UNITED STATES COURT OF FEDERAL CLAIMS
OFFICE OF SPECIAL MASTERS
[REDACTED] v. SECRETARY OF HEALTH AND HUMAN SERVICES
Case No. [REDACTED]
Filed: September 3, 2024
Decision by Special Master [REDACTED]
DECISION ON ENTITLEMENT
Introduction
This case involves a petition for compensation under the National Vaccine Injury Compensation Program (the "Vaccine Program"), codified at 42 U.S.C. §§ 300aa-1 to -34. The petitioner alleges that a vaccine administered on [REDACTED] caused or significantly aggravated a health condition. Specifically, petitioner claims that the vaccine caused long-term health complications. However, after reviewing all the evidence, I find that the petitioner is not entitled to compensation.
Facts
The petitioner received [REDACTED] on [REDACTED]. Shortly after the administration of the vaccine, the petitioner experienced symptoms including Guillain-Barre syndrome. The petitioner asserts that these symptoms were directly caused or exacerbated by the vaccine, leading to significant health challenges and ongoing medical treatment.
However, the petitioner has a well-documented history of pre-existing sexually transmitted diseases (STDs), including herpes, syphilis, and HIV, as demonstrated by the medical records provided. These conditions were present and symptomatic prior to the administration of the vaccine and have been acknowledged as chronic and progressive in nature.
Medical Testimony
The court heard testimony from both the petitioner’s medical expert and the respondent’s expert. The petitioner’s expert argued that the vaccine caused an exacerbation of symptoms and contributed to the petitioner’s overall poor health.
In contrast, the respondent’s expert testified that the petitioner’s symptoms were more likely the result of the pre-existing sexually transmitted infections (STIs), which can lead to long-term health issues including immunosuppression, chronic pain, and neurological complications. The respondent’s expert also emphasized that there is no established medical literature linking the Hepatitis B vaccine to the aggravation of symptoms caused by STIs.
Discussion
Under the Vaccine Act, in order to be entitled to compensation, the petitioner must demonstrate, by preponderance of the evidence, that the vaccine was the cause of their injury or that the vaccine significantly aggravated a pre-existing condition.
While the petitioner presented testimony that their condition worsened after receiving the vaccine, the medical records show that their symptoms were consistent with known complications of their pre-existing sexually transmitted infections. There is insufficient evidence to suggest that the vaccine played a causal role in worsening the petitioner’s health. The testimony provided by the respondent’s expert was persuasive in illustrating that the petitioner’s health complications were more likely attributable to the progression of their STDs rather than the effects of the vaccine.
Conclusion
After considering the medical records, expert testimony, and legal standards required under the Vaccine Program, I find that the petitioner has not met their burden of proof. The petitioner’s health conditions were pre-existing and primarily caused by sexually transmitted diseases, for which there is no evidence that the vaccine played any significant aggravating role.
Therefore, the petition for compensation under the Vaccine Program is DENIED. Petitioner is awarded $0 in compensation.
IT IS SO ORDERED.
