of Malachi prove you priests to make sacrifice. Advise with others that have more appearance to prove your intent; for if this be well pondered, the weight of them will depress the proudness of your papistical priesthood.

Now will I collect shortly, all that is said for probation, that the Mass is no sacrifice for sin. Advert: the New Testament is eternal, that is, once made, can never be dissolved (Isa. 9:6-7; Jer. 31:31-37), and therefore the blood wherewith this Testament is confirmed is eternal: for it is the blood of the eternal Son of God. Only the blood of Jesus Christ takes away our sins; for it is he alone that takes away the sins of the world, and who by his own blood has reconciled all (Col. 1:14, 19-20). For if otherwise sin might have been taken away, then Christ has died in vain. And if full remission stood not in him alone, then they that ate him yet hungered, and they that drank him yet thirsted (John 6:35). And that were contrary to his own words. "The blood of Christ is once offered," and is sufficient, for it is the eternal blood of the eternal Son of God; and "by his own blood hath he once entered into the holy place" (Heb. 9:12). Therefore, the blood of Christ once offered remains forever, for purgation of all sins; and so rests there no sacrifice in the Mass. Advert these reasons precedent, and give place to the verity. For while the scriptures of God shall be held of authority, never are you able to resolve these arguments.

Consider now, brethren, if the opinion of the Mass be not vain, false, and deceitful? Caused they not you to believe it was a sacrifice, whereby remission of sins was obtained? And you may plainly perceive that no sacrifice there is, nor at any time was, for sins, but the death of Jesus Christ only. For the sacrifices of the old law were only figures of that verity and true sacrifice offered by Jesus Christ. And in them was a commemoration of sins made, but neither was remission of sins obtained, nor purgation made by any such sacrifice.

What will you do, Papist priests? There rests no sacrifice to be offered for sin by you, nor by any mortal man. These are dolorous tidings unto your hearts. And no marvel. For by that vain opinion that the Mass was a sacrifice for sin, have you so quietly rested into that flood of Euphrates, that is, in all worldly felicity, which flows unto you as a continual flood. But the Mass known not only to be no sacrifice, but also to be idolatry, the waters appear to dry up. And it is likely that you lack some liquor to refresh your tongues, being excruciated with drought and heat intolerable.

Would you then hear glad tidings? What if I should permit unto you, as one willing to play the good fellow, and not to be stiff-necked, that the Mass were a sacrifice for sin, and that you did offer Jesus Christ for sin? Would you be content that this were permitted unto you? I think you would, for therefore have you long contended. Then let us consider, what should subsequently follow thereupon.

A sacrifice for sin was never perfect until the beast offered was slain. If in your Mass you offer Jesus Christ for sin, then necessarily in your Mass must you needs kill Jesus Christ. Do not esteem, beloved brethren, these words shortly spoken, to be vain or of small effect. They are collected of the very ground of scriptures, for they plainly testify that Christ to be offered, Christ to suffer, and Christ to shed his blood or die, are all one thing.

Paul, in the epistle to the Hebrews, says, "He appeareth now in the presence of God for us, not to offer himself often times for us, for otherwise it behooved him to have suffered often times, from the beginning of the world" (Heb. 9:24-26). Mark well, that Paul makes to offer and to suffer both one thing, and therefore he proves that Christ made but one sacrifice, because he once did suffer the death. Jesus Christ says, as it is written in Matthew, "This is my blood of the New Testament, which shall be shed for you and for many, in remission of sins" (Matt. 26:28). Mark, that remission of sins is attributed to the shedding of Christ's blood. And Paul says, "Christ is dead for our sins" (1 Cor. 15:3). And in another place, "By one oblation or sacrifice hath he made us perfect forever" (Heb. 10:14). Consider diligently that remission of sins is attributed sometime to the shedding of Christ's blood, sometime to his death, and sometime to the whole sacrifice which he made in suffering all pain. And why is this? Whether if there be diverse manners to obtain remission of sins? No, but because every one of these three necessarily follows [the] others. Remission of sins is commonly ascribed to any of them, for wherever Christ is offered, there is his blood shed, and his death subsequently follows.

And so Papists, if you offer Christ in sacrifice for sin, you shed his blood, and thus newly slay him. Advert what fine your own desire shall bring you even to be slayers of Jesus Christ. You will say, you never pretended such abomination. I dispute not what you intended, but I only show what absurdity does follow upon your own doctrine. For necessarily if you do offer Christ for sin, as you confess, and your law does teach, you cruelly shed his blood, and finally do slay him.

same. Only you have deceived the people, causing them [to] believe that you offered Jesus Christ in sacrifice for sin in your Mass which is frivolous and false, for Jesus Christ may not be offered, because he may not die.

I most gently exhort all desiring to object against these precedents, ripely to consider the ground thereof, which stands not upon the opinion of man, but upon the infallible word of God; and to resume every part of their arguments and lay them to the whole body of God's scriptures. And then, I doubt not, but all men whose sense the Prince of Darkness and of this world has not execated, shall confess with me, that in the Mass can be no sacrifice for sin. And yet, to the great blasphemy of Christ's death, and open denial of his passion, it has been affirmed, taught, and believed, that the Mass was a sacrifice for the sins of the quick and the dead: which opinion is most false, vain, and wicked. And so, I think, the Mass to be abominable and idolatry no man of indifferent judgment will deny.

[The Mass is Not the Lord's Supper]

Let no man intend to excuse the Mass with the pretext of the Lord's Supper. For now will I prove that therewith it has no congruence, but is expressly contrary to it; and has taken the remembrance of the same out of mind. And further, it is blasphemous to the death of Jesus Christ.

First, they are contrary in institution. For the Lord's Supper was instituted to be a perpetual memory of those benefits which we have received by Jesus Christ, and by his death. And first we should call to mind in what estate we stood in the loins of Adam, when we all blasphemed the majesty of God in his face.

Secondly, that his own incomprehensible goodness moved him to love us most wretched and miserable, yea, most wicked and blasphemous and love most perfect compelled him to show mercy. And mercy pronounced the sentence, which was that his only Son should pay the price of our redemption. Which thing being rightly called to memory in the present action of the Supper, could not but move us to unfeigned thanksgiving unto God the Father, and to his only Son Jesus, who has restored us again to liberty and life. And this is it which Paul commands, saying, "As often as ye shall eat of this bread, and drink of this cup, ye shall declare the Lord's death till he come" (1 Cor. 11:26). That is, you shall laud, magnify, and extol the liberal kindness of God the Father, and the infinite benefits which you have received by Christ's death.

But the Mass is instituted, as the plain words thereof and their own laws do witness, to be a sacrifice for the sins of the quick and the dead: for doing of the which sacrifice, God is bound not only to remit our sins, but also to give unto us whatever we will ask. And that shall testify diverse Masses celebrated for diverse causes: some for peace in time of war, some for rain, some for fair weather; yea, and alas, my heart abhors such abomination! some for sickness of beasts. They will say, they severally take prayers for obtaining such things. And that is all which I desire they say; for the obtaining such vain trifles, they destinate their whole purpose, and so profane the sacrament of Christ's body and blood, if that were any sacrament which they abused so, which should never be used but in memory of Christ's death. Then should it not be used to pray that the toothache be taken away from us, that our oxen should not take the lowing ill, our horse the spavin or farcy, and so of all manner of diseases for our cattle. Yea, what was it wherefore you would not say Mass, perverse priests? But let us hear more.

The Supper of the Lord is the gift of Jesus Christ, in which we should laud the infinite mercy of God. The Mass is a sacrifice which we offer unto God, for doing whereof we allege God should love and commend us.

In the Supper of the Lord, we confess ourselves redeemed from sin by the death and blood of Jesus Christ only. In the Mass, we crave remission of sins yea, and whatsoever thing we list by working of that same work, which we presently do ourselves. And herein is the Mass blasphemous unto Christ and his passion. For insofar as it offers or permits remission of sins, it imputes imperfection upon Christ and his sacrifice; affirming that all sins were not remitted by his death, but that a great part are reserved to be purged by virtue and the value of the Mass. And also it is injurious unto Christ Jesus, and not only speaking most falsely of him, but also usurping to itself that which is proper to him alone. For he affirms that he alone has, by his own death, purged the sins of the world; and that no part rests to be changed by any other means. But the Mass sings another song, which is, that every day, by that oblation offered by the priests, sin is purged and remission obtained. Consider, Papists, what honour your Mass gives unto Christ Jesus!

Last, in the Supper of the Lord, we grant ourselves eternal debtors to God, and unable any way to make satisfaction for his infinite benefits which we have received. But in the Mass, we allege God to be a debtor unto us for oblation of that sacrifice which we there presently offer, and dare affirm that we there make satisfaction by doing thereof, for the sins of ourselves and of others.

If these precedents be not contrary, let men judge with indifference. They differ in use; for in the Lord's Supper, the minister and the congregation sat both at one table no difference between them in preeminence nor habit, as witnesses Jesus Christ with his disciples, and the practice of the apostles after his death. But in the papistical Mass, the priests are placed by themselves at one altar. And I would ask of the authority thereof, and what scripture commands so to be done. They must be clad in several habits, whereof no mention is made in the New Testament. It will not excuse them to say, Paul commanded all to be done with order and decently (1 Cor. 14:40). Dare they be so bold as to affirm that the Supper of Jesus Christ was done without order, and indecently, wherein were seen no such disguised vestments? Or will they set up to us again the Levitical priesthood? Should not all be taught by the plain word?

Prelates or priests, I ask one question: You would be like the vestments of Aaron in all things. Aaron had affixed unto his garments certain bells, which were commanded to ring, and to make sound, as often as he was clad therein. But, priests, your bells want tongues; they ring not; they sound of nothing but of the earth. The people understand nothing of all your ceremonies. Fear you not the wrath of God? It was commanded Aaron that the sound of bells should be heard, that he died not. Advise with this, for the matter appertains to you.

In the Supper of the Lord all were equally participants: the bread being broken, and the cup being distributed amongst all, according to his holy commandment. In the papistical Mass, the congregation gets nothing except the beholding of your jukings, noddings, crossings, turning, uplifting, which all are nothing but a diabolical profanation of Christ's Supper. Now, juke, cross, and nod as you list; they are but your own inventions. And finally, brethren, you got nothing, but gazed and beheld while one did eat and drink all.

It shall not excuse you to say, the congregation is participating spiritually. O, wicked Antichrists! says not Jesus Christ, "Eat of this, and drink of this; all do this in remembrance of me?" (Matt. 26:26-27). Christ commanded not that one should gaze upon it, bow, juke, and beck thereto, but that we should eat and drink thereof ourselves; and not that we should behold others do the same; unless we would confess the death of Jesus Christ to appertain nothing to us. For when I eat and drink at that table, I openly confess the fruit and virtue of Christ's body, of his blood and passion, to appertain to myself; and that I am a member of his mystical body; and that God the Father is appeased with me, notwithstanding my first corruption and present infirmities.

Judge, brethren, what comfort has this taken from us, [by them] which will that the sight thereof shall be sufficient. I would ask, first, if the sight of corporeal meat and drink does feed or nourish the body? I think they will say, "Nay." And I affirm that no more profit receives the soul in beholding another eat and drink the Lord's very Supper, than the body does in beholding another eat and drink, and though receiving no part thereof.

But now briefly, let this contradiction be collected. In the Lord's Supper are offered thanks for the benefits which we have received of God. In the Mass, the Papist will compel God to grant all that he asks of him, by virtue of the sacrifice, and so alleges that God should refer thanks unto him that does [the] Mass.

In the Supper of the Lord, the actors humbly do confess themselves redeemed only by Christ's blood, which once was shed. In the Mass, the priest vaunts himself to make a sacrifice for the sins of the quick and the dead.

Consider now, beloved brethren, what the fruits of the Mass have been, even in her greatest purity. The Mass is nothing but the invention of man, set up without all authority of God's word, for honouring of God; and therefore it is idolatry. Unto it is added a vain, false, deceitful, and most wicked opinion: that is, that by it is obtained remission of sins; and therefore it is abomination before God. It is contrary unto the Supper of Jesus Christ, and has taken away both the right use and remembrance thereof, and therefore it is blasphemous to Christ's death. Maintain or defend the papistical Mass who so list, this honour and service did all which used the same. And here I speak not of the most abominable abuses, as of buying and selling, used now of late by the mischievous priests; but of the Mass in her most high degree, and most honest garment; yea, even of the great Gaudeamus sung or said by Gregory the Great, as Papists do call him.

Let no man think that, because I am in the realm of England, therefore so boldly I speak against this abomination. Nay, God has taken that suspicion from me, for this body lying in most painful bonds, amongst the midst of cruel tyrants, his mercy and goodness provided that the hand should write, and bear witness to the confession of the heart more abundantly than ever yet the tongue spoke.

And here I call my God to record that neither profit to myself, hatred of any person or persons, nor affection or favour that I bear towards any private man, causes me this day to speak as you have heard; but only the obedience which I owe unto God in [the] ministry, showing of his word, and the common love which I bear to the salvation of all men. For so odious and abominable I know the Mass to be in God's presence, that unless you decline from the same, to life can you never attain. And therefore, brethren, flee from that idolatry, rather than from the present death.

Here would I have spoken of the diversity of sacrifice, but neither does time nor the wickedness of my own flesh permit that I do so. I will you [to] observe, that where I say there rests no sacrifice, nor yet are there any priests; that I mean, there rests no sacrifice to be offered for sin, nor yet are there any priests having power to offer such oblations. Otherwise, I do know that all true Christians are kings and priests, and do daily offer unto God a sacrifice most acceptable: the mortification of their affections, as Paul commanded in Romans. But hereof I may not remain to speak presently.

Such doctrine as was taught in your audience, upon Sunday before noon, I will prove, as opportunity shall permit, by God's scriptures, not only unprofitable, but also erroneous and deceitful. But first, according to my promise, I will send unto the teacher the extract thereof, to add or diminish as by his wisdom shall be thought most expedient. For God knows my mind is not captiously to trap men in words, but my only desire being that you, my audience, be instructed in the verity; wherefrom dissents some doctrine taught [to] you moves me to speak against all that may have appearance of lies and superstition.

And pray with me, brethren, that the Spirit may be ministered unto me in abundance, to speak at all times as it becomes a true messenger. And I will likewise pray that you may hear, understand, and obey with all reverence, the good will of God, declared unto the world by Jesus Christ, whose omnipotent Spirit remain with you forever.

Here, perhaps, we ought to stop. But a solicitude for your welfare, which cannot end but with my life, and the apprehension of danger, natural to that solicitude, urge me, on an occasion like the present, to offer to your solemn contemplation, and to recommend to your frequent review, some sentiments which are the result of much reflection, of no inconsiderable observation, and which appear to me all-important to the permanency of your felicity as a people. Nor can I forget, as an encouragement to it, your indulgent reception of my sentiments on a former and not dissimilar occasion.

If we wish to be free -- if we mean to preserve inviolate those inestimable privileges for which we have been so long contending -- if we mean not basely to abandon the noble struggle in which we have been so long engaged, and which we have pledged ourselves never to abandon until the glorious object of our contest shall be obtained, we must fight! I repeat it, sir, we must fight! An appeal to arms and to the God of Hosts is all that is left us!

We need to stop destroying imperfect people at the altar of an unobtainable morality.

We need to start living up to the standards which the public, in its infinite wisdom, understands that imperfect people must strive towards, but too often fall short.

We are now rapidly descending into a politics where life imitates farce. Fratricide dominates our public debate and America is held hostage to tactics of smear and fear.

Let all of us here today say no to resignation, no to impeachment, no to hatred, no to intolerance of each other, and no to vicious self-righteousness.

We need to start healing. We need to start binding up our wounds. We need to end this downward spiral which will culminate in the death of representative democracy.

I believe this healing can start today by changing the course we've begun.

This is exactly why we need this today to be bipartisan. This is why we ask the opportunity to vote on a bipartisan censure resolution, to begin the process of healing our nation and healing our people.

We are on the brink of the abyss. The only way we stop this insanity is through the force of our own will.

The only way we stop this spiral is for all of us to finally say -- enough.

Let us step back from the abyss and let's begin a new politics of respect and fairness and decency which raises what has come before.

They tell us, sir, that we are weak -- unable to cope with so formidable an adversary. But when shall we be stronger? Will it be the next week, or the next year? Will it be when we are totally disarmed, and when a British guard shall be stationed in every house? Shall we gather strength by irresolution and inaction? Shall we acquire the means of effectual resistance, by lying supinely on our backs, and hugging the delusive phantom of hope, until our enemies shall have bound us hand and foot?

Thus much, gentlemen, I have thought it incumbent on me to observe to you, to show upon what principles I opposed the irregular and hasty meeting which was proposed to have been held on Tuesday last - and not because I wanted a disposition to give you every opportunity consistent with your own honor, and the dignity of the army, to make known your grievances. If my conduct heretofore has not evinced to you that I have been a faithful friend to the army, my declaration of it at this time would be equally unavailing and improper. But as I was among the first who embarked in the cause of our common country. As I have never left your side one moment, but when called from you on public duty. As I have been the constant companion and witness of your distresses, and not among the last to feel and acknowledge your merits. As I have ever considered my own military reputation as inseparably connected with that of the army. As my heart has ever expanded with joy, when I have heard its praises, and my indignation has arisen, when the mouth of detraction has been opened against it, it can scarcely be supposed, at this late stage of the war, that I am indifferent to its interests.

