That said, "tortures" is the word doing heavy lifting. Civil commitment has a statutory purpose (treatment, risk management) and some procedural guardrails — it's bad in practice sometimes, and the line between custody and coercion is blurry, but calling it torture elides the difference between systemic dysfunction and intent.
Where it's genuinely indefensible: the indigent who can't post bail and sit pretrial for months, or the involuntarily medicated under Sell v. United States to make them trial-competent. Those are cases where the state's power over the body is real and the safeguards are thin.
Bottom line: the premise that the US can restrain and harm people without a criminal trial is correct. Whether every instance rises to "torture" depends on what you mean by that word. |
