When Casey was first argued, Rehnquist thought he had the votes to overturn Roe (Kennedy was on board). But he didn't want to release the opinion before the 1992 election b/c he thought that would make women vote Dem. So he did something or other to try to delay the opinion. Probably somewhere in the top half but below the top 1/3. Who really knows? I like him a lot personally so I put him up there, it's all speculation though.
I think he's certainly smart enough to be on the court but he doesn't really belong there in this day and age because he's not a terribly "political" person; he's a fundamentalist and a true believer, but 99% of the time he clings to philosophical principles where all of the other justices cling to practical politics. And people aren't sure what to make of that. |