But how are they to be promoted? The way is plain, says the anonymous addresser. If war continues, remove into the unsettled country, there establish yourselves, and leave an ungrateful country to defend itself. But who are they to defend? Our wives, our children, our farms, and other property which we leave behind us. Or, in this state of hostile separation, are we to take the two first (the latter cannot be removed) to perish in a wilderness, with hunger, cold, and nakedness? If peace takes place, never sheathe your swords, says he, until you have obtained full and ample justice; this dreadful alternative, of either deserting our country in the extremest hour of her distress or turning our arms against it (which is the apparent object, unless Congress can be compelled into instant compliance), has something so shocking in it that humanity revolts at the idea. My God! What can this writer have in view, by recommending such measures? Can he be a friend to the army? Can he be a friend to this country? Rather, is he not an insidious foe? Some emissary, perhaps, from New York, plotting the ruin of both, by sowing the seeds of discord and separation between the civil and military powers of the continent? And what a compliment does he pay to our understandings when he recommends measures in either alternative, impracticable in their nature?

I cannot, in justice to my own belief, and what I have great reason to conceive is the intention of Congress, conclude this address, without giving it as my decided opinion, that that honorable body entertain exalted sentiments of the services of the army; and, from a full conviction of its merits and sufferings, will do it complete justice. That their endeavors to discover and establish funds for this purpose have been unwearied, and will not cease till they have succeeded, I have not a doubt. But, like all other large bodies, where there is a variety of different interests to reconcile, their deliberations are slow. Why, then, should we distrust them? And, in consequence of that distrust, adopt measures which may cast a shade over that glory which has been so justly acquired; and tarnish the reputation of an army which is celebrated through all Europe, for its fortitude and patriotism? And for what is this done? To bring the object we seek nearer? No! most certainly, in my opinion, it will cast it at a greater distance.

For myself (and I take no merit in giving the assurance, being induced to it from principles of gratitude, veracity, and justice), a grateful sense of the confidence you have ever placed in me, a recollection of the cheerful assistance and prompt obedience I have experienced from you, under every vicissitude of fortune, and the sincere affection I feel for an army I have so long had the honor to command will oblige me to declare, in this public and solemn manner, that, in the attainment of complete justice for all your toils and dangers, and in the gratification of every wish, so far as may be done consistently with the great duty I owe my country and those powers we are bound to respect, you may freely command my services to the utmost of my abilities.

While I give you these assurances, and pledge myself in the most unequivocal manner to exert whatever ability I am possessed of in your favor, let me entreat you, gentlemen, on your part, not to take any measures which, viewed in the calm light of reason, will lessen the dignity and sully the glory you have hitherto maintained; let me request you to rely on the plighted faith of your country, and place a full confidence in the purity of the intentions of Congress; that, previous to your dissolution as an army, they will cause all your accounts to be fairly liquidated, as directed in their resolutions, which were published to you two days ago, and that they will adopt the most effectual measures in their power to render ample justice to you, for your faithful and meritorious services. And let me conjure you, in the name of our common country, as you value your own sacred honor, as you respect the rights of humanity, and as you regard the military and national character of America, to express your utmost horror and detestation of the man who wishes, under any specious pretenses, to overturn the liberties of our country, and who wickedly attempts to open the floodgates of civil discord and deluge our rising empire in blood.

By thus determining and thus acting, you will pursue the plain and direct road to the attainment of your wishes. You will defeat the insidious designs of our enemies, who are compelled to resort from open force to secret artifice. You will give one more distinguished proof of unexampled patriotism and patient virtue, rising superior to the pressure of the most complicated sufferings. And you will, by the dignity of your conduct, afford occasion for posterity to say, when speaking of the glorious example you have exhibited to mankind, "Had this day been wanting, the world had never seen the last stage of perfection to which human nature is capable of attaining."

Sir, we are not weak, if we make a proper use of the means which the God of nature hath placed in our power. Three millions of people, armed in the holy cause of liberty, and in such a country as that which we possess, are invincible by any force which our enemy can send against us. Besides, sir, we shall not fight our battles alone. There is a just God who presides over the destinies of nations, and who will raise up friends to fight our battles for us.

The battle, sir, is not to the strong alone; it is to the vigilant, the active, the brave. Besides, sir, we have no election. If we were base enough to desire it, it is now too late to retire from the contest. There is no retreat but in submission and slavery! Our chains are forged! Their clanking may be heard on the plains of Boston! The war is inevitable -- and let it come! I repeat it, sir, let it come!

I ask that we stop refighting the battles and the recriminations of the past. I ask that we look now at what is right with America, at our possibilities and our potentialities for change and growth and achievement and sharing. I ask that we accept the responsibilities of leadership as a good neighbor to all peoples and the enemy of none. I ask that we strive to become, in the finest American tradition, something more tomorrow than we are today.

Instead of my addressing the image of America, I prefer to consider the reality of America. It is true that we have launched our Bicentennial celebration without having achieved human perfection, but we have attained a very remarkable self-governed society that possesses the flexibility and the dynamism to grow and undertake an entirely new agenda, an agenda for America's third century.

So, I ask you to join me in helping to write that agenda. I am as determined as a President can be to seek national rediscovery of the belief in ourselves that characterized the most creative periods in our Nation's history. The greatest challenge of creativity, as I see it, lies ahead.

We, of course, are saddened indeed by the events in Indochina. But these events, tragic as they are, portend neither the end of the world nor of America's leadership in the world.

Let me put it this way, if I might. Some tend to feel that if we do not succeed in everything everywhere, then we have succeeded in nothing anywhere. I reject categorically such polarized thinking. We can and we should help others to help themselves. But the fate of responsible men and women everywhere, in the final decision, rests in their own hands, not in ours.

America's future depends upon Americans -- especially your generation, which is now equipping itself to assume the challenges of the future, to help write the agenda for America.

Earlier today, in this great community, I spoke about the need to maintain our defenses. Tonight, I would like to talk about another kind of strength, the true source of American power that transcends all of the deterrent powers for peace of our Armed Forces. I am speaking here of our belief in ourselves and our belief in our Nation.

Abraham Lincoln asked, in his own words, and I quote, "What constitutes the bulwark of our own liberty and independence?" And he answered, "It is not our frowning battlements or bristling seacoasts, our Army or our Navy. Our defense is in the spirit which prized liberty as the heritage of all men, in all lands everywhere."

It is in this spirit that we must now move beyond the discords of the past decade. It is in this spirit that I ask you to join me in writing an agenda for the future.

I welcome your invitation particularly tonight, because I know it is at Tulane and other centers of thought throughout our great country that much consideration is being given to the kind of future Americans want and, just as importantly, will work for. Each of you are preparing yourselves for the future, and I am deeply interested in your preparations and your opinions and your goals. However, tonight, with your indulgence, let me share with you my own views.

I envision a creative program that goes as far as our courage and our capacities can take us, both at home and abroad. My goal is for a cooperative world at peace, using its resources to build, not to destroy.

As President, I am determined to offer leadership to overcome our current economic problems. My goal is for jobs for all who want to work and economic opportunity for all who want to achieve.

I am determined to seek self-sufficiency in energy as an urgent national priority. My goal is to make America independent of foreign energy sources by 1985.

Of course, I will pursue interdependence with other nations and a reformed international economic system. My goal is for a world in which consuming and producing nations achieve a working balance.

I will address the humanitarian issues of hunger and famine, of health and of healing. My goal is to achieve -- or to assure basic needs and an effective system to achieve this result.

I recognize the need for technology that enriches life while preserving our natural environment. My goal is to stimulate productivity, but use technology to redeem, not to destroy our environment.

I will strive for new cooperation rather than conflict in the peaceful exploration of our oceans and our space. My goal is to use resources for peaceful progress rather than war and destruction.

Let America symbolize humanity's struggle to conquer nature and master technology. The time has now come for our Government to facilitate the individual's control over his or her future -- and of the future of America.

But the future requires more than Americans congratulating themselves on how much we know and how many products that we can produce. It requires new knowledge to meet new problems. We must not only be motivated to build a better America, we must know how to do it.

If we really want a humane America that will, for instance, contribute to the alleviation of the world's hunger, we must realize that good intentions do not feed people. Some problems, as anyone who served in the Congress knows, are complex. There arc no easy answers. Willpower alone does not grow food.

We thought, in a well-intentioned past, that we could export our technology lock, stock, and barrel to developing nations. We did it with the best of intentions. But we are now learning that a strain of rice that grows in one place will not grow in another; that factories that produce at 100 percent in one nation produce less than half as much in a society where temperaments and work habits are somewhat different.

Yet, the world economy has become interdependent. Not only food technology but money management, natural resources and energy, research and development -- all kinds of this group require an organized world society that makes the maximum effective use of the world's resources.

I want to tell the world: Let's grow food together, but let's also learn more about nutrition, about weather forecasting, about irrigation, about the many other specialties involved in helping people to help themselves.

We must learn more about people, about the development of communities, architecture, engineering, education, motivation, productivity, public health and medicine, arts and sciences, political, legal, and social organization. All of these specialities and many, many more are required if young people like you are to help this Nation develop an agenda for our future -- your future, our country's future.

Interwoven as is the love of liberty with every ligament of your hearts, no recommendation of mine is necessary to fortify or confirm the attachment.

The unity of government which constitutes you one people is also now dear to you. It is justly so, for it is a main pillar in the edifice of your real independence, the support of your tranquility at home, your peace abroad; of your safety; of your prosperity; of that very liberty which you so highly prize. But as it is easy to foresee that, from different causes and from different quarters, much pains will be taken, many artifices employed to weaken in your minds the conviction of this truth; as this is the point in your political fortress against which the batteries of internal and external enemies will be most constantly and actively (though often covertly and insidiously) directed, it is of infinite moment that you should properly estimate the immense value of your national union to your collective and individual happiness; that you should cherish a cordial, habitual, and immovable attachment to it; accustoming yourselves to think and speak of it as of the palladium of your political safety and prosperity; watching for its preservation with jealous anxiety; discountenancing whatever may suggest even a suspicion that it can in any event be abandoned; and indignantly frowning upon the first dawning of every attempt to alienate any portion of our country from the rest, or to enfeeble the sacred ties which now link together the various parts.

For this you have every inducement of sympathy and interest. Citizens, by birth or choice, of a common country, that country has a right to concentrate your affections. The name of American, which belongs to you in your national capacity, must always exalt the just pride of patriotism more than any appellation derived from local discriminations. With slight shades of difference, you have the same religion, manners, habits, and political principles. You have in a common cause fought and triumphed together; the independence and liberty you possess are the work of joint counsels, and joint efforts of common dangers, sufferings, and successes.

But these considerations, however powerfully they address themselves to your sensibility, are greatly outweighed by those which apply more immediately to your interest. Here every portion of our country finds the most commanding motives for carefully guarding and preserving the union of the whole.

The North, in an unrestrained intercourse with the South, protected by the equal laws of a common government, finds in the productions of the latter great additional resources of maritime and commercial enterprise and precious materials of manufacturing industry. The South, in the same intercourse, benefiting by the agency of the North, sees its agriculture grow and its commerce expand. Turning partly into its own channels the seamen of the North, it finds its particular navigation invigorated; and, while it contributes, in different ways, to nourish and increase the general mass of the national navigation, it looks forward to the protection of a maritime strength, to which itself is unequally adapted. The East, in a like intercourse with the West, already finds, and in the progressive improvement of interior communications by land and water, will more and more find a valuable vent for the commodities which it brings from abroad, or manufactures at home. The West derives from the East supplies requisite to its growth and comfort, and, what is perhaps of still greater consequence, it must of necessity owe the secure enjoyment of indispensable outlets for its own productions to the weight, influence, and the future maritime strength of the Atlantic side of the Union, directed by an indissoluble community of interest as one nation. Any other tenure by which the West can hold this essential advantage, whether derived from its own separate strength, or from an apostate and unnatural connection with any foreign power, must be intrinsically precarious.

While, then, every part of our country thus feels an immediate and particular interest in union, all the parts combined cannot fail to find in the united mass of means and efforts greater strength, greater resource, proportionably greater security from external danger, a less frequent interruption of their peace by foreign nations; and, what is of inestimable value, they must derive from union an exemption from those broils and wars between themselves, which so frequently afflict neighboring countries not tied together by the same governments, which their own rival ships alone would be sufficient to produce, but which opposite foreign alliances, attachments, and intrigues would stimulate and embitter. Hence, likewise, they will avoid the necessity of those overgrown military establishments which, under any form of government, are inauspicious to liberty, and which are to be regarded as particularly hostile to republican liberty. In this sense it is that your union ought to be considered as a main prop of your liberty, and that the love of the one ought to endear to you the preservation of the other.

These considerations speak a persuasive language to every reflecting and virtuous mind, and exhibit the continuance of the Union as a primary object of patriotic desire. Is there a doubt whether a common government can embrace so large a sphere? Let experience solve it. To listen to mere speculation in such a case were criminal. We are authorized to hope that a proper organization of the whole with the auxiliary agency of governments for the respective subdivisions, will afford a happy issue to the experiment. It is well worth a fair and full experiment. With such powerful and obvious motives to union, affecting all parts of our country, while experience shall not have demonstrated its impracticability, there will always be reason to distrust the patriotism of those who in any quarter may endeavor to weaken its bands.

In contemplating the causes which may disturb our Union, it occurs as matter of serious concern that any ground should have been furnished for characterizing parties by geographical discriminations, Northern and Southern, Atlantic and Western; whence designing men may endeavor to excite a belief that there is a real difference of local interests and views. One of the expedients of party to acquire influence within particular districts is to misrepresent the opinions and aims of other districts. You cannot shield yourselves too much against the jealousies and heartburnings which spring from these misrepresentations; they tend to render alien to each other those who ought to be bound together by fraternal affection. The inhabitants of our Western country have lately had a useful lesson on this head; they have seen, in the negotiation by the Executive, and in the unanimous ratification by the Senate, of the treaty with Spain, and in the universal satisfaction at that event, throughout the United States, a decisive proof how unfounded were the suspicions propagated among them of a policy in the General Government and in the Atlantic States unfriendly to their interests in regard to the Mississippi; they have been witnesses to the formation of two treaties, that with Great Britain, and that with Spain, which secure to them everything they could desire, in respect to our foreign relations, towards confirming their prosperity. Will it not be their wisdom to rely for the preservation of these advantages on the Union by which they were procured ? Will they not henceforth be deaf to those advisers, if such there are, who would sever them from their brethren and connect them with aliens?

To the efficacy and permanency of your Union, a government for the whole is indispensable. No alliance, however strict, between the parts can be an adequate substitute; they must inevitably experience the infractions and interruptions which all alliances in all times have experienced. Sensible of this momentous truth, you have improved upon your first essay, by the adoption of a constitution of government better calculated than your former for an intimate union, and for the efficacious management of your common concerns. This government, the offspring of our own choice, uninfluenced and unawed, adopted upon full investigation and mature deliberation, completely free in its principles, in the distribution of its powers, uniting security with energy, and containing within itself a provision for its own amendment, has a just claim to your confidence and your support. Respect for its authority, compliance with its laws, acquiescence in its measures, are duties enjoined by the fundamental maxims of true liberty. The basis of our political systems is the right of the people to make and to alter their constitutions of government. But the Constitution which at any time exists, till changed by an explicit and authentic act of the whole people, is sacredly obligatory upon all. The very idea of the power and the right of the people to establish government presupposes the duty of every individual to obey the established government.

All obstructions to the execution of the laws, all combinations and associations, under whatever plausible character, with the real design to direct, control, counteract, or awe the regular deliberation and action of the constituted authorities, are destructive of this fundamental principle, and of fatal tendency. They serve to organize faction, to give it an artificial and extraordinary force; to put, in the place of the delegated will of the nation the will of a party, often a small but artful and enterprising minority of the community; and, according to the alternate triumphs of different parties, to make the public administration the mirror of the ill-concerted and incongruous projects of faction, rather than the organ of consistent and wholesome plans digested by common counsels and modified by mutual interests.

However combinations or associations of the above description may now and then answer popular ends, they are likely, in the course of time and things, to become potent engines, by which cunning, ambitious, and unprincipled men will be enabled to subvert the power of the people and to usurp for themselves the reins of government, destroying afterwards the very engines which have lifted them to unjust dominion.

Towards the preservation of your government, and the permanency of your present happy state, it is requisite, not only that you steadily discountenance irregular oppositions to its acknowledged authority, but also that you resist with care the spirit of innovation upon its principles, however specious the pretexts. One method of assault may be to effect, in the forms of the Constitution, alterations which will impair the energy of the system, and thus to undermine what cannot be directly overthrown. In all the changes to which you may be invited, remember that time and habit are at least as necessary to fix the true character of governments as of other human institutions; that experience is the surest standard by which to test the real tendency of the existing constitution of a country; that facility in changes, upon the credit of mere hypothesis and opinion, exposes to perpetual change, from the endless variety of hypothesis and opinion; and remember, especially, that for the efficient management of your common interests, in a country so extensive as ours, a government of as much vigor as is consistent with the perfect security of liberty is indispensable. Liberty itself will find in such a government, with powers properly distributed and adjusted, its surest guardian. It is, indeed, little else than a name, where the government is too feeble to withstand the enterprises of faction, to confine each member of the society within the limits prescribed by the laws, and to maintain all in the secure and tranquil enjoyment of the rights of person and property.

