Althouse:
We've been talking about the lawsuit brought by two Yale law students who are suing various individuals over some nasty talk about them at the AutoAdmit. NPR will have an "All Things Considered" story on the subject today. I gave a 20 minute interview to the reporter and will be interested to see which part of it they use. Perhaps none. I'm going to guess that the story will be very supportive of the students and will underplay free speech concerns.

Well, I did explain after that why it wasn't productive to get in the habit of removing comments, because they reappear in multiples. That just wasn't included.

announcer introduced autoadmit and the lawsuit. cited a few "rape" posts. talked to that jill girl from feministe, who said after autoadmit started hounding her she felt somewhat uncomfortable in public and in class (not knowing if she was sitting next to the perp). jill is not suing.
they talked to volokh, who said the doe who went 16/4/0 with law firms probably didn't do so because the firms read anything on autoadmit.
they talked to leiter, who said the Does' best remedy might be to out the defendants and thereby ruin their legal careers.
they talked to rachmiel, who said GTO was having trouble finding a job (he's "radioactive" according to rach), and who seemed ambivalent about whether he had a responsibility to police the board.
there was more, but this was the "new" stuff, if you understand what i mean.
no legal issues were discussed iirc.

What a fucking perverse version of first amendment law Leiter has. The Supreme Court has said the best remedy for speech is more speech - the basic marketplace approach. Leiter interprets this marketplace to mean: hey, let's censor speech we don't like, then attack free speech by outing the speakers' identities, and then let the "marketplace" destroy their careers.

A marketplace vote is 1) not fair and 2) not the American way.
The marketplace governs free speech: if you don't like some speech, drown it out with more speech.
The marketplace does not govern actions, such as outing posters and possibly ruining careers.
The American way is actually to restrain the marketplace from deciding such things. We have a republican form of government in part because our Framers wanted to protect the country against the whims of the mob. While our legal system still centers around the jury, our laws and procedures attempt to restrict its influence.
