This is a federal question meaning that we're arguing the meaning of a federal statute in court. D claims they aren't a proper defendant. How does one prove that they are proper? There are no tests, I cant imagine that a federal mag. is just going to sit there and listen to me tell him that I'm mostest positive that I'm right. |

If the statute prohibits x, y, z, and they did that shit, why wouldn't they be a proper defendant? If they didn't do that shit, what's your theory that they should be on the hook (third party liability? why?).
