If you say nothing, there's a good chance that one of the following happens:

1) no one notices the error, possibly because the whole thing blows over, or because this ends up not being a determining factor

2) partner realizes error but thinks "oh well, anyone could have made that mistake, I wouldn't have caught that"

3) opposing counsel presents counterargument in a way that doesn't make it obvious that you were flat out wrong

its just a letter to opp counsel? who cares! just get it right for the judge. i sometimes intentionally send incorrect law in those letters to mask my actual argument before the court.

UPDATE: I lucked out. Opposing counsel responded. He didn't notice my fuck up, and we're moving on to other issues. God I hate when things like this happen. FMA. But I am elated that this turned out alright

Oh man it was 180. I got an email from the partner that said: "I just received this from opposing counsel. Please read and give me your thoughts." I got nervous as fukkk: time slowed down, I puckered my butthold, and sweat began to bead on my forehead. I was so nervous I had to read the letter a few times before I understood that I wasnt fucked. Opposing counsel mentioned the bad case we cited in a paragraph, and when I saw it I thought I was fucked, but he clearly didn't take the time to read the case, bc he attacked it on some other minor point. YNY. All in all, it turned out to be a 180 day. Feels good to win one for once
