On information & belief, this person was never previously contacted by him to ok his inclusion in the bar complaint. His landlord failed to return his security deposit, so I agreed to represent him for free. As a thank you, he venmo'd me $400. Long story short, the (((process))) took too long and after a year, he bar grieved me.
Keep in mind, in that year I had gone back and forth with his landlord, had sent two certified demand letters, etc. I was just about ready to file the suit when the bar complaint happened. The reason I waited so long is because he explicitly told me he doesn't want his name in public records. I took that to heart and tried to resolve this without involvement of the courts until I couldn't. But then he bar grieved me. |

In the bar complaint, he referenced a mutual friend who "100% sides with [him]" whom I don't think ever knew that he was referenced. I can easily prove defamation.
EDIT: for the mouth breathers, that means that I'm not alleging the statements in the bar complaint were defamatory (and I will in fact concede they weren't!) -- it's what was said outside of the bar complaint. |

I can provide some remedial education from this thread: The defendant in my lawsuit (i.e., the faggot who made the bar complaint) said he had at witness (i.e., the person I want to depose) who can vouch for everything he said. On information and belief, that person never knew he was referenced in the bar complaint. In fact, he flat out said--to both of us--that he wants nothing to do with it. This guy included him on a text message chain asking why his case wasn't moving faster.
oh and in case you're *really* autistic: "I know him from the bar" means I know him from a restaurant that serves alcohol, not The Florida Bar. Why the *fuck* would I know a Bar investigator and, assuming I did, why the *fuck* wouldn't I volunteer that info initially? |
