lol first lol no, you can raise it alongside your answer OR in a separate motion BEFORE your answer.
and second no you can't interlocutory appeal it because it's not fucking appealable under 1291 see van cauwenberghe v. baird (1988), it's something you can just raise on ordinary appeal after final judgment. the only way you get it as an interlocutory appeal, which it isn't, is if you manage to convince the court to certify it, and even then an appeals court is probably going to just say fuck it. but short answer, not REQUIRED to eb immediately appealable.
