It can be a felony if it is in furtherance of a crime.

It seems to me that the prosecution is taking the position that they don't actually have to prove or even specify what that crime is.

Its almost like whether it was done for a crime is a factual jury question.

I don't think it will hold up on appeal for hundreds of reasons

it's obviously a factual issue but there is a reason we just give the just a state criminal code, tell them the facts, and let them sort it out. the prosecution should have to establish what the second crime is supposed to be. how can the jury be expected to know every crime?
