in any case, you're both making points that are at least somewhat valid: his: 1) US news has a stronger case where the entire page is scanned and linked 2) they likely won't have any case where the simple rankings are posted
yours: 1) they might have a case where the details of the rankings are posted w/o a scan 2) even if they don't have a very good case, they probably have a colorable argument and could cost this website a bundle if they sued |

The case i mentioned below is thought to have been a ruling on the outer boundaries of the idea/expression dichotomy. If the evaluations are expressions then you can't recreate them in a table as if they were mere facts. So, if the case below holds, you are screwed, no?
Even if you took a few numbers out, it would still likely be found to be substantially similar. |
