Courts in Germany, and I assume the rest of the EU, tend to be very establishment-friendly. I have a hard time believing they would not sign off on the legality of something proposed by the EU.

Article 122 of the
Treaty on the Functioning of the European Union (TFEU) provides the legal basis for the EU to take exceptional measures during economic or financial crises. It contains two main paragraphs: one for general economic difficulties and another for specific financial assistance to member states affected by natural disasters or "exceptional occurrences". Article 122 has become known as an "emergency law" for the EU, enabling rapid action but bypassing the European Parliament in the decision-making process.
Key aspects of Article 122 TFEU
Purpose: To enable the EU to act quickly in times of economic crisis or natural disaster in a spirit of solidarity among member states.
Scope:
Article 122(1): Allows for measures in response to general economic difficulties, such as supply problems in the energy sector.
Article 122(2): Specifically enables financial assistance to a member state facing or threatened by severe difficulties caused by natural disasters or exceptional occurrences beyond its control.
Decision-making:
Requires a proposal from the European Commission.
Requires a qualified majority vote in the Council.
