well, it depends on the nature of the information. databases of simple facts (e.g. telephone books) aren't directly copyrightable in the US (they are in europe). here it might be more complicated b/c the reputational scores are based on (probably) proprietary surveys.

in any case, you're both making points that are at least somewhat valid:

his:

1) US news has a stronger case where the entire page is scanned and linked

2) they likely won't have any case where the simple rankings are posted

yours:

1) they might have a case where the details of the rankings are posted w/o a scan

2) even if they don't have a very good case, they probably have a colorable argument and could cost this website a bundle if they sued

If you are talking about copyright protection then how much time and money you spend is irrelevant. Copying the actual pages of the USNEWS is obvious infringement. There is plenty of text all over the pages that are expression. Copying the tables wouldn't be since it would be mere fact, and the merger doctrine would also apply.

yeah, that's a problem. The case i mentioned below is thought to have been a ruling on the outer boundaries of the idea/expression dichotomy. If the evaluations are expressions then you can't recreate them in a table as if they were mere facts. So, if the case below holds, you are screwed, no?

Even if you took a few numbers out, it would still likely be found to be substantially similar.

Yale above Stanford above Harvard, etc -- this is just an idea, it doesn't matter who came up with it (unless you can patent it). Only its published form is copyrightable (i.e. the scans and copies of the actual pages).
