It is emphatically the duty of the Judicial Department to say what the law is. Those who apply the rule to particular cases must, of necessity, expound and interpret the rule. If two laws conflict with each other, the Court must decide on the operation of each. |

In years of litigation, the government has never cited any authority in support of a legal argument it kept making. It never cited any in its responsive brief. Then, for the first time ever, in oral argument, it whips out a footnote in a case which seems to support its theory, and we're caught completely off guard.