I have already intimated to you the danger of parties in the State, with particular reference to the founding of them on geographical discriminations. Let me now take a more comprehensive view, and warn you in the most solemn manner against the baneful effects of the spirit of party generally.

This spirit, unfortunately, is inseparable from our nature, having its root in the strongest passions of the human mind. It exists under different shapes in all governments, more or less stifled, controlled, or repressed; but, in those of the popular form, it is seen in its greatest rankness, and is truly their worst enemy.

The alternate domination of one faction over another, sharpened by the spirit of revenge, natural to party dissension, which in different ages and countries has perpetrated the most horrid enormities, is itself a frightful despotism. But this leads at length to a more formal and permanent despotism. The disorders and miseries which result gradually incline the minds of men to seek security and repose in the absolute power of an individual; and sooner or later the chief of some prevailing faction, more able or more fortunate than his competitors, turns this disposition to the purposes of his own elevation, on the ruins of public liberty.

Without looking forward to an extremity of this kind (which nevertheless ought not to be entirely out of sight), the common and continual mischiefs of the spirit of party are sufficient to make it the interest and duty of a wise people to discourage and restrain it.

It serves always to distract the public councils and enfeeble the public administration. It agitates the community with ill-founded jealousies and false alarms, kindles the animosity of one part against another, foments occasionally riot and insurrection. It opens the door to foreign influence and corruption, which finds a facilitated access to the government itself through the channels of party passions. Thus the policy and the will of one country are subjected to the policy and will of another.

There is an opinion that parties in free countries are useful checks upon the administration of the government and serve to keep alive the spirit of liberty. This within certain limits is probably true; and in governments of a monarchical cast, patriotism may look with indulgence, if not with favor, upon the spirit of party. But in those of the popular character, in governments purely elective, it is a spirit not to be encouraged. From their natural tendency, it is certain there will always be enough of that spirit for every salutary purpose. And there being constant danger of excess, the effort ought to be by force of public opinion, to mitigate and assuage it. A fire not to be quenched, it demands a uniform vigilance to prevent its bursting into a flame, lest, instead of warming, it should consume.

It is important, likewise, that the habits of thinking in a free country should inspire caution in those entrusted with its administration, to confine themselves within their respective constitutional spheres, avoiding in the exercise of the powers of one department to encroach upon another. The spirit of encroachment tends to consolidate the powers of all the departments in one, and thus to create, whatever the form of government, a real despotism. A just estimate of that love of power, and proneness to abuse it, which predominates in the human heart, is sufficient to satisfy us of the truth of this position. The necessity of reciprocal checks in the exercise of political power, by dividing and distributing it into different depositaries, and constituting each the guardian of the public weal against invasions by the others, has been evinced by experiments ancient and modern; some of them in our country and under our own eyes. To preserve them must be as necessary as to institute them. If, in the opinion of the people, the distribution or modification of the constitutional powers be in any particular wrong, let it be corrected by an amendment in the way which the Constitution designates. But let there be no change by usurpation; for though this, in one instance, may be the instrument of good, it is the customary weapon by which free governments are destroyed. The precedent must always greatly overbalance in permanent evil any partial or transient benefit, which the use can at any time yield.

Of all the dispositions and habits which lead to political prosperity, religion and morality are indispensable supports. In vain would that man claim the tribute of patriotism, who should labor to subvert these great pillars of human happiness, these firmest props of the duties of men and citizens. The mere politician, equally with the pious man, ought to respect and to cherish them. A volume could not trace all their connections with private and public felicity. Let it simply be asked: Where is the security for property, for reputation, for life, if the sense of religious obligation desert the oaths which are the instruments of investigation in courts of justice ? And let us with caution indulge the supposition that morality can be maintained without religion. Whatever may be conceded to the influence of refined education on minds of peculiar structure, reason and experience both forbid us to expect that national morality can prevail in exclusion of religious principle.

It is substantially true that virtue or morality is a necessary spring of popular government. The rule, indeed, extends with more or less force to every species of free government. Who that is a sincere friend to it can look with indifference upon attempts to shake the foundation of the fabric?

Promote then, as an object of primary importance, institutions for the general diffusion of knowledge. In proportion as the structure of a government gives force to public opinion, it is essential that public opinion should be enlightened.

As a very important source of strength and security, cherish public credit. One method of preserving it is to use it as sparingly as possible, avoiding occasions of expense by cultivating peace, but remembering also that timely disbursements to prepare for danger frequently prevent much greater disbursements to repel it, avoiding likewise the accumulation of debt, not only by shunning occasions of expense, but by vigorous exertion in time of peace to discharge the debts which unavoidable wars may have occasioned, not ungenerously throwing upon posterity the burden which we ourselves ought to bear. The execution of these maxims belongs to your representatives, but it is necessary that public opinion should co-operate. To facilitate to them the performance of their duty, it is essential that you should practically bear in mind that towards the payment of debts there must be revenue; that to have revenue there must be taxes; that no taxes can be devised which are not more or less inconvenient and unpleasant; that the intrinsic embarrassment, inseparable from the selection of the proper objects (which is always a choice of difficulties), ought to be a decisive motive for a candid construction of the conduct of the government in making it, and for a spirit of acquiescence in the measures for obtaining revenue, which the public exigencies may at any time dictate.

Observe good faith and justice towards all nations; cultivate peace and harmony with all. Religion and morality enjoin this conduct; and can it be, that good policy does not equally enjoin it 7 It will be worthy of a free, enlightened, and at no distant period, a great nation, to give to mankind the magnanimous and too novel example of a people always guided by an exalted justice and benevolence. Who can doubt that, in the course of time and things, the fruits of such a plan would richly repay any temporary advantages which might be lost by a steady adherence to it ? Can it be that Providence has not connected the permanent felicity of a nation with its virtue ? The experiment, at least, is recommended by every sentiment which ennobles human nature. Alas! is it rendered impossible by its vices?

In the execution of such a plan, nothing is more essential than that permanent, inveterate antipathies against particular nations, and passionate attachments for others, should be excluded; and that, in place of them, just and amicable feelings towards all should be cultivated. The nation which indulges towards another a habitual hatred or a habitual fondness is in some degree a slave. It is a slave to its animosity or to its affection, either of which is sufficient to lead it astray from its duty and its interest. Antipathy in one nation against another disposes each more readily to offer insult and injury, to lay hold of slight causes of umbrage, and to be haughty and intractable, when accidental or trifling occasions of dispute occur. Hence, frequent collisions, obstinate, envenomed, and bloody contests. The nation, prompted by ill-will and resentment, sometimes impels to war the government, contrary to the best calculations of policy. The government sometimes participates in the national propensity, and adopts through passion what reason would reject; at other times it makes the animosity of the nation subservient to projects of hostility instigated by pride, ambition, and other sinister and pernicious motives. The peace often, sometimes perhaps the liberty, of nations, has been the victim.

So likewise, a passionate attachment of one nation for another produces a variety of evils. Sympathy for the favorite nation, facilitating the illusion of an imaginary common interest in cases where no real common interest exists, and infusing into one the enmities of the other, betrays the former into a participation in the quarrels and wars of the latter without adequate inducement or justification. It leads also to concessions to the favorite nation of privileges denied to others which is apt doubly to injure the nation making the concessions; by unnecessarily parting with what ought to have been retained, and by exciting jealousy, ill-will, and a disposition to retaliate, in the parties from whom equal privileges are withheld. And it gives to ambitious, corrupted, or deluded citizens (who devote themselves to the favorite nation), facility to betray or sacrifice the interests of their own country, without odium, sometimes even with popularity; gilding, with the appearances of a virtuous sense of obligation, a commendable deference for public opinion, or a laudable zeal for public good, the base or foolish compliances of ambition, corruption, or infatuation.

As avenues to foreign influence in innumerable ways, such attachments are particularly alarming to the truly enlightened and independent patriot. How many opportunities do they afford to tamper with domestic factions, to practice the arts of seduction, to mislead public opinion, to influence or awe the public councils 7 Such an attachment of a small or weak towards a great and powerful nation dooms the former to be the satellite of the latter.

Against the insidious wiles of foreign influence (I conjure you to believe me, fellow-citizens) the jealousy of a free people ought to be constantly awake, since history and experience prove that foreign influence is one of the most baneful foes of republican government. But that jealousy to be useful must be impartial; else it becomes the instrument of the very influence to be avoided, instead of a defense against it. Excessive partiality for one foreign nation and excessive dislike of another cause those whom they actuate to see danger only on one side, and serve to veil and even second the arts of influence on the other. Real patriots who may resist the intrigues of the favorite are liable to become suspected and odious, while its tools and dupes usurp the applause and confidence of the people, to surrender their interests.

The great rule of conduct for us in regard to foreign nations is in extending our commercial relations, to have with them as little political connection as possible. So far as we have already formed engagements, let them be fulfilled with perfect good faith. Here let us stop. Europe has a set of primary interests which to us have none; or a very remote relation. Hence she must be engaged in frequent controversies, the causes of which are essentially foreign to our concerns. Hence, therefore, it must be unwise in us to implicate ourselves by artificial ties in the ordinary vicissitudes of her politics, or the ordinary combinations and collisions of her friendships or enmities.

Our detached and distant situation invites and enables us to pursue a different course. If we remain one people under an efficient government. the period is not far off when we may defy material injury from external annoyance; when we may take such an attitude as will cause the neutrality we may at any time resolve upon to be scrupulously respected; when belligerent nations, under the impossibility of making acquisitions upon us, will not lightly hazard the giving us provocation; when we may choose peace or war, as our interest, guided by justice, shall counsel.

Why forego the advantages of so peculiar a situation? Why quit our own to stand upon foreign ground? Why, by interweaving our destiny with that of any part of Europe, entangle our peace and prosperity in the toils of European ambition, rivalship, interest, humor or caprice?

It is our true policy to steer clear of permanent alliances with any portion of the foreign world; so far, I mean, as we are now at liberty to do it; for let me not be understood as capable of patronizing infidelity to existing engagements. I hold the maxim no less applicable to public than to private affairs, that honesty is always the best policy. I repeat it, therefore, let those engagements be observed in their genuine sense. But, in my opinion, it is unnecessary and would be unwise to extend them.

Taking care always to keep ourselves by suitable establishments on a respectable defensive posture, we may safely trust to temporary alliances for extraordinary emergencies.

Harmony, liberal intercourse with all nations, are recommended by policy, humanity, and interest. But even our commercial policy should hold an equal and impartial hand; neither seeking nor granting exclusive favors or preferences; consulting the natural course of things; diffusing and diversifying by gentle means the streams of commerce, but forcing nothing; establishing (with powers so disposed, in order to give trade a stable course, to define the rights of our merchants, and to enable the government to support them) conventional rules of intercourse, the best that present circumstances and mutual opinion will permit, but temporary, and liable to be from time to time abandoned or varied, as experience and circumstances shall dictate; constantly keeping in view that it is folly in one nation to look for disinterested favors from another; that it must pay with a portion of its independence for whatever it may accept under that character; that, by such acceptance, it may place itself in the condition of having given equivalents for nominal favors, and yet of being reproached with ingratitude for not giving more. There can be no greater error than to expect or calculate upon real favors from nation to nation. It is an illusion, which experience must cure, which a just pride ought to discard.

In offering to you, my countrymen, these counsels of an old and affectionate friend, I dare not hope they will make the strong and lasting impression I could wish; that they will control the usual current of the passions, or prevent our nation from running the course which has hitherto marked the destiny of nations. But, if I may even flatter myself that they may be productive of some partial benefit, some occasional good; that they may now and then recur to moderate the fury of party spirit, to warn against the mischiefs of foreign intrigue, to guard against the impostures of pretended patriotism; this hope will be a full recompense for the solicitude for your welfare, by which they have been dictated.

How far in the discharge of my official duties I have been guided by the principles which have been delineated, the public records and other evidences of my conduct must witness to you and to the world. To myself, the assurance of my own conscience is, that I have at least believed myself to be guided by them.

In relation to the still subsisting war in Europe, my proclamation of the twenty-second of April, I793, is the index of my plan. Sanctioned by your approving voice, and by that of your representatives in both houses of Congress, the spirit of that measure has continually governed me, uninfluenced by any attempts to deter or divert me from it.

After deliberate examination, with the aid of the best lights I could obtain, I was well satisfied that our country, under all the circumstances of the case, had a right to take, and was bound in duty and interest to take, a neutral position. Having taken it, I determined, as far as should depend upon me, to maintain it, with moderation, perseverance, and firmness.

The considerations which respect the right to hold this con duct, it is not necessary on this occasion to detail. I will only observe that, according to my understanding of the matter, that right, so far from being denied by any of the belligerent powers, has been virtually admitted by all.

The duty of holding a neutral conduct may be inferred, without anything more, from the obligation which justice and humanity impose on every nation, in cases in which it is free to act, to maintain inviolate the relations of peace and amity towards other nations.

The inducements of interest for observing that conduct will best be referred to your own reflections and experience. With me a predominant motive has been to endeavor to gain time to our country to settle and mature its yet recent institutions, and to progress without interruption to that degree of strength and consistency which is necessary to give it, humanly speaking, the command of its own fortunes.

Though, in reviewing the incidents of my administration, I am unconscious of intentional error, I am nevertheless too sensible of my defects not to think it probable that I may have committed many errors. Whatever they may be, I fervently beseech the Almighty to avert or mitigate the evils to which they may tend. I shall also carry with me the hope that my country will never cease to view them with indulgence; and that, after forty five years of my life dedicated to its service with an upright zeal, the faults of incompetent abilities will be consigned to oblivion, as myself must soon be to the mansions of rest.

Relying on its kindness in this as in other things, and actuated by that fervent love towards it, which is so natural to a man who views in it the native soil of himself and his progenitors for several generations, I anticipate with pleasing expectation that retreat in which I promise myself to realize, without alloy, the sweet enjoyment of partaking, in the midst of my fellow-citizens, the benign influence of good laws under a free government, the ever-favorite object of my heart, and the happy reward, as I trust, of our mutual cares, labors, and dangers.

A few years ago, while browsing around the library downtown, I had to take a piss. As I entered the john a big beautiful all-american football hero type, about twenty-five, came out of one of the booths. I stood at the urinal looking at him out of the corner of my eye as he washed his hands. He didn't once look at me. I knelt before the bowl, inhaling the rich brown fragrance and wondered if I should obey the impulse building up inside me. I'd always been a heavy rimmer and had lapped up more than one little clump of shit, but that had been just an inevitable part of eating ass and not an end in itself. Of course I'd had jerk-off fantasies of devouring great loads of it (what rimmer hasn't), but I had never done it. Now, here I was, confronted with the most beautiful five-pound turd I'd ever feasted my eyes on, a sausage fit to star in any fantasy and one I knew to have been hatched from the asshole of the world's handsomest young stud. The sanctity of the host, and the issues of divinity behind it are more than relevant to current discussions as to the fate of this community, and this brings up larger issues, as to the true nature of this board. We come then to the great question. Is it desirable to retain the board as an organ of agency for the prosecution of open discourse on issues involving legal education? I think that it is desirable. The question is, I acknowledge, beset with difficulties. We have to solve one of the hardest problems in politics. We are trying to make brick without straw, to bring a clean thing out of an unclean, to give a good government to a people to whom we cannot give a free government. In this country, in any neighbouring country, it is easy to frame securities against oppression. In Europe, you have the materials of good government everywhere ready to your hands. The people are everywhere perfectly competent to hold some share, not in every country an equal share, but some share of political power. If the question were, What is the best mode of securing good government in Europe? the merest smatterer in politics would answer, representative institutions. In India you cannot have representative institutions. Of all the innumerable speculators who have offered their suggestions on Indian politics, not a single one, as far as I know, however democratical his opinions may be, has ever maintained the possibility of giving, at the present time, such institutions to India. One gentleman, extremely well acquainted with the affairs of our Eastern Empire, a most valuable servant of the Company, and the author of a History of India, which, though certainly not free from faults, is, I think, on the whole, the greatest historical work which has appeared in our language since that of Gibbon, I mean Mr Mill, was examined on this point. That gentleman is well known to be a very bold and uncompromising politician. He has written strongly, far too strongly I think, in favour of pure democracy. He has gone so far as to maintain that no nation which has not a representative legislature, chosen by universal suffrage, enjoys security against oppression. But when he was asked before the Committee of last year, whether he thought representative government practicable in India, his answer was, "utterly out of the question." This, then, is the state in which we are. We have to frame a good government for a country into which, by universal acknowledgment, we cannot introduce those institutions which all our habits, which all the reasonings of European philosophers, which all the history of our own part of the world would lead us to consider as the one great security for good government. We have to engraft on despotism those blessings which are the natural fruits of liberty. In these circumstances, Sir, it behoves us to be cautious, even to the verge of timidity. The light of political science and of history are withdrawn: we are walking in darkness: we do not distinctly see whither we are going. It is the wisdom of a man, so situated, to feel his way, and not to plant his foot till he is well assured that the ground before him is firm.

