I tend to think his actions against Cassie are/should be criminal, but its a grey area and doesn't seem like something federal law enforcement should be pursuing. I could see a jury wanting to punish him for it, but I could also see a jury wanting to punish the prosecution for targeting him. |

i have done this job and nonetheless i can say that even the best prosecutors often underestimate how transparent some of the comically prejudicial yet legally admissible evidence (under means other than proof) like 404b shit is, transparently stacking the deck against the defendant.
people have a broad sense of fairness and the cases often don't require that level of dogpiling unless they're flimsy in the first place, and people seem to be able to sense that even if it's not abundantly clear to them. as the state, you have to maintain that baseline fidelity that you're trying to make sure a fair trial is occurring. |
