There's about a 99% chance I'll have to plead guilty to a drug felony pretty soon. I don't qualify for deferred adjudication (Georgia First Offenders Act), so the only possible way to get it off my record is to apply for a pardon, and I have to wait 10 years to do that.

I'm still in undergrad. I take it that there's no point in applying to law school anymore. What are some feasible careers for convicted felons? From what I understand, pretty much anything involving professional licensing is difficult, if not, impossible for me now. I really don't know what to do at this point. I'm okay with not being an attorney...but I don't want to wait tables for the rest of my life, either.

i only ask bc the brother of a friend of mine went to prison for several years for cocaine and some other charges. while he was in prison he taught himself quite a bit about computers. when he got out, he worked as a contractor with his father and eventually got a job as a programmer with a company his dad worked for. At the last job he had he was making about 70k

i dont know if this anecdote is useful or not, but I'm just saying it can be done. However, you will obviously have a much, much harder time getting hired than the average person, but if you work hard and/or have connections you might be ok.

this might work, but one thing you have to keep in mind is that many actuarial employers are reluctant to hire people with little experience and a lot of exams. that can probably be overcome, but be aware before you start on this path that it might not be easy

there are plenty of career changers out there. if you were busy doing something and said you discovered late in life you wanted to be an actuary, i could see an employer taking a chance with you. they'll be nervous about hiring you because of compensation expectations though. you won't be a very valuable employee initially but might want to earn what a typical FCAS earns, which would put them in an awkward situation

If you were interested in that from the start, why wouldn't you get a job in the field, unless, of course, you couldn't, because you're a convicted felon. 1)I don't have any connections so to speak. I come from a very modest middle class family. I don't know a single person in my family that's rich, well-connected, influential, etc. This, more than anything, is why I'm so destitute - I know that connections are the most important aspect to getting a job, especially in my situation.

2)Plea bargaining to a misdemeanor is not possible in my situation. My charges are Possession of a Controlled Substance with Intent to Distribute (VCSGA Schedule IV and Schedule III). The statutes only allow for misdemeanor offenses when it comes to marijuana.

3)Perhaps my record won't keep me from being admitted to school, but what about the bar? I understand that C & F can be forgiving of past mistakes, but I'd really hate to find out that they didn't in my case.

4)It's doubtful that I'll have to serve time. Most likely it'll just be 3-5 years of intensive probation (random drug screens and 4th Amendment waivers are common around here).

5)Entrepreneurship is probably the best path to mass riches, albeit fraught with risk. In any event, I don't really want to be the next Bill Gates or Larry Page. I just want to make a comfortable living doing something besides menial labor.

i would get involved in SALES. a lot of entrepreneurial spirit without the financial risks and it helps a lot to have someone else teach you who has already done so. if you were good at hustling pills you'd probably do alright with yourself hustling something else.

Have you shopped around on the lawyer front? In most major metropolitan areas, it's almost impossible to get stuck with a "possession with intent" charge as a first offense. I mean, how hard is it to use 300 pills personally? Does it go bad before you could use it all? Is all they have on the distribution angle the amount of drugs? DA's get a little queasy with those facts, and might want to avoid a trial.

Granted, Georgia doesn't sound like a liberal or forgiving place, so you might be screwed, but no harm in making sure other defense attorneys don't immediately indicate they could likely get a plea to something else.

Also, from what I can tell, there simply isn't anything in the statute to allow for a misdemeanor charge for any controlled substances other than marijuana. Simple possession is just as much a felony as possession with intent. What I'd like to know is whether I could still qualify for conditional discharge, i.e. O.C.G.A. § 16-13-2:

I'm waiting to hear back from my lawyer about this, but I think the odds are slim, considering that he's never mentioned it to me as an option.

According to the State Board of Pardons and Paroles website:

"A pardon which does not imply innocence may be granted to an applicant convicted under Georgia law who has completed his full sentence obligation, including serving any probated sentence and paying any court-ordered payment, and who has thereafter completed five years without any criminal involvement. The five-year waiting period after sentence completion may be waived if the waiting period is shown to be detrimental to the applicant's livelihood by delaying his qualifying for employment in his chosen profession. Application must be made by the ex-offender on a form available from the Board on request.

No pardon is automatic; the Board judges the merits of each individual case."

So if I have 5 years of probation (that's what I'm guessing will be offered in the plea bargain), and I'm able to convince the board, I may be able to get the pardon as soon as 2015. So that wouldn't be too bad at all. Anyone know how difficult this would be, or how difficult it is to get a pardon in the first place?

Would I be correct in assuming that contracting would be more feasible than conventional employment in my situation? I get the feeling companies aren't nearly as likely to do background checks on independent contractors as they are regular employees, but I suppose this depends on the field. Thoughts?