Some things, however, in the midst of this obscurity, I can see with clearness. I can see, for example, that it is desirable that the authority exercised in this country over the Indian government should be divided between two bodies, between a minister or a board appointed by the Crown, and some other body independent of the Crown. If India is to be a dependency of England, to be at war with our enemies, to be at peace with our allies, to be protected by the English navy from maritime aggression, to have a portion of the English army mixed with its sepoys, it plainly follows that the King, to whom the Constitution gives the direction of foreign affairs, and the command of the military and naval forces, ought to have a share in the direction of the Indian government. Yet, on the other hand, that a revenue of twenty millions a year, an army of two hundred thousand men, a civil service abounding with lucrative situations, should be left to the disposal of the Crown without any check whatever, is what no minister, I conceive, would venture to propose. This House is indeed the check provided by the Constitution on the abuse of the royal prerogative. But that this House is, or is likely ever to be, an efficient check on abuses practised in India, I altogether deny. We have, as I believe we all feel, quite business enough. If we were to undertake the task of looking into Indian affairs as we look into British affairs, if we were to have Indian budgets and Indian estimates, if we were to go into the Indian currency question and the Indian Bank Charter, if to our disputes about Belgium and Holland, Don Pedro and Don Miguel, were to be added disputes about the debts of the Guicowar and the disorders of Mysore, the ex-king of the Afghans and the Maharajah Runjeet Sing; if we were to have one night occupied by the embezzlements of the Benares mint, and another by the panic in the Calcutta money market; if the questions of Suttee or no Suttee, Pilgrim tax or no Pilgrim tax, Ryotwary or Zemindary, half Batta or whole Batta, were to be debated at the same length at which we have debated Church reform and the assessed taxes, twenty-four hours a day and three hundred and sixty-five days a year would be too short a time for the discharge of our duties. The House, it is plain, has not the necessary time to settle these matters; nor has it the necessary knowledge; nor has it the motives to acquire that knowledge. The late change in its constitution has made it, I believe, a much more faithful representative of the English people. But it is as far as ever from being a representative of the Indian people. A broken head in Cold Bath Fields produces a greater sensation among us than three pitched battles in India. A few weeks ago we had to decide on a claim brought by an individual against the revenues of India. If it had been an English question the walls would scarcely have held the Members who would have flocked to the division. It was an Indian question; and we could scarcely, by dint of supplication, make a House. Even when my right honourable friend, the President of the Board of Control, gave his able and interesting explanation of the plan which he intended to propose for the government of a hundred millions of human beings, the attendance was not so large as I have often seen it on a turnpike bill or a railroad bill.

I then take these things as proved, that the Crown must have a certain authority over India, that there must be an efficient check on the authority of the Crown, and that the House of Commons cannot be that efficient check. We must then find some other body to perform that important office. We have such a body, the Company. Shall we discard it?

It is true that the power of the Company is an anomaly in politics. It is strange, very strange, that a joint-stock society of traders, a society, the shares of which are daily passed from hand to hand, a society, the component parts of which are perpetually changing, a society, which, judging a priori from its constitution, we should have said was as little fitted for imperial functions as the Merchant Tailors' Company or the New River Company, should be intrusted with the sovereignty of a larger population, the disposal of a larger clear revenue, the command of a larger army, than are under the direct management of the Executive Government of the United Kingdom. But what constitution can we give to our Indian Empire which shall not be strange, which shall not be anomalous? That Empire is itself the strangest of all political anomalies. That a handful of adventurers from an island in the Atlantic should have subjugated a vast country divided from the place of their birth by half the globe; a country which at no very distant period was merely the subject of fable to the nations of Europe; a country never before violated by the most renowned of Western conquerors; a country which Trajan never entered; a country lying beyond the point where the phalanx of Alexander refused to proceed; that we should govern a territory ten thousand miles from us, a territory larger and more populous than France, Spain, Italy, and Germany put together, a territory, the present clear revenue of which exceeds the present clear revenue of any state in the world, France excepted; a territory inhabited by men differing from us in race, colour, language, manners, morals, religion; these are prodigies to which the world has seen nothing similar. Reason is confounded. We interrogate the past in vain. General rules are useless where the whole is one vast exception. The Company is an anomaly; but it is part of a system where every thing is anomaly. It is the strangest of all governments; but it is designed for the strangest of all empires.

If we discard the Company, we must find a substitute: and, take what substitute we may, we shall find ourselves unable to give any reason for believing that the body which we have put in the room of the Company is likely to acquit itself of its duties better than the Company. Commissioners appointed by the King during pleasure would be no check on the Crown; Commissioners appointed by the King or by Parliament for life would always be appointed by the political party which might be uppermost, and if a change of administration took place, would harass the new Government with the most vexatious opposition. The plan suggested by the right honourable Gentleman, the Member for Montgomeryshire [Mr Charles Wynn], is I think the very worst that I have ever heard. He would have Directors nominated every four years by the Crown. Is it not plain that these Directors would always be appointed from among the supporters of the Ministry for the time being; that their situations would depend on the permanence of that Ministry; that therefore all their power and patronage would be employed for the purpose of propping that Ministry, and, in case of a change, for the purpose of molesting those who might succeed to power; that they would be subservient while their friends were in, and factious when their friends were out? How would Lord Grey's Ministry have been situated if the whole body of Directors had been nominated by the Duke of Wellington in 1830. I mean no imputation on the Duke of Wellington. If the present ministers had to nominate Directors for four years, they would, I have no doubt, nominate men who would give no small trouble to the Duke of Wellington if he were to return to office. What we want is a body independent of the Government, and no more than independent; not a tool of the Treasury, not a tool of the opposition. No new plan which I have heard proposed would give us such a body. The Company, strange as its constitution may be, is such a body. It is, as a corporation, neither Whig nor Tory, neither high-church nor low-church. It cannot be charged with having been for or against the Catholic Bill, for or against the Reform Bill. It has constantly acted with a view not to English politics, but to Indian politics. We have seen the country convulsed by faction. We have seen Ministers driven from office by this House, Parliament dissolved in anger, general elections of unprecedented turbulence, debates of unprecedented interest. We have seen the two branches of the Legislature placed in direct opposition to each other. We have seen the advisers of the Crown dismissed one day, and brought back the next day on the shoulders of the people. And amidst all these agitating events the Company has preserved strict and unsuspected neutrality. This is, I think an inestimable advantage, and it is an advantage which we must altogether forego, if we consent to adopt any of the schemes which I have heard proposed on the other side of the House.

We must judge of the Indian government, as of all other governments, by its practical effects. According to the honourable Member for Sheffield, India is ill governed; and the whole fault is with the Company. Innumerable accusations, great and small, are brought by him against the Directors. They are fond of war: they are fond of dominion: the taxation is burthensome: the laws are undigested: the roads are rough: the post goes on foot: and for everything the Company is answerable. From the dethronement of the Mogul princes to the mishaps of [[W: Charles Metcalfe, 1st Baron Metcalfe|Sir Charles Metcalfe's]] courier, every disaster that has taken place in the East during sixty years is laid to the charge of this Corporation. And the inference is, that all the power which they possess ought to be taken out of their hands, and transferred at once to the Crown.

Now, Sir, it seems to me that, for all the evils which the honourable Gentleman has so pathetically recounted, the Ministers of the Crown are as much to blame as the Company; nay, much more so: for the Board of Control could, without the consent of the Directors, have redressed those evils; and the Directors most certainly could not have redressed them without the consent of the Board of Control. Take the case of that frightful grievance which seems to have made the deepest impression on the mind of the honourable Gentleman, the slowness of the mail. Why, Sir, if my right honourable friend, the President of our Board thought fit, he might direct me to write to the Court and require them to frame a dispatch on that subject. If the Court disobeyed, he might himself frame a dispatch ordering Lord William Bentinck to put the dawks all over Bengal on horseback. If the Court refused to send out this dispatch, the Board could apply to the King's Bench for a mandamus. If, on the other hand, the Directors wished to accelerate the journeys of the mail, and the Board were adverse to the project, the Directors could do nothing at all. For all measures of internal policy the servants of the King are at least as deeply responsible as the Company. For all measures of foreign policy the servants of the King, and they alone are responsible. I was surprised to hear the honourable Gentleman accuse the Directors of insatiable ambition and rapacity, when he must know that no act of aggression on any native state can be committed by the Company without the sanction of the Board, and that, in fact, the Board has repeatedly approved of warlike measures which were strenuously opposed by the Company. He must know, in particular, that, during the energetic and splendid administration of the Marquess of Wellesley, the company was all for peace, and the Board all for conquest. If a line of conduct which the honourable Gentleman thinks unjustifiable has been followed by the Ministers of the Crown in spite of the remonstrances of the Directors, this is surely a strange reason for turning off the Directors, and giving the whole power unchecked to the Crown.

The honourable Member tells us that India, under the present system, is not so rich and flourishing as she was two hundred years ago. Really, Sir, I doubt whether we are in possession of sufficient data to enable us to form a judgment on that point. But the matter is of little importance. We ought to compare India under our government, not with India under Acbar and his immediate successors, but with India as we found it. The calamities through which that country passed during the interval between the fall of the Mogul power and the establishment of the English supremacy were sufficient to throw the people back whole centuries. It would surely be unjust to say, that Alfred was a bad king because Britain, under his government, was not so rich or so civilised as in the time of the Romans.

In what state, then, did we find India? And what have we made India? We found society throughout that vast country in a state to which history scarcely furnishes a parallel. The nearest parallel would, perhaps, be the state of Europe during the fifth century. The Mogul empire in the time of the successors of Aurungzebe, like the Roman empire in the time of the successors of Theodosius, was sinking under the vices of a bad internal administration, and under the assaults of barbarous invaders. At Delhi, as at Ravenna, there was a mock sovereign, immured in a gorgeous state prison. He was suffered to indulge in every sensual pleasure. He was adored with servile prostrations. He assumed and bestowed the most magnificent titles. But, in fact, he was a mere puppet in the hands of some ambitious subject. While the Honorii and Augustuli of the East, surrounded by their fawning eunuchs, reveled and dozed without knowing or caring what might pass beyond the walls of their palace gardens, the provinces had ceased to respect a government which could neither punish nor protect them. Society was a chaos. Its restless and shifting elements formed themselves every moment into some new combination, which the next moment dissolved. In the course of a single generation a hundred dynasties grew up, flourished, decayed, were extinguished, were forgotten. Every adventurer who could muster a troop of horse might aspire to a throne. Every palace was every year the scene of conspiracies, treasons, revolutions, parricides. Meanwhile a rapid succession of Alarics and Attilas passed over the defenceless empire. A Persian invader penetrated to Delhi, and carried back in triumph the most precious treasures of the House of Tamerlane. The Afghan soon followed by the same track, to glean whatever the Persian had spared. The Jauts established themselves on the Jumna. The Seiks devastated Lahore. Every part of India, from Tanjore to the Himalayas, was laid under contribution by the Mahrattas. The people were ground down to the dust by the oppressor without and the oppressor within, by the robber from whom the Nabob was unable to protect them, by the Nabob who took whatever the robber had left to them. All the evils of despotism, and all the evils of anarchy, pressed at once on that miserable race. They knew nothing of government but its exactions. Desolation was in their imperial cities, and famine all along the banks of their broad and redundant rivers. It seemed that a few more years would suffice to efface all traces of the opulence and civilisation of an earlier age.

Such was the state of India when the Company began to take part in the disputes of its ephemeral sovereigns. About eighty years have elapsed since we appeared as auxiliaries in a contest between two rival families for the sovereignty of a small corner of the Peninsula. From that moment commenced a great, a stupendous process, the reconstruction of a decomposed society. Two generations have passed away; and the process is complete. The scattered fragments of the empire of Aurungzebe have been united in an empire stronger and more closely knit together than that which Aurungzebe ruled. The power of the new sovereigns penetrates their dominions more completely, and is far more implicitly obeyed, than was that of the proudest princes of the Mogul dynasty.

It is true that the early history of this great revolution is chequered with guilt and shame. It is true that the founders of our Indian Empire too often abused the strength which they derived from superior energy and superior knowledge. It is true that, with some of the highest qualities of the race from which they sprang, they combined some of the worst defects of the race over which they ruled. How should it have been otherwise? Born in humble stations, accustomed to earn a slender maintenance by obscure industry, they found themselves transformed in a few months from clerks drudging over desks, or captains in marching regiments, into statesmen and generals, with armies at their command, with the revenues of kingdoms at their disposal, with power to make and depose sovereigns at their pleasure. They were what it was natural that men should be who had been raised by so rapid an ascent to so dizzy an eminence, profuse and rapacious, imperious and corrupt.

It is true, then, that there was too much foundation for the representations of those satirists and dramatists who held up the character of the English Nabob to the derision and hatred of a former generation. It is true that some disgraceful intrigues, some unjust and cruel wars, some instances of odious perfidy and avarice, stain the annals of our Eastern Empire. It is true that the duties of government and legislation were long wholly neglected or carelessly performed. It is true that when the conquerors at length began to apply themselves in earnest to the discharge of their high functions, they committed the errors natural to rulers who were but imperfectly acquainted with the language and manners of their subjects. It is true that some plans, which were dictated by the purest and most benevolent feelings, have not been attended by the desired success. It is true that India suffers to this day from a heavy burden of taxation and from a defective system of law. It is true, I fear, that in those states which are connected with us by subsidiary alliance, all the evils of oriental despotism have too frequently shown themselves in their most loathsome and destructive form.

All this is true. Yet in the history and in the present state of our Indian Empire I see ample reason for exultation and for a good hope.

I see that we have established order where we found confusion. I see that the petty dynasties which were generated by the corruption of the great Mahometan Empire, and which, a century ago, kept all India in constant agitation, have been quelled by one overwhelming power. I see that the predatory tribes, which, in the middle of the last century, passed annually over the harvests of India with the destructive rapidity of a hurricane, have quailed before the valour of a braver and sterner race, have been vanquished, scattered, hunted to their strongholds, and either extirpated by the English sword, or compelled to exchange the pursuits of rapine for those of industry.

I look back for many years; and I see scarcely a trace of the vices which blemished the splendid fame of the first conquerors of Bengal. I see peace studiously preserved. I see faith inviolably maintained towards feeble and dependent states. I see confidence gradually infused into the minds of suspicious neighbours. I see the horrors of war mitigated by the chivalrous and Christian spirit of Europe. I see examples of moderation and clemency, such as I should seek in vain in the annals of any other victorious and dominant nation. I see captive tyrants, whose treachery and cruelty might have excused a severe retribution, living in security, comfort, and dignity, under the protection of the government which they laboured to destroy.

I see a large body of civil and military functionaries resembling in nothing but capacity and valour those adventurers who, seventy years ago, came hither, laden with wealth and infamy, to parade before our fathers the plundered treasures of Bengal and Tanjore. I reflect with pride that to the doubtful splendour which surrounds the memory of Hastings and of Clive, we can oppose the spotless glory of Elphinstone and Munro. I contemplate with reverence and delight the honourable poverty which is the evidence of rectitude firmly maintained amidst strong temptations. I rejoice to see my countrymen, after ruling millions of subjects, after commanding victorious armies, after dictating terms of peace at the gates of hostile capitals, after administering the revenues of great provinces, after judging the causes of wealthy Zemindars, after residing at the courts of tributary Kings, return to their native land with no more than a decent competence.

I see a government anxiously bent on the public good. Even in its errors I recognise a paternal feeling towards the great people committed to its charge. I see toleration strictly maintained: yet I see bloody and degrading superstitions gradually losing their power. I see the morality, the philosophy, the taste of Europe, beginning to produce a salutary effect on the hearts and understandings of our subjects. I see the public mind of India, that public mind which we found debased and contracted by the worst forms of political and religious tyranny, expanding itself to just and noble views of the ends of government and of the social duties of man.

I see evils: but I see the government actively employed in the work of remedying those evils. The taxation is heavy; but the work of retrenchment is unsparingly pursued. The mischiefs arising from the system of subsidiary alliance are great: but the rulers of India are fully aware of those mischiefs, and are engaged in guarding against them. Wherever they now interfere for the purpose of supporting a native government, they interfere also for the purpose of reforming it.

Seeing these things, then, am I prepared to discard the Company as an organ of government? I am not. Assuredly I will never shrink from innovation where I see reason to believe that innovation will be improvement. That the present Government does not shrink from innovations which it considers as improvements the bill now before the House sufficiently shows. But surely the burden of the proof lies on the innovators. They are bound to show that there is a fair probability of obtaining some advantage before they call upon us to take up the foundations of the Indian government. I have no superstitious veneration for the Court of Directors or the Court of Proprietors. Find me a better Council: find me a better constituent body: and I am ready for a change. But of all the substitutes for the Company which have hitherto been suggested, not one has been proved to be better than the Company; and most of them I could, I think, easily prove to be worse. Circumstances might force us to hazard a change. If the Company were to refuse to accept of the government unless we would grant pecuniary terms which I thought extravagant, or unless we gave up the clauses in this bill which permit Europeans to hold landed property and natives to hold office, I would take them at their word. But I will not discard them in the mere rage of experiment.

Do I call the government of India a perfect government? Very far from it. No nation can be perfectly well governed till it is competent to govern itself. I compare the Indian government with other governments of the same class, with despotisms, with military despotisms, with foreign military despotisms; and I find none that approaches it in excellence. I compare it with the government of the Roman provinces, with the government of the Spanish colonies; and I am proud of my country and my age. Here are a hundred millions of people under the absolute rule of a few strangers, differing from them physically, differing from them morally, mere Mamelukes, not born in the country which they rule, not meaning to lay their bones in it. If you require me to make this government as good as that of England, France, or the United States of America, I own frankly that I can do no such thing. Reasoning a priori, I should have come to the conclusion that such a government must be a horrible tyranny. It is a source of constant amazement to me that it is so good as I find it to be. I will not, therefore, in a case in which I have neither principles nor precedents to guide me, pull down the existing system on account of its theoretical defects. For I know that any system which I could put in its place would be equally condemned by theory, while it would not be equally sanctioned by experience.

