I'm licensed in another state and am taking the CA bar right now. Since I'm working full time I'm not taking BARBRI.

For the essays, I'm curious what they said in the lectures about the formatting. Is it just IRAC the fuck out of everything or is there anything else?

IRAC + headings + underline important words like reasonable person, promissory estoppel, etc. etc. shit like that, actually promissory estoppel would be a heading, you'd underline the elements of promissory estoppel

thanks. A few other questions.

What is the essay grade scale?

Second, Barbri said essentially no one had ever failed the NY exam who got at least 140+ on the MBE. Did they say any MBE score essentially guaranteed passing on the CA bar?

i don't actually remember my score, but it was over 140 on the MBE and i failed. that being said i didn't take barbri and i took a sps course that actually told me to skip free points on the essays. they basically told me bro if it's obvious that there's a contract in a contract's essay don't talk about offer acceptance and consideration. there's no point focus on the topics that there's a lot to talk about, when i hired a tutor they were like dude if u just did x, y and z on this essay and on this essay you'd have passed already, i basically threw away like 30 easy points on each essay.

if u score a 140 on the MBE it's pretty hard to fail, you can borderline fail all of your essays and be fine. but if you already passed the bar someplace else u don't take the mbe right?

pretty sure that's impossible in CA because MBE isn't worth half of the points like it is in NY.

70 is right around what your essay needs to be to be "passing" eh it was 65 or around there actually, but 70 is like you're safe

A 70 is a very solid essay. I took the exam last year and it was scary to see failing essays that scored a 55 which looked very similar to 70s.

If you can average a 65 on the essays you're in very good shape.

assuming u get equally low on mbe/essay/pt i think u need to average 62.5 on the essays. lots of people do solid on the mbe + pts though so u can screw up essays quite a bit.

Subject: CA Bar Tutor here.

A few things:

1) I hope you're taking the full exam with MBE and not just the attorney's exam (only essays). The MBE will help raise your score (and to a comment above, MBE's don't transfer into CA).

2) A good strategy is to learn the fuck out of the MBE subjects and prof responsibility. You'll rape the MBE, and you'll also do well on roughly half of the essay portion (as PR is always guaranteed for the most part, and MBE subjects will involve 35-50% of the essay portion).

3) You're practicing so you should do well on the PTs. Take all this into account, and it really doesn't matter what you do on the random as fuck wills or community property essays. That said, those are easy too.

4) For scoring, a 65 is technically failing and 70 is technically passing based on an average. You'll probably get some mixture of 70s and 65s, with maybe a 75 or 80 thrown in with a 60 possibly if you just blank on one.

5) The formula I think is 34% MBE, 26% PT's, and 40% essays on a 2000 pt scale. Everything is converted into some #, don't even bother trying to figure it out. You're supposed to get like a 1440 or so , but that doesn't mean you need to get 72% right per se.

6) Definitely IRAC and be elementary as possible. Tons of headings and subheadings, make sure to address tandem issues always (e.g., conversion AND trespass to chattels). If you just read a bunch of sample answers, you can see the general structures you need for any given essay in each subject. It's pretty formulaic.

7) You won't know everything...but take solace in the fact that everyone else won't either (and most will know less).

do I just IRAC the fuck out of everything? I mean, do I literally break down all the elements of a rule?

E.g., burglary--every element gets a heading:

Breaking and Entering

Of a dwelling

Of another

at Night

With an intent to felony therein

like that? the barbri sample answers dont always do that but im going to do that shit for security.

Yes, this is how the bar graders expect it, especially if it's a major issue. I don't think it's possible to have too many headings, but if you don't have enough the grader will fuck you.
