Larry Krasner means change is afoot in Philly DA on BBC4

The documentary follows a noted civil rights lawyer who became the surprise new district attorney of Philadelphia

Change is afoot in Philadelphia. “We’re gonna win the Super Bowl and get rid of cash bail all in the same year!” exults a member of Larry Krasner’s team. This eight-part series looks at what happened when a noted civil rights lawyer became the surprise new district attorney of the “most incarcerated” big city in the US. Surprise, because the role is traditionally taken by a hardline prosecutor rather than a defence lawyer. “Almost by nature you’re conservative,” says a judge. “You’ll be the DA when David Dukes is the next head of the ACLU [American Civil Liberties Union],” chortles an insider. 

His immediate predecessor Seth Williams having been indicted for fraud, Krasner won by a landslide in January 2018 on a reforming ticket, one of the new breed of progressive prosecutors — including women and people of colour — taking office up and down the country. Krasner’s mission is to overturn the “lock ’em up, lock more of them up, lock ’em up for longer” policy as he pithily terms it. Tough former Philly DA Lynne Abraham sniffs: “Turn out the jails . . . good luck with that.”

Ending cash bail — the system where people too poor to pay their way out endure lengthy incarceration before ever being found guilty of a crime — is a priority for the black community whom it disproportionately affects. Krasner also thinks the public will be on side with stopping jailing people for “dumb stuff” such as SAM — small amounts of marijuana — retail theft and some non-violent offences. However, the media might not be so forgiving, with a news anchor intoning a splendid non sequitur: the new DA is against “mass incarceration but not mass firing”. This is a reference to Krasner’s infamous “Snow Day Massacre”, where former staff glumly trudged into the blizzard with their cardboard boxes. “The coach gets to pick the team,” he counters. 

Part of the joy of this series is the intellectual cut and thrust of its protagonists. Well, perhaps not John McNesby, president of the Fraternal Order of Police (FOP). He was never likely to warm to a DA who was previously involved in overturning 800 convictions after accusations of misconduct by officers. “He’s not going to be able to make any changes here without going through the FOP,” McNesby says grimly, while Krasner warns police: “If you think this is Romper Room for beating people up and stealing from them, you’re going to have a problem with me.”

At a victory meeting, an aide tells Krasner it’s time to drop the belligerent anti-establishment attitude: “You the man now . . . you love everybody. You love puppies and kittens and vegans.” Who could argue with that? Quite a few, it turns out.
