The tweet asks, "Who's at fault here?" That must refer to fault for the collision because nothing else makes much sense. And let's assume it means legal fault, not some sort of moral or ethical fault.
The majority position in the comments seems to be that the truck at least shares fault for the collision, which is completely fucking retarded. The truck was established in the lane and the dumbass car got upset and tried to pass.

Everyone blaming the dumb cunt bitch is doing so on incomplete information because we lose sight of her during the critical time. Initially it does look like she got pissed and tried to cut him off, but if you rewatch closely, that isn't what happened. I don't think she ever ended up in the right lane or that the truck ever got "established" in the left. They were both in the same lane fighting over it, with the truck straddling oncoming traffic. The truck had the obligation to yield that entire time, and at any rate, it's not clear whether she had free space to go to the right lane. It looks like she sped up to AVOID a collision with a car encroaching into her lane, and the truck had an obligation to yield b slowing down.
It does *look* like she "zoomed in from the right," but you have to remember that this is from the DASH CAM'S perspective, which in this case is not aligned with actual traffic lanes. Yes, the truck is going straight, but it's only a bit more than halfway over the centerline when it hits her and is not entitled to occupy any of the lanes. We don't know where she is when we lose sight of her, but it's much more likely that she's next to the truck rather than behind it. |

No reasonably prudent person under the circumstances with a duty to drive safely would have accelerated, threaded between cars, and then swerved into the truck.
The woman's breaches weren't just breaches; they proximately caused damage to the truck.
You hang everything on the notion that the truck committed traffic violations and was partially in the lane. That's not good enough. For there to be fault in the fault comparison context, the truck must have (1) breached a relevant duty and (2) thereby proximately caused the damage at issue -- here, the collision.
I don't care about the truck's violations because they weren't a proximate cause of the collision. Nothing about straddling a line or cutting someone off proximately causes the person who was cut off to accelerate, pass, and later swerve. That road rage is a superseding cause, it's not within the scope of the risk of the truck's violations, it's not legally foreseeable, and recognizing it would be contrary to public policy.
So all fault goes to the car, and no fault goes to the truck. |

The truck seems to be 100% at fault.
Everyone blaming the dumb cunt bitch is doing so on incomplete information because we lose sight of her during the critical time. Initially it does look like she got pissed and tried to cut him off, but if you rewatch closely, that isn't what happened. I don't think she ever ended up in the right lane or that the truck ever got "established" in the left. They were both in the same lane fighting over it, with the truck straddling oncoming traffic. The truck had the obligation to yield that entire time, and at any rate, it's not clear whether she had free space to go to the right lane. It looks like she sped up to AVOID a collision with a car encroaching into her lane, and the truck had an obligation to yield b slowing down.
It does *look* like she "zoomed in from the right," but you have to remember that this is from the DASH CAM'S perspective, which in this case is not aligned with actual traffic lanes. Yes, the truck is going straight, but it's only a bit more than halfway over the centerline when it hits her and is not entitled to occupy any of the lanes. We don't know where she is when we lose sight of her, but it's much more likely that she's next to the truck rather than behind it.

Then she swerved in front of him AFTER he finished turning. If she had just kept going straight instead, and they collided, then it would be the truck's fault for turning into traffic and not giving way. But I think since she pulled back into the lane after he turned, the accident is her fault, even though he did turn illegally beforehand.
Any normal person would let the truck in though, because turning left in traffic is hard, she was stopped and had some space in front of her that he could have used, and that's what you do to be considerate. |