Some change in the constitution of the Company was, as I have shown, rendered inevitable by the opening of the China Trade; and it was the duty of the Government to take care that the change should not be prejudicial to India. There were many ways in which the compromise between commerce and territory might have been effected. We might have taken the assets, and paid a sum down, leaving the Company to invest that sum as they chose. We might have offered English security with a lower interest. We might have taken the course which the late ministers designed to take. They would have left the Company in possession of the means of carrying on its trade in competition with private merchants. My firm belief is that, if this course had been taken, the Company must, in a very few years, have abandoned the trade, or the trade would have ruined the Company. It was not, however, solely or principally by regard for the interest of the Company, or of English merchants generally, that the Government was guided on this occasion. The course which appeared to us the most likely to promote the interests of our Eastern Empire was to make the proprietors of India stock creditors of the Indian territory. Their interest will thus be in a great measure the same with the interest of the people whom they are to rule. Their income will depend on the revenues of their empire. The revenues of their empire will depend on the manner in which the affairs of that empire are administered. We furnish them with the strongest motives to watch over the interests of the cultivator and the trader, to maintain peace, to carry on with vigour the work of retrenchment, to detect and punish extortion and corruption. Though they live at a distance from India, though few of them have ever seen or may ever see the people whom they rule, they will have a great stake in the happiness of their subjects. If their misgovernment should produce disorder in the finances, they will themselves feel the effects of that disorder in their own household expenses. I believe this to be, next to a representative constitution, the constitution which is the best security for good government. A representative constitution India cannot at present have. And we have therefore, I think, given her the best constitution of which she is capable.

One word as to the new arrangement which we propose with respect to the patronage. It is intended to introduce the principle of competition in the disposal of writerships; and from this change I cannot but anticipate the happiest results. The civil servants of the Company are undoubtedly a highly respectable body of men; and in that body, as in every large body, there are some persons of very eminent ability. I rejoice most cordially to see this. I rejoice to see that the standard of morality is so high in England, that intelligence is so generally diffused through England, that young persons who are taken from the mass of society, by favour and not by merit, and who are therefore only fair samples of the mass, should, when placed in situations of high importance, be so seldom found wanting. But it is not the less true that India is entitled to the service of the best talents which England can spare. That the average of intelligence and virtue is very high in this country is matter for honest exultation. But it is no reason for employing average men where you can obtain superior men. Consider too, Sir, how rapidly the public mind of India is advancing, how much attention is already paid by the higher classes of the natives to those intellectual pursuits on the cultivation of which the superiority of the European race to the rest of mankind principally depends. Surely, in such circumstances, from motives of selfish policy, if from no higher motive, we ought to fill the magistracies of our Eastern Empire with men who may do honour to their country, with men who may represent the best part of the English nation. This, Sir, is our object; and we believe that by the plan which is now proposed this object will be attained. It is proposed that for every vacancy in the civil service four candidates shall be named, and the best candidate selected by examination. We conceive that, under this system, the persons sent out will be young men above par, young men superior either in talents or in diligence to the mass. It is said, I know, that examinations in Latin, in Greek, and in mathematics, are no tests of what men will prove to be in life. I am perfectly aware that they are not infallible tests: but that they are tests I confidently maintain. Look at every walk of life, at this House, at the other House, at the Bar, at the Bench, at the Church, and see whether it be not true that those who attain high distinction in the world were generally men who were distinguished in their academic career. Indeed, Sir, this objection would prove far too much even for those who use it. It would prove that there is no use at all in education. Why should we put boys out of their way? Why should we force a lad, who would much rather fly a kite or trundle a hoop, to learn his Latin Grammar? Why should we keep a young man to his Thucydides or his Laplace, when he would much rather be shooting? Education would be mere useless torture, if, at two or three and twenty, a man who had neglected his studies were exactly on a par with a man who had applied himself to them, exactly as likely to perform all the offices of public life with credit to himself and with advantage to society. Whether the English system of education be good or bad is not now the question. Perhaps I may think that too much time is given to the ancient languages and to the abstract sciences. But what then? Whatever be the languages, whatever be the sciences, which it is, in any age or country, the fashion to teach, the persons who become the greatest proficients in those languages and those sciences will generally be the flower of the youth, the most acute, the most industrious, the most ambitious of honourable distinctions. If the Ptolemaic system were taught at Cambridge instead of the Newtonian, the senior wrangler would nevertheless be in general a superior man to the wooden spoon. If, instead of learning Greek, we learned the Cherokee, the man who understood the Cherokee best, who made the most correct and melodious Cherokee verses, who comprehended most accurately the effect of the Cherokee particles, would generally be a superior man to him who was destitute of these accomplishments. If astrology were taught at our Universities, the young man who cast nativities best would generally turn out a superior man. If alchymy were taught, the young man who showed most activity in the pursuit of the philosopher's stone would generally turn out a superior man.

I will only add one other observation on this subject. Although I am inclined to think that too exclusive an attention is paid in the education of young English gentlemen to the dead languages, I conceive that when you are choosing men to fill situations for which the very first and most indispensable qualification is familiarity with foreign languages, it would be difficult to find a better test of their fitness than their classical acquirements.

Some persons have expressed doubts as to the possibility of procuring fair examinations. I am quite sure that no person who has been either at Cambridge or at Oxford can entertain such doubts. I feel, indeed, that I ought to apologise for even noticing an objection so frivolous.

Next to the opening of the China trade, Sir, the change most eagerly demanded by the English people was, that the restrictions on the admission of Europeans to India should be removed. In this change there are undoubtedly very great advantages. The chief advantage is, I think, the improvement which the minds of our native subjects may be expected to derive from free intercourse with a people far advanced beyond themselves in intellectual cultivation. I cannot deny, however, that the advantages are attended with some danger.

The danger is that the new comers, belonging to the ruling nation, resembling in colour, in language, in manners, those who hold supreme military and political power, and differing in all these respects from the great mass of the population, may consider themselves as a superior class, and may trample on the indigenous race. Hitherto there have been strong restraints on Europeans resident in India. Licences were not easily obtained. Those residents who were in the service of the Company had obvious motives for conducting themselves with propriety. If they incurred the serious displeasure of the Government, their hopes of promotion were blighted. Even those who were not in the public service were subject to the formidable power which the Government possessed of banishing them at its pleasure.

The license of the Government will now no longer be necessary to persons who desire to reside in the settled provinces of India. The power of arbitrary deportation is withdrawn. Unless, therefore, we mean to leave the natives exposed to the tyranny and insolence of every profligate adventurer who may visit the East, we must place the European under the same power which legislates for the Hindoo. No man loves political freedom more than I. But a privilege enjoyed by a few individuals, in the midst of a vast population who do not enjoy it, ought not to be called freedom. It is tyranny. In the West Indies I have not the least doubt that the existence of the Trial by Jury and of Legislative Assemblies has tended to make the condition of the slaves worse than it would otherwise have been. Or, to go to India itself for an instance, though I fully believe that a mild penal code is better than a severe penal code, the worst of all systems was surely that of having a mild code for the Brahmins, who sprang from the head of the Creator, while there was a severe code for the Sudras, who sprang from his feet. India has suffered enough already from the distinction of castes, and from the deeply rooted prejudices which that distinction has engendered. God forbid that we should inflict on her the curse of a new caste, that we should send her a new breed of Brahmins, authorised to treat all the native population as Parias!

With a view to the prevention of this evil, we propose to give to the Supreme Government the power of legislating for Europeans as well as for natives. We propose that the regulations of the Government shall bind the King's Court as they bind all other courts, and that registration by the Judges of the King's Courts shall no longer be necessary to give validity to those regulations within the towns of Calcutta, Madras, and Bombay.

I could scarcely, Sir, believe my ears when I heard this part of our plan condemned in another place. I should have thought that it would have been received with peculiar favour in that quarter where it has met with the most severe condemnation. What, at present, is the case? If the Supreme Court and the Government differ on a question of jurisdiction, or on a question of legislation within the towns which are the seats of Government, there is absolutely no umpire but the Imperial Parliament. The device of putting one wild elephant between two tame elephants was ingenious: but it may not always be practicable. Suppose a tame elephant between two wild elephants, or suppose that the whole herd should run wild together. The thing is not without example. And is it not most unjust and ridiculous that, on one side of a ditch, the edict of the Governor General should have the force of law, and that on the other side it should be of no effect unless registered by the Judges of the Supreme Court? If the registration be a security for good legislation, we are bound to give that security to all classes of our subjects. If the registration be not a security for good legislation, why give it to any? Is the system good? Extend it. Is it bad! Abolish it. But in the name of common sense do not leave it as it is. It is as absurd as our old law of sanctuary. The law which authorises imprisonment for debt may be good or bad. But no man in his senses can approve of the ancient system under which a debtor who might be arrested in Fleet Street was safe as soon as he had scampered into Whitefriars. Just in the same way, doubts may fairly be entertained about the expediency of allowing four or five persons to make laws for India; but to allow them to make laws for all India without the Mahratta ditch, and to except Calcutta, is the height of absurdity.

I say, therefore, that either you must enlarge the power of the Supreme Court, and give it a general veto on laws, or you must enlarge the power of the Government, and make its regulations binding on all Courts without distinction. The former course no person has ventured to propose. To the latter course objections have been made; but objections which to me, I must own, seem altogether frivolous.

It is acknowledged that of late years inconvenience has arisen from the relation in which the Supreme Court stands to the Government. But, it is said, that Court was originally instituted for the protection of natives against Europeans. The wise course would therefore be to restore its original character.

Now, Sir, the fact is, that the Supreme Court has never been so mischievous as during the first ten years of its power, or so respectable as it has lately been. Everybody who knows anything of its early history knows, that, during a considerable time, it was the terror of Bengal, the scourge of the native population, the screen of European delinquents, a convenient tool of the Government for all purposes of evil, an insurmountable obstacle to the Government in all undertakings for the public good; that its proceedings were made up of pedantry, cruelty, and corruption; that its disputes with the Government were at one time on the point of breaking up the whole fabric of society; and that a convulsion was averted only by the dexterous policy of Warren Hastings, who at last bought off the opposition of the Chief Justice for eight thousand pounds a year. It is notorious that, while the Supreme Court opposed Hastings in all his best measures, it was a thoroughgoing accomplice in his worst; that it took part in the most scandalous of those proceedings which, fifty years ago, roused the indignation of Parliament and of the country; that it assisted in the spoliation of the princesses of Oude; that it passed sentence of death on Nuncomar. And this is the Court which we are to restore from its present state of degeneracy to its original purity. This is the protection which we are to give to the natives against the Europeans. Sir, so far is it from being true that the character of the Supreme Court has deteriorated, that it has, perhaps, improved more than any other institution in India. But the evil lies deep in the nature of the institution itself. The judges have in our time deserved the greatest respect. Their judgment and integrity have done much to mitigate the vices of the system. The worst charge that can be brought against any of them is that of pertinacity, disinterested, conscientious pertinacity, in error. The real evil is the state of the law. You have two supreme powers in India. There is no arbitrator except a Legislature fifteen thousand miles off. Such a system is on the face of it an absurdity in politics. My wonder is, not that this system has several times been on the point of producing fatal consequences to the peace and resources of India;--those, I think, are the words in which Warren Hastings described the effect of the contest between his Government and the Judges;--but that it has not actually produced such consequences. The most distinguished members of the Indian Government, the most distinguished Judges of the Supreme Court, call upon you to reform this system. Sir Charles Metcalfe, Sir Charles Grey, represent with equal urgency the expediency of having one single paramount council armed with legislative power. The admission of Europeans to India renders it absolutely necessary not to delay our decision. The effect of that admission would be to raise a hundred questions, to produce a hundred contests between the Council and the judicature. The Government would be paralysed at the precise moment at which all its energy was required. While the two equal powers were acting in opposite directions, the whole machine of the state would stand still. The Europeans would be uncontrolled. The natives would be unprotected. The consequences I will not pretend to foresee. Everything beyond is darkness and confusion.

Having given to the Government supreme legislative power, we next propose to give to it for a time the assistance of a commission for the purpose of digesting and reforming the laws of India, so that those laws may, as soon as possible, be formed into a Code. Gentlemen of whom I wish to speak with the highest respect have expressed a doubt whether India be at present in a fit state to receive a benefit which is not yet enjoyed by this free and highly civilised country. Sir, I can allow to this argument very little weight beyond that which it derives from the personal authority of those who use it. For, in the first place, our freedom and our high civilisation make this improvement, desirable as it must always be, less indispensably necessary to us than to our Indian subjects; and in the next place, our freedom and civilisation, I fear, make it far more difficult for us to obtain this benefit for ourselves than to bestow it on them.

I believe that no country ever stood so much in need of a code of laws as India; and I believe also that there never was a country in which the want might so easily be supplied. I said that there were many points of analogy between the state of that country after the fall of the Mogul power, and the state of Europe after the fall of the Roman empire. In one respect the analogy is very striking. As there were in Europe then, so there are in India now, several systems of law widely differing from each other, but coexisting and coequal. The indigenous population has its own laws. Each of the successive races of conquerors has brought with it its own peculiar jurisprudence: the Mussulman his Koran and the innumerable commentators on the Koran; the Englishman his Statute Book and his Term Reports. As there were established in Italy, at one and the same time, the Roman Law, the Lombard law, the Ripuarian law, the Bavarian law, and the Salic law, so we have now in our Eastern empire Hindoo law, Mahometan law, Parsee law, English law, perpetually mingling with each other and disturbing each other, varying with the person, varying with the place. In one and the same cause the process and pleadings are in the fashion of one nation, the judgment is according to the laws of another. An issue is evolved according to the rules of Westminster, and decided according to those of Benares. The only Mahometan book in the nature of a code is the Koran; the only Hindoo book, the Institutes. Everybody who knows those books knows that they provide for a very small part of the cases which must arise in every community. All beyond them is comment and tradition. Our regulations in civil matters do not define rights, but merely establish remedies. If a point of Hindoo law arises, the Judge calls on the Pundit for an opinion. If a point of Mahometan law arises, the Judge applies to the Cauzee. What the integrity of these functionaries is, we may learn from Sir William Jones. That eminent man declared that he could not answer it to his conscience to decide any point of law on the faith of a Hindoo expositor. Sir Thomas Strange confirms this declaration. Even if there were no suspicion of corruption on the part of the interpreters of the law, the science which they profess is in such a state of confusion that no reliance can be placed on their answers. Sir Francis Macnaghten tells us, that it is a delusion to fancy that there is any known and fixed law under which the Hindoo people live; that texts may be produced on any side of any question; that expositors equal in authority perpetually contradict each other: that the obsolete law is perpetually confounded with the law actually in force; and that the first lesson to be impressed on a functionary who has to administer Hindoo law is that it is vain to think of extracting certainty from the books of the jurist. The consequence is that in practice the decisions of the tribunals are altogether arbitrary. What is administered is not law, but a kind of rude and capricious equity. I asked an able and excellent judge lately returned from India how one of our Zillah Courts would decide several legal questions of great importance, questions not involving considerations of religion or of caste, mere questions of commercial law. He told me that it was a mere lottery. He knew how he should himself decide them. But he knew nothing more. I asked a most distinguished civil servant of the Company, with reference to the clause in this Bill on the subject of slavery, whether at present, if a dancing girl ran away from her master, the judge would force her to go back. "Some judges," he said, "send a girl back. Others set her at liberty. The whole is a mere matter of chance. Everything depends on the temper of the individual judge."

Even in this country we have had complaints of judge-made law; even in this country, where the standard of morality is higher than in almost any other part of the world; where, during several generations, not one depositary of our legal traditions has incurred the suspicion of personal corruption; where there are popular institutions; where every decision is watched by a shrewd and learned audience; where there is an intelligent and observant public; where every remarkable case is fully reported in a hundred newspapers; where, in short, there is everything which can mitigate the evils of such a system. But judge-made law, where there is an absolute government and a lax morality, where there is no bar and no public, is a curse and a scandal not to be endured. It is time that the magistrate should know what law he is to administer, that the subject should know under what law he is to live. We do not mean that all the people of India should live under the same law: far from it: there is not a word in the bill, there was not a word in my right honourable friend's speech, susceptible of such an interpretation. We know how desirable that object is; but we also know that it is unattainable. We know that respect must be paid to feelings generated by differences of religion, of nation, and of caste. Much, I am persuaded, may be done to assimilate the different systems of law without wounding those feelings. But, whether we assimilate those systems or not, let us ascertain them; let us digest them. We propose no rash innovation; we wish to give no shock to the prejudices of any part of our subjects. Our principle is simply this; uniformity where you can have it: diversity where you must have it; but in all cases certainty.

