-The DC Circuit, while important, has a very low caseload, and these three judges are not going to have a very significant impact, especially with a lot of senior Reagan-era nominees still staffing cases.

-Maybe his goal is to staff the bench with 50- to 52-year-old judges who'll be shortlisted for the next Democratic administration for SCOTUS. But that's a very very long game and assumes that no one else in the wings is any good for a short list.

-There's only a couple of years left in his term for him to even get nominees through, and he's nominated at a lower rate.

So while I get that Obama and Reid have advantages to going nuclear, doesn't this, in the long run, likely fail a Rawlsian test in terms of long-term advantage?

Anyone liberals want to defend on the basis of something I'm missing. tyia

I have to wonder if the GOP won't have a majority of senators pretty soon, in which case Reid will be glad to have been bluffing. He's a shrewd, craft parliamentarian, so I assume it's a bluff.

We'll find out in about 15 minutes. They voted to end cloture on a nominee (failed), they vote to adjourn (failed), they're voting on whether to reconsider the cloture vote at the moment. Endgame now, unless a last-second negotiation comes through.

I believe this is called the "QUICK DO SOMETHING...ANYTHING...TO CHANGE THE CURRENT MEDIA NARRATIVE" tactic.

Or perhaps that tactic's cousein, the "WE'RE GETTING DESTROYED IN THE MEDIA ALREADY, MIGHT AS WELL CRAM IN AS MUCH BAD SHIT AT ONCE AS POSSIBLE BECAUSE THEY ONLY HAVE SO MANY MINUTES OF AIRTIME TO BLAST US" gambit.

the democrats have a structural advantage in the electoral college and will probably hold the white house for the foreseeable future, even though gerrymandering and rural districts will keep the gop in control of the house. if a democratic president has a friendly DC circuit he can simply do whatever he wants and get them to rubber stamp it.

obama is already going this.

I know, but my point is that they have a structural advantage in the electoral college. They want to get these DC circuit nominees confirmed so the president act unilaterally.

Obama has done all sorts of things using the EPA and the Department of Justice. He's done everything from imposing new coal regulations to unilaterally stopping the deportation of "Dreamers." He's become an imperial president.

Stupid to say DC Circuit requires 11--when it had 12, they cut a vacant seat and moved it over to the Ninth Circuit in 2007 because the DC Circuit caseload is so low. They should cut it to 9. But the GOP is stupid for saying "well it's so low so we should just leave it vacant." No, the solution is to statutorily amend the number of seats on the DC Circuit, not to refuse to fill vacancies.
