But the dude straight up drugged her with a date rape drug, which was combined with the alcohol. Despite being drugged she still stated that she didn't want sex, she just wasn't strong enough to fight. Its my understanding that these facts aren't really in dispute.
Given that, the age difference isn't the main issue. Really, neither is the anal sex in and of itself. Regardless of her age this would be rape.
That said, the victim doesn't seem to care much so frankly I'd be perfectly happy to have this guy give a few million to the victim and a few million to the government and call it good with the understanding that he never returns to the US again. |

I guess I'm just a pragmatist as far as criminal justice is concerned. The US spends way too much on this crap and incarcerates more people than any other country, which is nuts. Its not like he's a serial rapist, and its not like the victim is pressing for action (on the contrary, she wants this to go away), so it seems like spending money to fly him to the US, try him, and imprison him for years, all while the French are constantly protesting seems unnecessary. |

The victim, who doesn't even want to send the guy to jail, gets several million dollars which I'm sure she will appreciate. The state also gets a few million. And people generally get an additional incentive to work harder and become rich. What do we do with the poor person? 9/10 times no one would even pursue the guy. But the truth is that no matter how you slice it money matters. Polanski will get out of prison and what? He'll move back to his mansion in France. What will the poor guy do? He'll have a get a job bagging groceries. So I guess if you want to complain about inequality this seems like a strange place to start.
Whenever I have to draw lines for this stuff I draw them very, very low. But yeah, like you say, I'm ridiculously libertarian. |