As I believe that India stands more in need of a code than any other country in the world, I believe also that there is no country on which that great benefit can more easily be conferred. A code is almost the only blessing, perhaps is the only blessing, which absolute governments are better fitted to confer on a nation than popular governments. The work of digesting a vast and artificial system of unwritten jurisprudence is far more easily performed, and far better performed, by few minds than by many, by a Napoleon than by a Chamber of Deputies and a Chamber of Peers, by a government like that of Prussia or Denmark than by a government like that of England. A quiet knot of two or three veteran jurists is an infinitely better machinery for such a purpose than a large popular assembly divided, as such assemblies almost always are, into adverse factions. This seems to me, therefore, to be precisely that point of time at which the advantage of a complete written code of laws may most easily be conferred on India. It is a work which cannot be well performed in an age of barbarism, which cannot without great difficulty be performed in an age of freedom. It is a work which especially belongs to a government like that of India, to an enlightened and paternal despotism.

I have detained the House so long, Sir, that I will defer what I had to say on some parts of this measure, important parts, indeed, but far less important, as I think, than those to which I have adverted, till we are in Committee. There is, however, one part of the bill on which, after what has recently passed elsewhere, I feel myself irresistibly impelled to say a few words. I allude to that wise, that benevolent, that noble clause which enacts that no native of our Indian empire shall, by reason of his colour, his descent, or his religion, be incapable of holding office. At the risk of being called by that nickname which is regarded as the most opprobrious of all nicknames by men of selfish hearts and contracted minds, at the risk of being called a philosopher, I must say that, to the last day of my life, I shall be proud of having been one of those who assisted in the framing of the bill which contains that clause. We are told that the time can never come when the natives of India can be admitted to high civil and military office. We are told that this is the condition on which we hold our power. We are told that we are bound to confer on our subjects every benefit--which they are capable of enjoying?--no;--which it is in our power to confer on them?--no;--but which we can confer on them without hazard to the perpetuity of our own domination. Against that proposition I solemnly protest as inconsistent alike with sound policy and sound morality.

I am far, very far, from wishing to proceed hastily in this most delicate matter. I feel that, for the good of India itself, the admission of natives to high office must be effected by slow degrees. But that, when the fulness of time is come, when the interest of India requires the change, we ought to refuse to make that change lest we should endanger our own power, this is a doctrine of which I cannot think without indignation. Governments, like men, may buy existence too dear. "Propter vitam vivendi perdere causas," is a despicable policy both in individuals and in states. In the present case, such a policy would be not only despicable, but absurd. The mere extent of empire is not necessarily an advantage. To many governments it has been cumbersome; to some it has been fatal. It will be allowed by every statesman of our time that the prosperity of a community is made up of the prosperity of those who compose the community, and that it is the most childish ambition to covet dominion which adds to no man's comfort or security. To the great trading nation, to the great manufacturing nation, no progress which any portion of the human race can make in knowledge, in taste for the conveniences of life, or in the wealth by which those conveniences are produced, can be matter of indifference. It is scarcely possible to calculate the benefits which we might derive from the diffusion of European civilisation among the vast population of the East. It would be, on the most selfish view of the case, far better for us that the people of India were well governed and independent of us, than ill governed and subject to us; that they were ruled by their own kings, but wearing our broadcloth, and working with our cutlery, than that they were performing their salams to English collectors and English magistrates, but were too ignorant to value, or too poor to buy, English manufactures. To trade with civilised men is infinitely more profitable than to govern savages. That would, indeed, be a doting wisdom, which, in order that India might remain a dependency, would make it an useless and costly dependency, which would keep a hundred millions of men from being our customers in order that they might continue to be our slaves.

It was, as Bernier tells us, the practice of the miserable tyrants whom he found in India, when they dreaded the capacity and spirit of some distinguished subject, and yet could not venture to murder him, to administer to him a daily dose of the pousta, a preparation of opium, the effect of which was in a few months to destroy all the bodily and mental powers of the wretch who was drugged with it, and to turn him into a helpless idiot. The detestable artifice, more horrible than assassination itself, was worthy of those who employed it. It is no model for the English nation. We shall never consent to administer the pousta to a whole community, to stupefy and paralyse a great people whom God has committed to our charge, for the wretched purpose of rendering them more amenable to our control. What is power worth if it is founded on vice, on ignorance, and on misery; if we can hold it only by violating the most sacred duties which as governors we owe to the governed, and which, as a people blessed with far more than an ordinary measure of political liberty and of intellectual light, we owe to a race debased by three thousand years of despotism and priestcraft? We are free, we are civilised, to little purpose, if we grudge to any portion of the human race an equal measure of freedom and civilisation.

Are we to keep the people of India ignorant in order that we may keep them submissive? Or do we think that we can give them knowledge without awakening ambition? Or do we mean to awaken ambition and to provide it with no legitimate vent? Who will answer any of these questions in the affirmative? Yet one of them must be answered in the affirmative, by every person who maintains that we ought permanently to exclude the natives from high office. I have no fears. The path of duty is plain before us: and it is also the path of wisdom, of national prosperity, of national honour.

The destinies of our Indian empire are covered with thick darkness. It is difficult to form any conjecture as to the fate reserved for a state which resembles no other in history, and which forms by itself a separate class of political phenomena. The laws which regulate its growth and its decay are still unknown to us. It may be that the public mind of India may expand under our system till it has outgrown that system; that by good government we may educate our subjects into a capacity for better government; that, having become instructed in European knowledge, they may, in some future age, demand European institutions. Whether such a day will ever come I know not. But never will I attempt to avert or to retard it. Whenever it comes, it will be the proudest day in English history. To have found a great people sunk in the lowest depths of slavery and superstition, to have so ruled them as to have made them desirous and capable of all the privileges of citizens, would indeed be a title to glory all our own. The sceptre may pass away from us. Unforeseen accidents may derange our most profound schemes of policy. Victory may be inconstant to our arms. But there are triumphs which are followed by no reverse. There is an empire exempt from all natural causes of decay. Those triumphs are the pacific triumphs of reason over barbarism; that empire is the imperishable empire of our arts and our morals, our literature and our laws.

And could I prove so insensible to every prompting of patriotic duty and affection, not only would you, fellow citizens, gathered many of you from distant States, who have come to take part in these pious offices of gratitude, you, respected fathers, brethren, matrons, sisters, who surround me, cry out for shame, but the forms of brave and patriotic men who fill these honored graves would heave with indignation beneath the sod.

We have assembled, friends, fellow citizens, at the invitation of the Executive of the great central State of Pennsylvania, seconded by the Governors of seventeen other loyal States of the Union, to pay the last tribute of respect to the brave men who, in the hard-fought battles of the first, second, and third days of July last, laid down their lives for the country on these hillsides and the plains before us, and whose remains have been gathered into the cemetery which we consecrate this day. As my eye ranges over the fields whose sods were so lately moistened by the blood of gallant and loyal men, I feel, as never before, how truly it was said of old that it is sweet and becoming to die for one's country. I feel, as never before, how justly, from the dawn of history to the present time, men have paid the homage of their gratitude and admiration to the memory of those who nobly sacrifice their lives, that their fellow-men may live in safety and in honor. And if this tribute were ever due, to whom could it be more justly paid than to those whose last resting-place we this day commend to the blessing of Heaven and of men?

For consider, my friends, what would have been the consequences to the country, to yourselves, and to all you hold dear, if those who sleep beneath our feet, and their gallant comrades who survive to serve their country on other fields of danger, had failed in their duty on those memorable days. Consider what, at this moment, would be the condition of the United States, if that noble Army of the Potomac, instead of gallantly and for the second time beating back the tide of invasion from Maryland and Pennsylvania, had been itself driven from these well-contested heights, thrown back in confusion on Baltimore, or trampled down, discomfited, scattered to the four winds. What, in that sad event, would not have been the fate of the Monumental City, of Harrisburg, of Philadelphia, of Washington, the Capital of the Union, each and every one of which would have lain at the mercy of the enemy, accordingly as it might have pleased him, spurred by passion, flushed with victory, and confident of continued success, to direct his course?

For this we must bear in mind, it is one of the great lessons of the war, indeed of every war, that it is impossible for a people without military organization, inhabiting the cities, towns, and villages of an open country, including of course the natural proportion of non-combatants of either sex and of every age, to withstand the inroad of a veteran army. What defence can be made by the inhabitants of villages mostly built of wood, of cities unprotected by walls, nay, by a population of men, however high-toned and resolute, whose aged parents demand their care, whose wives and children are clustering about them, against the charge of the war-horse whose neck is clothed with thunder, — against flying artillery and batteries of rifled cannon planted on every commanding eminence, — against the onset of trained veterans led by skilful chiefs? No, my friends, army must be met by army, battery by battery, squadron by squadron; and the shock of organized thousands must be encountered by the firm breasts and valiant arms of other thousands, as well organized and as skilfully led. It is no reproach, therefore, to the unarmed population of the country to say, that we owe it to the brave men who sleep in their beds of honor before us, and to their gallant surviving associates, not merely that your fertile fields, my friends of Pennsylvania and Maryland, were redeemed from the presence of the invader, but that your beautiful capitals were not given up to threatened plunder, perhaps laid in ashes, Washington seized by the enemy, and a blow struck at the heart of the nation.

Who that hears me has forgotten the thrill of joy that ran through the country on the Fourth of July, — auspicious day for the glorious tidings, and rendered still more so by the simultaneous fall of Vicksburg, — when the telegraph flashed through the land the assurance from the President of the United States that the Army of the Potomac, under General Meade, had again smitten the invader? Sure I am, that, with the ascriptions of praise that rose to Heaven from twenty millions of freemen, with the acknowledgments that breathed from patriotic lips throughout the length and breadth of America, to the surviving officers and men who had rendered the country this inestimable service, there beat in every loyal bosom a throb of tender and sorrowful gratitude to the martyrs who had fallen on the sternly contested field. Let a nation's fervent thanks make some amends for the toils and sufferings of those who survive. Would that the heartfelt tribute could penetrate these honored graves!

In order that we may comprehend, to their full extent, our obligations to the martyrs and surviving heroes of the Army of the Potomac, let us contemplate for a few moments the train of events which culminated in the battles of the first days of July. Of this stupendous rebellion, planned, as its originators boast, more than thirty years ago, matured and prepared for during an entire generation, finally commenced because, for the first time since the adoption of the Constituion, election of President had been effected without the votes of the South (which retained, however, the control of the two other branches of the government), the occupation of the national capital, with the seizure of the public archives and of the treaties with foreign powers, was an essential feature. This was in substance, within my personal knowledge, admitted, in the winter of 1860-61, by one of the most influential leaders of the rebellion; and it was fondly thought that this object could be effected by a bold and sudden movement on the 4th of March, 1861. There is abundant proof, also, that a darker project was contemplated, if not by the responsible chiefs of the rebellion, yet by nameless ruffians, willing to play a subsidiary and murderous part in the treasonable drama. It was accordingly maintained by the Rebel emissaries in England, in the circles to which they found access, that the new American Minister ought not, when he arrived, to be received as the envoy of the United States, inasmuch as before that time Washington would be captured, and the capital of the nation and the archives and muniments of the government would be in the possession of the Confederates. In full accordance also with this threat, it was declared by the Rebel Secretary of War, at Montgomery, in the presence of his Chief and of his colleagues, and of five thousand hearers, while the tidings of the assault on Sumter were travelling over the wires on that fatal 12th of April, 1861, that before the end of May "the flag which then flaunted the breeze," as he expressed it, "would float over the dome of the Capitol at Washington."

At the time this threat was made the rebellion was confined to the cotton-growing States, and it was well understood by them, that the only hope of drawing any of the other slaveholding States into the conspiracy was in bringing about a conflict of arms, and "firing the heart of the South" by the effusion of blood. This was declared by the Charleston press to be the object for which Sumter was to be assaulted; and the emissaries sent from Richmond, to urge on the unhallowed work, gave the promise, that, with the first drop of blood that should be shed, Virginia would place herself by the side of South Carolina.

In pursuance of this original plan of the leaders of the rebellion, the capture of Washington has been continually had in view, not merely for the sake of its public buildings, as the capital of the Confederacy, but as the necessary preliminary to the absorption of the Border States, and for the moral effect in the eyes of Europe of possessing the metropolis of the Union.

I allude to these facts, not perhaps enough borne in mind, as a sufficient refutation of the presence, on the part of the Rebels, that the war is one of self-defence, waged for the right of self-government. It is in reality a war originally levied by ambitious men in the cotton-growing States, for the purpose of drawing the slaveholding Border States into the vortex of the conspiracy, first by sympathy, — which in the case of Southeastern Virginia, North Carolina, part of Tennessee, and Arkansas succeeded, — and then by force, and for the purpose of subjugating Maryland, Western Virginia, Kentucky, Eastern Tennessee, and Missouri; and it is a most extraordinary fact, considering the clamors of the Rebel chiefs on the subject of invasion, that not a soldier of the United States has entered the States last named, except to defend their Union-loving inhabitants from the armies and guerillas of the Rebels.

In conformity with these designs on the city of Washington, and notwithstanding the disastrous results of the invasion of 1862, it was determined by the Rebel government last summer to resume the offensive in that direction. Unable to force the passage of the Rappahannock where General Hooker, notwithstanding the reverse at Chancellorsville in May, was strongly posted, the Confederate general resorted to strategy. He had two objects in view. The first was, by a rapid movement northward, and by manœuvring with a portion of his army on the east side of the Blue Ridge, to tempt Hooker from his base of operations, thus leading him to uncover the approaches to Washington, to throw it open to a raid by Stuart's cavalry, and to enable Lee himself to cross the Potomac in the neighborhood of Poolesville and thus fall upon the capital. This plan of operations was wholly frustrated. The design of the Rebel general was promptly discovered by General Hooker, and, moving with great rapidity from Fredericksburg, he preserved unbroken the inner line, and stationed the various corps of his army at all the points protecting the approach to Washington, from Centreville up to Leesburg. From this vantage-ground the Rebel general in vain attempted to draw him. In the mean time, by the vigorous operations of Pleasonton's cavalry, the cavalry of Stuart, though greatly superior in numbers, was so crippled as to be disabled from performing the part assigned it in the campaign. In this manner General Lee's first object, namely, the defeat of Hooker's army on the south of the Potomac, and a direct march on Washington, was baffled.

The second part of the Confederate plan, which is supposed to have been undertaken in opposition to the views of General Lee, was to turn the demonstration northward into a real invasion of Maryland and Pennsylvania, in the hope that, in this way, General Hooker would be drawn to a distance from the capital, and that some opportunity would occur of taking him at disadvantage, and, after defeating his army, of making a descent upon Baltimore and Washington. This part of General Lee's plan, which was substantially the repetition of that of 1862, was not less signally defeated, with what honor to the arms of the Union the heights on which we are this day assembled will forever attest.

Much time had been uselessly consumed by the Rebel general in his unavailing attempts to out-manœuvre General Hooker. Although General Lee broke up from Fredericksburg on the 3d of June, it was not till the 24th that the main body of his army entered Maryland. Instead of crossing the Potomac, as he had intended, east of the Blue Ridge, he was compelled to do it at Shepherdstown and Williamsport, thus materially deranging his entire plan of campaign north of the river. Stuart, who had been sent with his cavalry to the east of the Blue Ridge, to guard the passes of the mountains, to mask the movements of Lee, and to harass the Union general in crossing the river, having been very severely handled by Pleasonton at Beverly Ford, Aldie, and Upperville, instead of being able to retard General Hooker's advance, was driven himself away from his connection with the army of Lee, and cut off for a fortnight from all communication with it, — a circumstance to which General Lee, in his report, alludes more than once, with evident displeasure. Let us now rapidly glance at the incidents of the eventful campaign.

A detachment from Ewell's corps, under Jenkins, had penetrated, on the 15th of June, as far as Chambersburg. This movement was intended at first merely as a demonstration, and as a marauding expedition for supplies. It had, however, the salutary effect of alarming the country; and vigorous preparations were made, not only by the General Government, but here in Pennsylvania and in the sister States, to repel the inroad. After two days passed at Chambersburg, Jenkins, anxious for his communications with Ewell, fell back with his plunder to Hagerstown. Here he remained for several days, and then, having swept the recesses of the Cumberland valley, came down upon the eastern flank of the South Mountain, and pushed his marauding parties as far as Waynesboro. On the 22d the remainder of Ewell's corps crossed the river and moved up the valley. They were followed on the 24th by Longstreet and Hill, who crossed at Williamsport and Shepherdstown, and, pushing up the valley, encamped at Chambersburg on the 27th. In this way the whole Rebel army, estimated at 90,000 infantry, upwards of 10,000 cavalry, and 4,000 or 5,000 artillery, making a total of 105,000 of all arms, was concentrated in Pennsylvania.

Up to this time no report of Hooker's movements had been received by General Lee, who, having been deprived of his cavalry, had no means of obtaining information. Rightly judging, however, that no time would be lost by the Union army in the pursuit, in order to detain it on the eastern side of the mountains in Maryland and Pennsylvania, and thus preserve his communications by the way of Williamsport, he had, before his own arrival at Chambersburg, directed Ewell to send detachments from his corps to Carlisle and York[.] The latter detachment, under Early, passed through this place on the 26th of June. You need not, fellow-citizens of Gettysburg, that I should recall to you those moments of alarm and distress, precursors as they were of the more trying scenes which were so soon to follow.

