In Mass, the state needs to prove beyond a reasonable doubt that she "retained the substantial capacity to appreciate the wrongfulness or criminality of their conduct and to conform their conduct to the requirements of the law."
On the day of the murder, she probably legitimately could not "conform her conduct" to not murdering the kids, even though she knew it was wrong. |

I worked on a case once where that happened. Def was an obviously guilty gang member. Trial 1 ended in hung jury. State "retested" some DnA evidence so it found a better match, didn't give the defendant the new evidence in a timely manner, tried him again, and got a hung jury again. Judge then said he wasn't putting up with a third trial and tossed the case. Def couldn't believe his luck. Judge was former prosbro from that office. I think he was unhappy that the state (a) messed up an easy conviction (twice!) and (b) that they tried the shenanigans with 11th hour DnA retesting. |
