agreed, and it really makes Roberts' opinion look dumb. you have a Nigerian fam from the UK, briefly stuck in the US because the pregnant mother is too sick to fly. the kid is born there and is hustled back to the UK as quickly as possible where he lives his life.
why the fuck can't Congress regulate citizenship in those cases? Roberts says it's because in feudal Europe those born on the soil belong to the king of that soil. ok, i guess. but the US Constitution gives Congress all sorts of democratic powers over nationalization and citizenship. the democratic solution is to acknowledge that Congress can act in these marginal cases and at the same time insist that Congress cannot deprive former slaves and their descendants of their citizenship.