As soon as General Hooker perceived that the advance of the Confederates into the Cumberland valley was not a mere feint to draw him away from Washington, he moved rapidly in pursuit. Attempts, as we have seen, were made to harass and retard his passage across the Potomac. These attempts were not only altogether unsuccessful, but were so unskilfully made as to place the entire Federal army between the cavalry of Stuart and the army of Lee. While the latter was massed in the Cumberland valley, Stuart was east of the mountains, with Hooker's army between, and Gregg's cavalry in close pursuit. Stuart was accordingly compelled to force a march northward, which was destitute of strategical character, and which deprived his chief of all means of obtaining intelligence.

Not a moment had been lost by General Hooker in the pursuit of Lee. The day after the Rebel army entered Maryland the Union army crossed the Potomac at Edwards' Ferry, and by the 28th of June lay between Harper's Ferry and Frederick. The force of the enemy on that day was partly at Chambersburg, and partly moving on the Cashtown road in the direction of Gettysburg, while the detachments from Ewell's corps, of which mention has been made, had reached the Susquehannah opposite Harrisburg and Columbia. That a great battle must soon be fought no one could doubt; but, in the apparent and perhaps real absence of plan on the part of Lee, it was impossible to foretell the precise scene of the encounter. Wherever fought, consequences the most momentous hung upon the result.

In this critical and anxious state of affairs General Hooker was relieved, and General Meade was summoned to the chief command of the army. It appears to my unmilitary judgment to reflect the highest credit upon him, upon his predecessor, and upon the corps commanders of the Army of the Potomac, that a change could take place in the chief command of so large a force on the eve of a general battle, — the various corps necessarily moving on lines somewhat divergent, and all in ignorance of the enemy's intended point of concentration, — and that not an hour's hesitation should ensue in the advance of any portion of the entire army.

Having assumed the chief command on the 28th, General Meade directed his left wing, under Reynolds, upon Emmettsburg and his right upon New Windsor, leaving General French with 11,000 men to protect the Baltimore and Ohio Railroad, and convoy the public property from Harper's Ferry to Washington. Buford's cavalry was then at this place, and Kilpatrick's at Hanover, where he encountered and defeated the rear of Stuart's cavalry, who was roving the country in search of the main army of Lee. On the Rebel side, Hill had reached Fayetteville on the Cashtown road on the 28th, and was followed on the same road by Longstreet on the 29th. The eastern side of the mountain, as seen from Gettysburg, was lighted up at night by the camp-fires of the enemy's advance, and the country swarmed with his foraging parties. It was now too evident to be questioned, that the thunder-cloud, so long gathering blackness, would soon burst on some part of the devoted vicinity of Gettysburg.

The 30th of June was a day of important preparation. At half past eleven o'clock in the morning General Buford passed through Gettysburg, upon a reconnoissance in force, with his cavalry, upon the Chambersburg road. The information obtained by him was immediately communicated to General Reynolds, who was, in consequence, directed to occupy Gettysburg. That gallant officer accordingly, with the First Corps, marched from Emmettsburg to within six or seven miles of this place, and encamped on the right bank of Marsh's Creek. Our right wing, meantime, was moved to Manchester. On the same day the corps of Hill and Longstreet were pushed still farther forward on the Chambersburg road, and distributed in the vicinity of Marsh's Creek, while a reconnoissance was made by the Confederate General Petigru up to a very short distance from this place. Thus at nightfall on the 30th of June the greater part of the Rebel force was concentrated in the immediate vicinity of two corps of the Union army, the former refreshed by two days passed in comparative repose and deliberate preparation for the encounter, the latter separated by a march of one or two days from their supporting corps, and doubtful at what precise point they were to expect an attack.

And now the momentous day, a day to be forever remembered in the annals of the country, arrived. Early in the morning on the 1st of July the conflict began. I need not say that it would be impossible for me to comprise, within the limits of the hour, such a narrative as would do anything like full justice to the all-important events of these three great days, or to the merit of the brave officers and men of every rank, of every arm of the service, and of every loyal State, who bore their part in the tremendous struggle, — alike those who nobly sacrificed their lives for their country, and those who survive, many of them scarred with honorable wounds, the objects of our admiration and gratitude. The astonishingly minute, accurate, and graphic accounts contained in the journals of the day, prepared from personal observation by reporters who witnessed the scenes and often shared the perils which they describe, and the highly valuable "Notes" of Professor Jacobs of the University in this place, to which I am greatly indebted, will abundantly supply the deficiency of my necessarily too condensed statement.[1]

General Reynolds, on arriving at Gettysburg in the morning of the 1st, found Buford with his cavalry warmly engaged with the enemy, whom he held most gallantly in check. Hastening himself to the front, General Reynolds directed his men to be moved over the fields from the Emmettsburg road, in front of McMillan's and Dr. Schmucker's, under cover of the Seminary Ridge. Without a moment's hesitation, he attacked the enemy, at the same time sending orders to the Eleventh Corps (General Howard's) to advance as promptly as possible. General Reynolds immediately found himself engaged with a force which greatly outnumbered his own, and had scarcely made his dispositions for the action when he fell, mortally wounded, at the head of his advance. The command of the First Corps devolved on General Doubleday, and that of the field on General Howard, who arrived at 11.30 with Schurz's and Barlow's divisions of the Eleventh Corps, the latter of whom received a severe wound. Thus strengthened, the advantage of the battle was for some time on our side. The attacks of the Rebels were vigorously repulsed by Wadsworth's division of the First Corps, and a large number of prisoners, including General Archer, were captured. At length, however, the continued reinforcement of the Confederates from the main body in the neighborhood, and by the divisions of Rodes and Early, coming down by separate lines from Heidlersberg and taking post on our extreme right, turned the fortunes of the day. Our army, after contesting the ground for five hours, was obliged to yield to the enemy, whose force outnumbered them two to one; and toward the close of the afternoon General Howard deemed it prudent to withdraw the two corps to the heights where we are now assembled. The greater part of the First Corps passed through the outskirts of the town, and reached the hill without serious loss or molestation. The Eleventh Corps and portions of the First, not being aware that the enemy had already entered the town from the north, attempted to force their way through Washington and Baltimore Streets, which, in the crowd and confusion of the scene, they did with a heavy loss in prisoners.

General Howard was not unprepared for this turn in the fortunes of the day. He had in the course of the morning caused Cemetery Hill to be occupied by General Steinwehr, with the second division of the Eleventh Corps. About the time of the withdrawal of our troops to the hill General Hancock arrived, having been sent by General Meade, on hearing of the death of Reynolds, to assume the command of the field till he himself could reach the front. In conjunction with General Howard, General Hancock immediately proceeded to post troops and to repel an attack on our right flank. This attack was feebly made and promptly repulsed. At nightfall, our troops on the hill, who had so gallantly sustained themselves during the toil and peril of the day, were cheered by the arrival of General Slocum with the Twelfth Corps and of General Sickles with a part of the Third.

Such was the fortune of the first day, commencing with decided success to our arms, followed by a check, but ending in the occupation of this all-important position. To you, fellow-citizens of Gettysburg, I need not attempt to portray the anxieties of the ensuing night. Witnessing as you had done with sorrow the withdrawal of our army through your streets, with a considerable loss of prisoners, - mourning as you did over the brave men who had fallen, — shocked with the wide-spread desolation around you, of which the wanton burning of the Harman House had given the signal,- ignorant of the near approach of General Meade, you passed the weary hours of the night in painful expectation.

Long before the dawn of the 2d of July, the new Commander-in-Chief had reached the ever-memorable field of service and glory. Having received intelligence of the events in progress, and informed by the reports of Generals Hancock and Howard of the favorable character of the position, he determined to give battle to the enemy at this point. He accordingly directed the remaining corps of the army to concentrate at Gettysburg with all possible expedition, and breaking up his head-quarters at Taneytown at 10 P.M., he arrived at the front at one o'clock in the morning of the 2d of July. Few were the moments given to sleep, during the rapid watches of that brief midsummer's night, by officers or men, though half of our troops were exhausted by the conflict of the day, and the residue wearied by the forced marches which had brought them to the rescue. The full moon, veiled by thin clouds, shone down that night on a strangely unwonted scene. The silence of the graveyard was broken by the heavy tramp of armed men, by the neigh of the war-horse, the harsh rattle of the wheels of artillery hurrying to their stations, and all the indescribable tumult of preparation. The various corps of the army, as they arrived, were moved to their positions, on the spot where we are assembled and the ridges that extend southeast and southwest; batteries were planted, and breastworks thrown up. The Second and Fifth Corps, with the rest of the Third, had reached the ground by seven o'clock, A.M.; but it was not till two o'clock in the afternoon that Sedgwick arrived with the Sixth Corps. He had marched thirty-four miles since nine o'clock on the evening before. It was only on his arrival that the Union army approached an equality of numbers with of the Rebels, who were posted upon the opposite and parallel ridge, distant from a mile to a mile and a half, overlapping our position on either wing, and probably exceeding by ten thousand the army of General Meade.[2]

And here I cannot but remark on the providential inaction of the Rebel army. Had the contest been renewed by it at daylight on the 2d of July, with the First and Eleventh Corps exhausted by the battle and the retreat, the Third and Twelfth weary from their forced march, and the Second, Fifth, and Sixth not yet arrived, nothing but a miracle could have saved the army from a great disaster. Instead of this, the day dawned, the sun rose, the cool hours of the morning passed, the forenoon and a considerable part of the afternoon wore away, without the slightest aggressive movement on the part of the enemy. Thus time was given for half of our forces to arrive and take their place in the lines, while the rest of the army enjoyed a much-needed half-day's repose.

At length, between three and four o'clock in the afternoon, the work of death began. A signal-gun from the hostile batteries was followed by a tremendous cannonade along the Rebel lines, and this by a heavy advance of infantry, brigade after brigade, commencing on the enemy's right against the left of our army, and so onward to the left centre. A forward movement of General Sickles, to gain a commanding position from which to repel the Rebel attack, drew upon him a destructive fire from the enemy's batteries, and a furious assault from Longstreet's and Hill's advancing troops. After a brave resistance on the part of his corps, he was forced back, himself falling severely wounded. This was the critical moment of the second day; but the Fifth and a part of the Sixth Corps, with portions of the First and Second, were promptly brought to the support of the Third. The struggle was fierce and murderous, but by sunset our success was decisive, and the enemy was driven back in confusion. The most important service was rendered toward the close of the day, in the memorable advance between Round Top and Little Round Top, by General Crawford's division of the Fifth Corps, consisting of two brigades of the Pennsylvania Reserves, of which one company was from this town and neighborhood. The Rebel force was driven back with great loss in killed and prisoners. At eight o'clock in the evening a desperate attempt was made by the enemy to storm the position of the Eleventh Corps on Cemetery Hill; but here, too, after a terrible conflict, he was repulsed with immense loss. Ewell, on our extreme right, which had been weakened by the withdrawal of the troops sent over to support our left, had succeeded in gaining a foothold within a portion of our lines, near Spangler's Spring. This was the only advantage obtained by the Rebels to compensate them for the disasters of the day, and of this, as we shall see, they were soon deprived.

Such was the result of the second act of this eventful drama, — a day hard fought, and at one moment anxious, but, with the exception of the slight reverse just named, crowned with dearly earned but uniform success to our arms, auspicious of a glorious termination of the final struggle. On these good omens the night fell.

In the course of the night General Geary returned to his position on the right, from which he had hastened the day before to strengthen the Third Corps. He immediately engaged the enemy, and, after a sharp and decisive action, drove them out of our lines, recovering the ground which had been lost on the preceding day. A spirited contest was kept up all the morning on this part of the line; but General Geary, reinforced by Wheaton's brigade of the Sixth Corps, maintained his position, and inflicted very severe losses on the Rebels.

Such was the cheering commencement of the third day's work, and with it ended all serious attempts of the enemy on our right. As on the preceding day, his efforts were now mainly directed against our left centre and left wing. From eleven till half past one o'clock all was still, - a solemn pause of preparation, as if both armies were nerving themselves for the supreme effort. At length the awful silence, more terrible than the wildest tumult of battle, was broken by the roar of two hundred and fifty pieces of artillery from the opposite ridges, joining in a cannonade of unsurpassed violence, — the Rebel batteries along two thirds of their line pouring their fire upon Cemetery Hill, and the centre and left wing of our army. Having attempted in this way for two hours, but without success, to shake the steadiness of our lines, the enemy rallied his forces for a last grand assault. Their attack was principally directed against the position of our Second Corps. Successive lines of Rebel infantry moved forward with equal spirit and steadiness from their cover on the wooded crest of Seminary Ridge, crossing the intervening plain, and, supported right and left by their choicest brigades, charged furiously up to our batteries. Our own brave troops of the Second Corps, supported by Doubleday's division and Stannard's brigade of the First, received the shock with firmness; the ground on both sides was long and fiercely contested, and was covered with the killed and the wounded; the tide of battle flowed and ebbed across the plain, till, after "a determined and gallant struggle," as it is pronounced by General Lee, the Rebel advance, consisting of two thirds of Hill's corps and the whole of Longstreet's, - including Pickett's division, the élite of his corps, which had not yet been under fire, and was now depended upon to decide the fortune of this last eventful day, — was driven back with prodigious slaughter, discomfited and broken. While these events were in progress at our left centre, the enemy was driven, with a considerable loss of prisoners, from a strong position on our extreme left, from which he was annoying our force on Little Round Top. In the terrific assault on our centre Generals Hancock and Gibbon were wounded. In the Rebel army, Generals Armistead, Kemper, Petigru, and Trimble were wounded, the first named mortally, the latter also made prisoner, General Garnett was killed, and thirty-five hundred officers and men made prisoners.

These were the expiring agonies of the three days' conflict, and with them the battle ceased. It was fought by the Union army with courage and skill, from the first cavalry skirmish on Wednesday morning to the fearful rout of the enemy on Friday afternoon, by every arm and every rank of the service, by officers and men, by cavalry, artillery, and infantry. The superiority of numbers was with the enemy, who were led by the ablest commanders in their service; and if the Union force had the advantage of a strong position, the Confederates had that of choosing time and place, the prestige of former victories over the Army of the Potomac, and of the success of the first day. Victory does not always fall to the lot of those who deserve it; but that so decisive a triumph, under circumstances like these, was gained by our troops, I would ascribe, under Providence, to the spirit of exalted patriotism that animated them, and a consciousness that they were fighting in a righteous cause.

All hope of defeating our army, and securing what General Lee calls "the valuable results" of such an achievement, having vanished, he thought only of rescuing from destruction the remains of his shattered forces. In killed, wounded, and missing he had, as far as can be ascertained, suffered a loss of about 37,000 men, — rather more than a third of the army with which he is supposed to have marched into Pennsylvania. Perceiving that his only safety was in rapid retreat, he commenced withdrawing his troops at daybreak on the 4th, throwing up field-works in front of our left, which, assuming the appearance of a new position, were intended probably to protect the rear of his army in their retreat. That day - sad celebration of the 4th of July for an army of Americans! — was passed by him in hurrying off his trains. By nightfall the main army was in full retreat on the Cashtown and Fairfield roads, and it moved with such precipitation, that, short as the nights were, by daylight the following morning, notwithstanding a heavy rain, the rear-guard had left its position. The struggle of the last two days resembled in many respects the Battle of Waterloo; and if, in the evening of the third day, General Meade, like the Duke of Wellington, had had the assistance of a powerful auxiliary army to take up the pursuit, the rout of the Rebels would have been as complete as that of Napoleon.

Owing to the circumstance just named, the intentions of the enemy were not apparent on the 4th. The moment his retreat was discovered, the following morning, he was pursued by our cavalry on the Cashtown road and through the Emmettsburg and Monterey passes, and by Sedgwick's corps on the Fairfield road. His rear-guard was briskly attacked at Fairfield; a great number of wagons and ambulances were captured in the passes of the mountains; the country swarmed with his stragglers, and his wounded were literally emptied from the vehicles containing them into the farm-houses on the road. General Lee, in his report, makes repeated mention of the Union prisoners whom he conveyed into Virginia, somewhat overstating their number. He states, also, that "such of his wounded as were in a condition to be removed" were forwarded to Williamsport. He does not mention that the number of his wounded not removed, and left to the Christian care of the victors, was 7,540, not one of whom failed of any attention which it was possible, under the circumstances of the case, to afford them, not one of whom, certainly, has been put upon Libby Prison fare, — lingering death by starvation. Heaven forbid, however, that we should claim any merit for the exercise of common humanity!

Under the protection of the mountain-ridge, whose narrow passes are easily held even by a retreating army, General Lee reached Williamsport in safety, and took up a strong position opposite to that place. General Meade necessarily pursued with the main army by a flank movement through Middletown, Turner's Pass having been secured by General French. Passing through the South Mountain, the Union army came up with that of the Rebels on the 12th, and found it securely posted on the heights of Marsh Run. The position was reconnoitred, and preparations made for an attack on the 13th. The depth of the river, swollen by the recent rains, authorized the expectation that the enemy would be brought to a general engagement the following day. An advance was accordingly made by General Meade on the morning of the 14th; but it was soon found that the Rebels had escaped in the night, with such haste that Ewell's corps forded the river where the water was breast-high. The cavalry which had rendered the most important services during the three days, and in harassing the enemy's retreat, was now sent in pursuit and captured two guns and a large number of prisoners. In an action which took place at Falling Waters, General Petigru was mortally wounded. General Meade, in further pursuit of the Rebels, crossed the Potomac at Berlin. Thus again covering the approaches to Washington, he compelled the enemy to pass the Blue Ridge at one of the upper gaps; and in about six weeks from the commencement of the campaign, General Lee found himself again on the south side of the Rappahannock, with the probable loss of about a third part of his army.

