Which seems dumb. Who cares if the President was wrong in his legal conclusion that DACA was unconstitutional? How is that any less rational than just saying "I don't like this program and therefore it's gone"??

You have cloistered lib judges who hate Trump, supported by naive 26-year-old lib clerks who hate Trump. Typically judges even if very lib or very conservative have the wisdom and judgment to curb their clerks' ideological excesses and to stay within the bounds of the law. Now it seems like they're mutually enabling each other, ruling against Trump whenever they see a legal rationale for doing so that is less than 100% frivolous.
The ruling here is similar to the travel ban ruling, in that they take presidential decisions where typically POTUS enjoys near absolute deference, and subject them to a test where the judge has to find the justification for action persuasive in order to uphold it.
As someone mentioned earlier, yes, this is moving in the direction of a constitutional crisis. |
