I do mostly PI but I take on the occasional employment case if it is a good one.

I'm sitting in a mediation right now on a wrongful term. Client worked for a company doing marketing. Several months before she was pregnant, a company was hired to outsource some of her company's work. The invoices never included any worked performed by my client. Once my client let them know she was pregnant, the next invoice showed her role being outsource and she was fired two weeks later. Client has been unable to find a job for a year because she was pregnant for several months and then she had the baby and has been with him the last 5 months. She actively attempted to mitigate by looking for work, but of course no one is going to hire a pregnant woman or one with a newborn baby.

We demanded 1 million. Their first offer is 50K + attorneys fees/costs. Taking guesses on where this will settle. I'm thinking 200-300K. It is probably worth more but there is no insurance so the owners are paying out of pocket.

We take 40% attorneys fees. If we were awarded attorneys fees we would get those if they were greater than 40%. If there are not, we just roll them into the total settlement and take 40% of everything.

Got it, so you're already into discovery. Surprised they didn't try and settle before getting to that phase. Was it pretty targeted and easy for them to produce? The texts are probably hers assuming they went to her phone. No issue with saving emails, possibly violation of company policy to do so?

I'm more familiar with matters where discovery starts at 6 figures and goes up from there, so it's usually a motivator for parties to try to work out an agreement first.

Still here. They are at 200K right now. We are at 800K. There has been a lot of back and forth on facts. Now we are finally into the negotiation. It looks like we may get to 400K+ the way things are going. Much better than I expected.

No demands. We had a bunch of factual disputes that we worked through with the mediator. Then mediator asked us to come off the million. We said we would if they came up to 200K. So there has only been one move. Waiting for mediator to come back to the room still. Just working and eating a sandwich.

I know every single one of my 300 cases. I regularly speak with the clients and have a personal relationship with all of them. I spend half a day once per week going through EVERY single file and refreshing myself on the current status. I also have a good memory too I guess.

Recovery paid out in fees is generally taxable to the client, but many employment cases get an above the line deduction for the fees they paid, which negates it. Check IRC 62a20 and 62e

We are paid in a separate check as per settlement agreement. Also, Trump fucked up the tax code and right now it reads as though client has to pay taxes on attorneys fees as well, but that is getting corrected.

1. We had a strong case. If we hit my guess would be high six figures. But, there was some damaging evidence that she was selling a competing product while working there in violation of company policy (which she had a reasonable explanation for). I think chances of a plaintiff's verdict was probably 70-80%. Client also needed money now and didn't want to wait a year to get paid. Right now her husband is working crazy overtime, they have a new baby, and the 250K they netted will help them out.

2. We would have tried the case. I'm not afraid to take it to trial. But more likely we probably would have mediated again after depos/closer to trial and it would have settled.