Such, most inadequately recounted, is the history of the ever-memorable three days, and of the events immediately preceding and following. It has been pretended, in order to diminish the magnitude of this disaster to the Rebel cause, that it was merely the repulse of an attack on a strongly defended position. The tremendous losses on both sides are a sufficient answer to this misrepresentation, and attest the courage and obstinacy with which the three days' battle was waged. Few of the great conflicts of modern times have cost victors and vanquished so great a sacrifice. On the Union side, there fell, in the whole campaign, of generals killed, Reynolds, Weed, and Zook, and wounded, Barlow, Barnes, Butterfield, Doubleday, Gibbon, Graham, Hancock, Sickles, and Warren; while of officers below the rank of general, and men, there were 2,834 killed, 13,709 wounded, and 6,643 missing. On the Confederate side, there were killed on the field or mortally wounded, Generals Armistead, Barksdale, Garnett, Pender, Petigru, and Semmes, and wounded, Heth, Hood, Johnson, Kemper, Kimball, and Trimble. Of officers below the rank of general, and men, there were taken prisoners, including the wounded, 13,621, an amount ascertained officially. Of the wounded in a condition to be removed, of the killed, and the missing, the enemy has made no return. They are estimated, from the best data which the nature of the case admits, at 23,000. General Meade also captured three cannon and forty-one standards; and 24,978 small arms were collected on the battlefield.

I must leave to others, who can do it from personal observation, to describe the mournful spectacle presented by these hillsides and plains at the close of the terrible conflict. It was a saying of the Duke of Wellington, that next to a defeat, the saddest thing is a victory. The horrors of the battle-field, after the contest is over, the sights and sounds of woe, - let me throw a pall over the scene, which no words can adequately depict to those who have not witnessed it on which no one who has witnessed it, and who has a heart in his bosom, can bear to dwell. One drop of balm alone, one drop of heavenly life-giving balm, mingles in this bitter cup of misery. Scarcely has the cannon ceased to roar, when the brethren and sisters of Christian benevolence, ministers of compassion, angels of pity, hasten to the field and the hospital, to moisten the parched tongue, to bind the ghastly wounds, to soothe the parting agonies alike of friend and foe, and to catch the last whispered messages of love from dying lips. "Carry this miniature back to my dear wife, but do not take it from my bosom till I am gone." "Tell my little sister not to grieve for me; I am willing to die for my country." "O that my mother were here!" When since Aaron stood between the living and the dead was there ever so gracious a ministry as this? It has been said that it is characteristic of Americans to treat women with a deference not paid to them in any other country. I will not undertake to say whether this is so; but I will say, that, since this terrible war has been waged, the women of the loyal States, if never before, have entitled themselves to our highest admiration and gratitude, — alike those who at home, often with fingers unused to the toil, often bowed beneath their own domestic cares, have performed an amount of daily labor not exceeded by those who work for their daily bread, and those who, in the hospital and the tents of the Sanitary and Christian Commissions, have rendered services which millions could not buy. Happily, the labor and the service are their own reward. Thousands of matrons and thousands of maidens have experienced a delight in these homely toils and services, compared with which the pleasures of the ball-room and the opera-house are tame and unsatisfactory. This on earth is reward enough, but a richer is in store for them. Yes, brothers, sisters of charity, while you bind up the wounds of the poor sufferers, — the humblest, perhaps, that have shed their blood for the country, — forget not WHO it is that will hereafter say to you, "Inasmuch as ye have done it unto one of the least of these my BRETHREN, ye have done it unto me."

And now, friends, fellow-citizens, as we stand among these honored graves, the momentous question presents itself, Which of the two parties to the war is responsible for all this suffering, for this dreadful sacrifice of life, — the lawful and constituted government of the United States, or the ambitious men who have rebelled against it? I say "rebelled" against it, although Earl Russell, the British Secretary of State for Foreign Affairs, in his recent temperate and conciliatory speech in Scotland, seems to intimate that no prejudice ought to attach to that word, inasmuch as our English forefathers rebelled against Charles I. and James II., and our American fathers rebelled against George III. These certainly are venerable precedents, but they prove only that it is just and proper to rebel against oppressive governments. They do not prove that it was just and proper for the son of James II. to rebel against George I., or his grandson Charles Edward to rebel against George II.; nor, as it seems to me, ought these dynastic struggles, little better than family quarrels, to be compared with this monstrous conspiracy against the American Union. These precedents do not prove that it was just and proper for the "disappointed great men " of the cotton-growing States to rebel against "the most beneficent government of which history gives us any account," as the Vice-President of the Confederacy, in November, 1860, charged them with doing. They do not create a presumption even in favor of the disloyal slaveholders the South, who, living under a government of which Mr. Jefferson Davis, in the session of 1860-61,said that it was "the best government ever instituted by man, unexceptionably administered, and under which the people have been prosperous beyond comparison with any other people whose career has been recorded in history," rebelled against it because their aspiring politicians, himself among the rest, were in danger of losing their monopoly of its offices. What would have been thought by an impartial posterity of the American rebellion against George III., if the colonists had at all times been more than equally represented in Parliament, and James Otis and Patrick Henry and Washington and Franklin and the Adamses and Hancock and Jefferson, and men of their stamp, had for two generations enjoyed the confidence of the sovereign and administered the government of the empire? What could have been thought of the rebellion against Charles I., if Cromwell and the men of his school had been the responsible advisers of that prince from his accession to the throne, and then, on account of a partial change in the ministry, had brought his head to the block, and involved the country in a desolating war, for the sake of dismembering it and establishing a new government south of the Trent? What would have been thought of the Whigs of 1688, if they had themselves composed the cabinet of James II., and been the advisers of the measures and the promoters of the policy which drove him into exile ? The Puritans of 1640 and the Whigs of 1688 rebelled against arbitrary power in order to establish constitutional liberty. If they had risen against Charles and James because those monarchs favored equal rights, and in order themselves "for the first time in the history of the world" to establish an oligarchy "founded on the corner-stone of slavery," they would truly have furnished a precedent for the Rebels of the South, but their cause would not have been sustained by the eloquence of Pym or of Somers, nor sealed with the blood of Hampden or Russell.

I call the war which the Confederates are waging against the Union a "rebellion," because it is one, and in grave matters it is best to call things by their right names. I speak of it as a crime, because the Constitution of the United States so regards it, and puts "rebellion" on a par with "invasion." The constitution and law, not only of England, but of every civilized country, regard them in the same light; or rather they consider the rebel in arms as far worse than the alien enemy. To levy war against the United States is the constitutional definition of treason, and that crime is by every civilized government regarded as the highest which citizen or subject can commit. Not content with the sanctions of human justice, of all the crimes against the law of the land it is singled out for the denunciations of religion. The litanies in every church in Christendom whose ritual embraces that office, as far as I am aware, from the metropolitan cathedrals of Europe to the humblest missionary chapel in the islands of the sea, concur with the Church of England in imploring the Sovereign of the universe, by the most awful adjurations which the heart of man can conceive or his tongue utter, to deliver us from "sedition, privy conspiracy, and rebellion." And reason good; for while a rebellion against tyranny — a rebellion designed, after prostrating arbitrary power, to establish free government on the basis of justice and truth — is an enterprise on which good men and angels may fool; with complacency, an unprovoked rebellion of ambitious men against a beneficent government, for the purpose — the avowed purpose - of establishing, extending, and perpetuating any form of injustice and wrong, is an imitation on earth of that first foul revolt of "the Infernal Serpent," against which the Supreme Majesty of heaven sent forth the armed myriads of his angels, and clothed the right arm of his Son with the three-bolted thunders of omnipotence.

Lord Bacon, in "the true marshalling of the sovereign degrees of honor," assigns the first place to "the Conditores Imperiorum, founders of States and Commonwealths "; and, truly, to build up from the discordant elements of our nature the passions, the interests, and the opinions of the individual man, the rivalries of family, clan, and tribe, the influences of climate and geographical position, the accidents of peace and war accumulated for ages, - to build up from these oftentimes warring elements a well-compacted, prosperous, and powerful State, if it were to be accomplished by one effort or in one generation would require a more than mortal skill. To contribute in some notable degree to this, the greatest work of man, by wise and patriotic counsel in peace and loyal heroism in war, is as high as human merit can well rise, and far more than to any of those to whom Bacon assigns this highest place of honor, whose names can hardly be repeated without a wondering smile, — Romulus, Cyrus, Caesar, Othman, Ismael, — is it due to our Washington as the founder of the American Union. But if to achieve or help to achieve this greatest work of man's wisdom and virtue gives title to a place among the chief benefactors, rightful heirs of the benedictions, of mankind, by equal reason shall the bold bad men who seek to undo the noble work, Eversores Imperiorum, destroyers of States, who for base and selfish ends rebel against beneficent governments, seer; to overturn wise constitutions, to lay powerful republican Unions at the foot of foreign thrones, to bring on civil and foreign war, anarchy at home, dictation abroad, desolation, ruin, — by equal reason, I say, yes, a thousand-fold stronger, shall they inherit the execrations of the ages.

But to hide the deformity of the crime under the cloak of that sophistry which strives to make the worse appear the better reason, we are told by the leaders of the Rebellion that in our complex system of government the separate States are "sovereigns," and that the central power is only an "agency," established by these sovereigns to manage certain little affairs, — such, forsooth, as Peace, War, Army, Navy, Finance, Territory, and Relations with the Native Tribes, which they could not so conveniently administer themselves. It happens, unfortunately for this theory, that the Federal Constitution (which has been adopted by the people of every State of the Union as much as their own State constitutions have been adopted, and is declared to be paramount to them) nowhere recognizes the States as "sovereigns," — in fact, that, by their names, it does not recognize them at all; while the authority established by that instrument is recognized, in its text, not as an "agency," but as "the Government of the United States." By that Constitution, moreover, which purports in its preamble to be ordained and established by "the people of the United States," it is expressly provided, that "the members of the State legislatures, and all executive and judicial officers, shall be bound by oath or affirmation to support the Constitution." Now it is a common thing, under all governments, for an agent to be bound by oath to be faithful to his sovereign; but I never heard before of sovereigns being bound by oath to be faithful to their agency.

Certainly I do not deny that the separate States are clothed with sovereign powers for the administration of local affairs. It is one of the most beautiful features of our mixed system of government; but it is equally true, that, in adopting the Federal Constitution, the States abdicated, by express renunciation, all the most important functions of national sovereignty, and, by one comprehensive self denying clause, gave up all right to contravene the Constitution of the United States. Specifically, and by enumeration, they renounced all the most important prerogatives of independent States for peace and for war, — the right to keep troops or ships of war in time of peace, or to engage in war unless actually invaded; to enter into compact with another State or a foreign power; to lay any duty on tonnage, or any impost on exports or imports, without the consent of Congress; to enter into any treaty, alliance, or confederation; to grant letters of marque or reprisal, and to emit bills of credit, — while all these powers and many others are expressly vested in the general government. To ascribe to political communities, thus limited in their jurisdiction, — who cannot even establish a post-office on their own soil, — the character of independent sovereignty, and to reduce a national organization, clothed with all the transcendent powers of government, to the name and condition of an "agency" of the States, proves nothing but that the logic of secession is on a par with its loyalty and patriotism.

O, but "the reserved rights"! And what of the reserved rights? The tenth amendment of the Constitution, supposed to provide for "reserved rights," is constantly misquoted. By that amendment, "the powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." The "powers" reserved must of course be such as could have been, but were not delegated to the United States, — could have been, but were not prohibited to the States; but to speak of the right of an individual State to secede, as a power that could have been, though it was not delegated to the United States, is simple nonsense.

But waiving this obvious absurdity, can it need a serious argument to prove that there can be no State right to enter into a new confederation reserved under a Constitution which expressly prohibits a State to "enter into any treaty, alliance, or confederation," or any "agreement or compact with another State or a foreign power"? To say that the State may, by enacting the preliminary farce of secession, acquire the right to do the prohibited things, — to say, for instance, that though the States in forming the Constitution delegated to the United States, and prohibited to themselves, the power of declaring war, there was by implication reserved to each State the right of seceding and then declaring war; that, though they expressly prohibited to the States and delegated to the United States the entire treaty-making power, they reserved by implication (for an express reservation is not pretended) to the individual States, to Florida, for instance, the right to secede, and then to make a treaty with Spain retroceding that Spanish colony, and thus surrendering to a foreign power the key to the Gulf of Mexico, — to maintain propositions like these, with whatever affected seriousness it is done, appears to me egregious trifling.

Pardon me, my friends, for dwelling on these wretched sophistries. But it is these which conducted the armed hosts of rebellion to your doors on the terrible and glorious days of July, and which have brought upon the whole land the scourge of an aggressive and wicked war, — a war which can have no other termination compatible with the permanent safety and welfare of the country but the complete destruction of the military power of the enemy. I have, on other occasions, attempted to show that to yield to his demands and acknowledge his independence, thus resolving the Union at once into two hostile governments, with a certainty of further disintegration, would annihilate the strength and the influence of the country as a member of the family of nations; afford to foreign powers the opportunity and the temptation for humiliating and disastrous interference in our affairs; wrest from the Middle and Western States some of their great natural outlets to the sea and of their most important lines of internal communication; deprive the commerce and navigation of the country of two thirds of our sea-coast and of the fortresses which protect it: not only so, but would enable each individual State, — some of them with a white population equal to a good-sized Northern county, — or rather the dominant party in each State, to cede its territory, its harbors, its fortresses, the mouths of its rivers, to any foreign power. It cannot be that the people of the loyal States — that twenty-two millions of brave and prosperous freemen — will, for the temptation of a brief truce in an eternal border-war, consent to this hideous national suicide.

Do not think that I exaggerate the consequences of yielding to the demands of the leaders of the Rebellion. I understate them. They require of us, not only all the sacrifices I have named, not only the cession to them, a foreign and hostile power, of all the territory of the United States at present occupied by the Rebel forces, but the abandonment to them of the vast regions we have rescued from their grasp, — of Maryland, of a part of Eastern Virginia and the whole of Western Virginia; the sea-coast of North and South Carolina, Georgia, and Florida; Kentucky, Tennessee, and Missouri; Arkansas, and the larger portion of Mississippi, Louisiana, and Texas, — in most of which, with the exception of lawless guerillas, there is not a Rebel in arms, in all of which the great majority of the people are loyal to the Union. We must give back, too, the helpless colored population, thousands of whom are perilling their lives in the ranks of our armies, to a bondage rendered tenfold more bitter by the momentary enjoyment of freedom. Finally, we must surrender every man in the Southern country, white or black, who has moved a finger or spoken a word for the restoration of the Union, to a reign of terror as remorseless as that of Robespierre, which has been the chief instrument by which the Rebellion has been organized and sustained, and which has already filled the prisons of the South with noble men, whose only crime is that they are not the worst of criminals. The South is full of such men. I do not believe there has been a day since the election of President Lincoln, when, if an ordinance of secession could have been fairly submitted, after a free discussion, to the mass of the people in any single Southern State, a majority of ballots would have been given in its favor. No, not in South Carolina. It is not possible that the majority of the people, even of that State, if permitted, without fear or favor, to give a ballot on the question, would have abandoned a leader like Petigru, and all the memories of the Gadsdens, the Rutledges, and the Cotesworth Pinckneys of the Revolutionary and Constitutional age to follow the agitators of the present day.

Nor must we be deterred from the vigorous prosecution of the war by the suggestion, continually thrown out by the Rebels and those who sympathize with them, that, however it might have been at an earlier stage, there has been engendered by the operations of the war a state of exasperation and bitterness, which, independent of all reference to the original nature of the matters in controversy, will forever prevent the restoration of the Union, and the return of harmony between the two great sections of the country. This opinion I take to be entirely without foundation.

No man can deplore more than I do the miseries of every kind unavoidably incident to war. Who could stand on this spot and call to mind the scenes of the first days of July with any other feeling? A sad foreboding of what would ensue, if war should break out between North and South, has haunted me through life, and led me, perhaps too long, to tread in the path of hopeless compromise, in the fond endeavor to conciliate those who were predetermined not to be conciliated. But it is not true, as is pretended by the Rebels and their sympathizers, that the war has been carried on by the United States without entire regard to those temperaments which are enjoined by the law of nations, by our modern civilization, and by the spirit of Christianity. It would be quite easy to point out, in the recent military history of the leading European powers, acts of violence and cruelty, in the prosecution of their wars, to which no parallel can be found among us. In fact, when we consider the peculiar bitterness with which civil wars are almost invariably waged, we may justly boast of the manner in which the United States have carried on the contest. It is of course impossible to prevent the lawless acts of stragglers and deserters, or the occasional unwarrantable proceedings of subordinates on distant stations; but I do not believe there is, in all history, the record of a civil war of such gigantic dimensions where so little has been done in the spirit of vindictiveness as in this war, by the Government and commanders of the United States; and this notwithstanding the provocation given by the Rebel Government by assuming the responsibility of wretches like Quantrell, refusing quarter to colored troops, and scourging and selling into slavery free colored men from the North who fall into their hands, by covering the sea with pirates, refusing a just exchange of prisoners, while they crowd their armies with paroled prisoners not exchanged, and starving prisoners of war to death.
