Seems to me the probability is pretty low that a gunshot heard by the shooter is from a mostly pinned/controlled guy (who shooter is looking at and who does not visually have a gun), and not from anyone else in the crowd, other law enforcement, or an endless number of other potential sources. And obviously the gravity of shooting to death a disarmed and pinned/controlled guy is huge.
This all adds up to unreasonability in my estimation. |

Once a firearm appears during active resistance, the legal standard is simple: reasonable perception of imminent deadly force. That standard was met here. that BP agent's mistake isn't attributed to the cop who shot. the cops all yelled "gun!" accurately and then in the melee heard the shot fire and they assumed (reasonably?) that they had to protect themselves and fellow agents.
it was a fucked up shooting but there is an articulable defense. they will be cleared and pardoned on the federal side. the action will be on the state side at some point. |
