The federal judge is a shitlib Obama appointee. She's going to rule in favor of Harvard, and DOJ will appeal to SCOTUS. It will be a 5-4 decision, probably narrowly tailored to argue that Harvard cannot use arbitrary measures to impose higher admission standards on Asian-Americans but will refuse to ban affirmative action outright. Colleges will then simply shift their admissions policies by eliminating the SAT/ACT as requirements and adding a video interview component and use that to justify more unqualified blacks and latinos.

I think it will be a rare case where the quality of the trial advocacy will be determinstive. The plaintiffs should win, but they are necessarily geeks and can be portrayed in off putting ways.
