Judge rejects settlement; gay activist Terry Bean to face trial on child sex abuse charges
A Lane County judge denied gay activist Terry Bean's request Thursday to settle child sex abuse charges by compensating the underage victim.
Bean, 66, and his former boyfriend, Kiah Loy Lawson, 25, are accused of having sex with a 15-year-old boy at a Eugene hotel in 2013.
They each are charged with two counts of third-degree sodomy, a felony, and third-degree sexual abuse, a misdemeanor.
Bean proposed a civil compromise that could result in the dismissal of the criminal charges against him. Had the request been granted, the criminal case against Bean would have ended.
In Oregon, judges have discretion to accept or deny a civil compromise.
Circuit Judge Charles M. Zennaché said he was unaware of another Oregon child sex abuse case that has been settled by civil compromise. "It's a little different than I banged up someone's car because they fired me," Zennaché said.
The judge said he did not want to open the door to settlements in child sex cases.
Zennaché said that if he were to approve the settlement, it would send a troubling message: "If you have enough money, you can buy sex with a minor" and avoid prosecution.
Bean, who lives in Portland, has been one of the state's biggest Democratic donors and an influential figure in gay rights circles in the state. He helped found two major national political groups, the Human Rights Campaign and the Gay and Lesbian Victory Fund, and has been a major contributor for several Democratic presidential candidates, including Barack Obama.
"There are certain social mores that we, as a society say, 'We are not going to let this happen,' " Zennaché said when ruling on the settlement. "I think it's bad public policy ... (and bad) from a public safety perspective."
Terms of the offer were not made public. Zennaché briefly cleared the courtroom while Derek Ashton, Bean's attorney, and Lori Deveny, an attorney representing the boy, detailed the proposed settlement.
Ashton said such an agreement is not unprecedented.
Bean's attorney cited the 2003 Clackamas County case of Stephen Page, a Milwaukie dentist who reached a civil settlement with a patient who accused him of sexually abusing and harassing her. The prosecutor in that case agreed to dismiss criminal charges as part of the agreement.
Zennaché and special prosecutor Scott Healy both noted that the victim in the Page case was an adult. And, Healy said, the circumstances were less egregious.
Healy strongly opposed Bean's proposal. He argued in court filings that Bean has engaged in sex with underage males for most of his adult life.
"Normally, such a remedy is suggested in low-level property crime cases where the facts are not too aggravated and the defendant has no prior criminal record or history of similar conduct," Healy said in a court filing.
Ashton said Healy "grossly mischaracterized" Bean in court filings to make Bean appear to be a lifelong child predator.
Ashton said Bean and Lawson met the boy through Grindr, an app used by gay men to arrange meetings. The boy claimed to be 18; the encounter lasted about 30 minutes; and "everyone went their separate ways," Ashton said.
Healy said in court filings that the boy told the men that he was underage as they were on the way to a Eugene hotel to have sex.
Bean's alleged victim, now 17, supports the settlement and does not want to testify, Deveny said.
"He has been as vocal as he can be and his voice still isn't being heard," Deveny said.
"He is being forced to do something against his will," Deveny said. "He is not merely reluctant, he is adamant" about not participating in the criminal case.
"It's not about buying your way out of it" and it's not about money, Deveny said
Bean's offer is "beyond monetary," she said. The boy would receive other beneficial things "that will follow him to the day he dies," said Deveny, who offered no details.
"Terry Bean is innocent of these charges. Nothing that transpired today changes that fact despite the prosecutor's attempts to color the proceedings," Ashton said in a written statement. "Terry looks forward to proving his innocence at trial."
Bean will be back in court July 30, when a judge will rule on what evidence and testimony will be allowed at trial

Original story: Police say they arrested 66-year-old Larry Brinkin, the high-profile gay activist, on possession of child pornography on Friday night.
Brinkin, a community icon who led the fight for the city to recognize same-sex partnerships, was arrested and booked into San Francisco County Jail, police said.
He posted bail and was released Saturday, according to a jail spokesman.
Police Spokesman Officer Albie Esparza would only say that the case was still under investigation, and would give no more details at this time.
