I feel bad for the poor taxi driver who is probably just trying to make a living to feed his family working 70 hours a week. He probably already had neck pain from driving that was seriously aggravated by this attention seeking woman. He probably still lives daily with the pain she caused. That’s significant enough damages for a settlement well worth in excess of $25k depending on specials. You have to be going 15 to 20 to get that much bumper distortion. The dingdong chick even poasted a photo w the driver *holding his neck* after the crash. The fact that she chose that photo either means she’s a fucking idiot or that was the best of the lot for her defense. Driver is demonstrating injury on the scene and preoccupied w the car when the photo was taken. Taxi driver had a legitimate claim and I certaintly would have gotten more for him than $24k.
Note the relationship of the ad damnum 240000 to the final settlement amount $24000. Some attys will claim an ad damnum 10x the specials on soft tissue injury cases especially if that figure punches past the available coverage. If thats what plaintiffs atty did here, that is even more of an sps result (24k in actual specials and then a 24k settlement?!)
