But obviously the last thing a franchisee wants is to tangle with corporate-- not only do they have far deeper pockets, they have about a billion ways to fuck with the franchisee without formally breaching the contract (helps that corporate WROTE the contract!). So if you display knowledge of their obligations, then they'll play ball just to make you happy and get rid of you so you don't tell corporate they're in breach. What's more, the agreements are "out there" pretty easily, but technically confidential-- so you may know what the franchisee has agreed to, but establishing so in compliance with the rules of evidence is surprisingly difficult.
But, more to the point, you don't actually need to do this, because what the franchisee is really afraid of is corporate and what corporate can do without relying on the court system (hint, if they don't play ball, their deliveries may become mysteriously delayed, and TECHNICALLY the McDonald's website doesn't have to list the location of every McD's-- disfavored franchisees have been known to find themselves invisible on the app and website). The only lawyer you need to get your McPizza is you, don't overcomplicate things by involving the formal legal system. |
