To be fair, do you not see how a voter initiative for legalizing gay marriage predicated on the prevailing popular opinion among average Americans is completely and utterly different from SCOTUS - a non-majoritarian, non-democractic institution comprised of only 9 people, all of whom are highly educated and extremely intelligent - finding that a class is legally "protected" when it comes to something like this?
Do you think the holding in Brown v. Board would have passed a voter initiative in 1954?
It will take a long time for majoritarian support for gay rights to fully develop in the general population, but the writing is on the wall already and SCOTUS will get in on this issue with a landmark ruling in the next decade for sure. It's a matter of when, not if. |

I wasn't aware of this; it might have been in line with overall popular sentiment among the aggregate U.S. population, but how strongly did the average supporter of integration hold that view compared to how strongly the average opponent held his view? If there was some sort of hypothetical "national referendum" on the issue I'm not sure integration would have carried the ballot for that reason, even if most of the American public supported it in some weak, abstract sense. |
