Boalt Dean Recommends Expulsion of Trustafarian

BREAKING: Dean Edley, Boalt, has recommended that the student who posted the threat on XOXO be expelled. The case goes to U.C. Berkeley's Judicial Affairs Office for final adjudication.
April 25, 2007 To: Boalt Community From: Dean Christopher Edley, Jr.
It has been a week since the distressing events involving a Boalt student's threat —a hoax — against the community at Hastings College of the Law. I am writing to let you know that all our actions following the incident have been taken with the intention of securing the safety and well-being of our community and that at Hastings, while respecting the procedural rights of the student.
On Wednesday, April 25, 2007, the Law School filed a complaint with the U.C. Berkeley Judicial Affairs Office against the law student who claimed responsibility for posting the threat on a website. We, the administrative leadership of Boalt, believe that the student's action is clearly in violation of a number of regulations detailed in the Student Code of Conduct. The case will be adjudicated by Judicial Affairs according to campus regulations. Those regulations prohibit us from disclosing the name of the student against whom we are proceeding.
Based on the facts as we understand them today, we have recommended expulsion. This is based not only on the intrinsic wrongfulness of the act itself, but also the disruption, turmoil and emotional toll on the Hastings community and, to a more limited extent, the Boalt community as well. I have received ample evidence of this through a great many emails, some of them painful to read.
This incident has once again confirmed for me the strength and qualities of the Boalt community. Even in this challenging circumstance, you have engaged in thoughtful and productive discussions. We should all take some pride in this, imperfect though we are.

By fessing up, he almost surely has avoided criminal penalties that he had a significantly better chance of facing if the FBI had to spend a couple weeks subpoenaing a bunch of people to get IP logs, and then doing IP traces to locate who posted it. Sure, they may not have caught him. But they may have. Especially since they immediately had the lead that he was a Boalt student. How many males are in the Boalttt 1L class?
There are plenty of other things to do besides being a lawyer. You can't do them if you're in Federal Ass Pounding Prison.
That said, I'm sure he didn't expect this result. |

I defended the decision to evacuate the campus. I defended the FBI's desire to identify and interview him. All those things are reasonable reactions given the circumstances at the time.
But the "threat" was confirmed to be what most people knew it would be: a bad and stupid joke. Trustafarian is guilty of bad judgment. He's not guilty of an offense disqualifying him from the legal profession. He more than made up for his poor judgment by apologizing, coming forward, and cooperating with authorities.
I agree with everyone else on this thread who says that Boalt is making their message loud and clear: DON'T come forward, DON'T be responsible if you make a mistake, DON'T be honest, and DON'T apologize even when you've screwed up. Boalt's decision to try and expel him HARMS the legal profession, rather than bettering it.

This seems like a textbook case of groupthink by the Boalt administration, where enough angry people got in a room and the group eventually coalesced around the most extreme reaction. The series of seemingly self-satisfied e-mails coming from the Dean also supports this interpretation of events.
Hopefully cooler heads will prevail at the actual sentencing phase, though I think it is extremely unlikely that the Judicial Affairs bureaucrats are going to stand up to the Law School administration. My guess is that the decision has already effectively been made. |

By acting as he did, Trusta not only did the moral thing to minimize the repercussions of his recklessness, but he saved the Hastings community from MORE pain and anguish. he should be censored but not expelled. But more importantly, the issue you raise goes more to the adequacy of the evidence, rather than the ultimate guilt/innocence question. The wording of his post might cause some people to believe that he was making a "threat". For example, I could "threaten" you by saying the exact opposite of something and it wouldn't be a defense for me to say that my words did not technically constitute a threat.