Brinkin retired from the Human Rights Commission in 2010, and has been a beloved member of the gay community, with the Board of Supervisors even declaring the first week of February as "Larry Brinkin Week." At the time of his retirement, he earned more than $135,000 yearly.
We put in a call to Theresa Sparks, executive director of the Human Rights Commission, told us this allegation is "beyond hard to believe."
"It's almost incredulous, there's no way I could believe such a thing," Sparks told us. "He's always been one of my heroes, and he's the epitome of human rights activist -- this is man who coined phrases we use in our daily language. I support Larry 100 percent, hopefully it will all come out in the investigation."

Harry Hay has been described as "the father of gay liberation", and has been the subject of a biography and documentary film.
Hay came to be viewed as an elder statesman within the gay community, and was regularly invited to give speeches to LGBT activist and student groups. He was the featured speaker at the San Francisco Gay Pride Parade in 1982, and Grand Marshal of the Long Beach Gay Pride Parade in 1986. In 1990, Stuart Timmons published a biography, The Trouble with Harry Hay, on the basis of three years of research. Timmons described Hay as "the father of gay liberation".
Hay was the subject of Eric Slade's documentary film Hope Along the Wind: The Life of Harry Hay (2002). He also appeared in other documentaries, such as Word Is Out (1978), in which he appeared with his partner Burnside. Eugene, OR (AP) – A judge on dismissed sex-crimes charges against prominent gay rights activist Terry Bean after the alleged teenage victim refused to testify against him.
On Sept. 1, Lane County Circuit Court Judge Jay McAlpin gave prosecutors the option to refile charges if circumstances change, The Register-Guard reported.
Bean released a statement saying he’s relieved that the charges have been dropped, but “this nightmare never should have even begun.”
“I take some measure of comfort that the world now knows what I have always known — that I was falsely accused and completely innocent of every accusation that was made,” Bean’s statement said.
Bean, 66, is a Portland real-estate developer who co-founded two national gay rights groups and is a large donor to Democratic candidates. Prosecutors alleged that Bean and his then-boyfriend, Kiah Lawson, met a 15-year-old boy for sex in a Eugene hotel room in 2013. Charges against Lawson, 25, also were dropped Tuesday.
Bean’s lawyer, Derek Ashton, said Bean was not in the hotel room with the boy, and he said a witness would support the claim, the Oregonian reported ( http://bit.ly/1Jwkqos ).
Bean maintains that he was the victim of an extortion plot cooked up by Lawson.
“I look forward to being able to tell the story of this conspiracy of lies, deceit, blackmail, malicious prosecution and homophobia now that this case has ended,” Bean said.
Prosecutor Erik Hasselman said Bean rented the room and witnesses put him there during the alleged sexual encounter. Hasselman said the boy never wavered in his description of a three-way sexual encounter with Bean and Lawson.
“The prospect of testifying about very intimate details of a one-night relationship that he had with these men in front of a group of strangers, in front of the media … was extremely detrimental to his mental health,” Hasselman said.
Bean and the boy proposed a civil compromise, an option under Oregon law that allows the case to be resolved without a criminal conviction. A judge rejected their proposal. Prosecutors revealed Tuesday that the deal involved Bean paying the boy more than $200,000, the Register-Guard reported.
Bean and his lawyers have fought to keep details the proposed settlement secret and are fighting a motion by The Oregonian to make them public.
The boy’s attorney, Lori Deveny, said any suggestion that the boy didn’t want to testify because of money is false.
“My client is relieved this is finally over,” Deveny said in a statement. “He did not seek out this prosecution and made his unwillingness to testify known at every step in the process.”
Bean has for decades been a prominent figure in the Democratic Party and gay-rights circles. He helped found the Human Rights Campaign and the Gay and Lesbian Victory Fund, and he has raised money for Democratic presidential candidates, including President Barack Obama.
As a result of the charges, Bean took a leave of absence from the board of the Human Rights Campaign.
The charges haven’t shut off his activism completely, however. Bean is scheduled to host a fundraiser this month for the Multnomah County Democratic Party.
