It would seem that from a utilitarian perspective, it makes sense to look the other way if a CEO who presided over a major company turnaround gets caught snorting coke. Society suffers a net loss from jailing him.
On the other hand, society gets a net gain from jailing some crackhead who robs people to support his habit. Since archetypes like those are correlated with race (whites are disproportionately powerful businessmen and blacks are disproportionately poor crackheads), Barzini's idea isn't as ridiculous on the face as you would make it out to be.
There is a balancing act between justice and utilitarianism and trying to obscure the complexity of the situation with cries of racism reeks of a lack of intellectual rigor. |
