As I recall, there was testimony during Charlie's trial to the effect that Harvey knew nothing about the plot and was very upset when he heard about it. On the other hand, I think the circumstantial evidence against Wendi is very strong. As I recall, there were a bunch of calls between her and Charlie right before the murder happened. On the morning of the murder, she drove past shortporch's house even though it was a major detour on her route. And when she saw crime scene tape at the house, she didn't stop to see if her kids were okay. And there was testimony from one of the hitmen that Charlie insisted that they drive a certain model and color of car, which was the same as Wendi's boyfriend was driving at the time. It's not airtight, but people have been convicted on far weaker evidence than this. My guess is that unless they can find new evidence that can definitely prove that Wendi is involved, they won't arrest Wendi until they either get Donna or Charlie to roll over (or give up on trying). There was a rumor that the DA's office offered Donna a plea deal for time served if she would give up Wendi, but Donna refused. The DA's office denies this, so who knows? A good defense attorney might be able to convince a juror or two that there is a reasonable doubt, but plenty of people have gone to prison on much weaker evidence than this. 2) what does it mean that wendi testified under immunity? does that mean that they would have forced her to testify either way and made her invoke the 5th? did she testify at previous trials and invoke? why would she take an immunity offer -- did she WANT to rat out her mother? and why would someone take immunity to rat out their mom without getting an actual deal? i dont see what she gains, and "looking cooperative" to the DA doesnt like aseem good enough reason to rat out your mom. |

He was there specifically to show how controlling Donna is/was and to observe her reactions in the aftermath of Markel's death. He also has a secondary effect of blunting Wendi's credibility.
2) she has qualified immunity and perhaps I'm out of my depth here but I don't think she can make blanket 5th amendment objections because the state has agreed not to use her testimony against her. That doesn't mean they can't charge her. As far as why she's testifying, at this point it has to be self-preservation. |
