"The NYPD Hate Crimes task force is investigating an anti-Semitic scrawl at NYU Law.

Cleaning staff found “Damn Orthodox Jews” scrawled in a first-floor men’s room at 40 Washington Square South at 1:45 p.m. Monday.

Cops are poring over surveillance videos."

So...if I scrawled "I love Jews," since there is no hate, it's just a normal misdemeanor. But because I express hatred while also defacing property, it suddenly gets more government attetion?

Being liberal means never having to say you're sorry for creating thought police.

Each state's laws are different, but at least some require a certain intent while doing the crime (i.e., trying to instill fear or intimidatino in a certain group). In that sense, it's not unlike many crimes that differ based on the level/type of intent.

i love the thought police stuff. Of course that doesn't apply to mens rea and murder 1, right? Thoughts have never been taken into account in the history of criminal law

Depending on how the law is written (or applied for that matter) it could be fundamentally different.

If you're intent is to intimidate a group of people, I think that's a legitimate mens rea element to incorporate into a more serious crime. If the act is just motivated by your dislike for Belgians, I think that gets a little closer to criminalizing opinions.
