How do you know if you have a proper defendant given that the SMJ is proper.
Case is a federal Q, but beyond that - how do you know if you have a proper defendant?

Yes, I've filed a number of lawsuits.
Maybe it would help if you explained why they claim they are not a proper defendant.
If the statute prohibits x, y, z, and they did that shit, why wouldn't they be a proper defendant? If they didn't do that shit, what's your theory that they should be on the hook (third party liability? why?).
